Acceptance of Tract Improvements and Approval of Regulatory Traffic Control
Devices for Tract 8037, Positano Neighborhood C -2 (D.R. Horton Bay, Inc.)

EXECUTIVE SUMMARY:
D.R. Horton Bay, Inc. has constructed the improvements for Tract 8037, Neighborhood C -2,
Positano /Fallon Village in accordance with their Tract Improvement Agreement. It is now
appropriate for the City to accept these improvements and approve the regulatory traffic control
devices.
FINANCIAL IMPACT:
D.R. Horton Bay, Inc. has provided a Warranty Bond (Bond No. 016059457) in the amount of
$427,845.00, issued by Liberty Mutual Insurance Company, to guarantee the improvements
associated with Tract 8037 for one year. Upon acceptance of the improvements, the City will
incur annualized maintenance costs estimated to be $24,000 for street sweeping and street
lighting (monthly), slurry seal (every five years) and asphalt concrete pavement overlay (every
20 years).
RECOMMENDATION:
Staff recommends that the City Council adopt a Resolution Accepting the Improvements for
Tract 8037, Neighborhood C -2, Positano /Fallon Village and Approving the Regulatory Traffic
Control Devices.

D.R. Horton Bay, Inc. (D.R. Horton) entered into a Tract Improvement Agreement with the City
of Dublin on August 17, 2010, for the construction of street and other tract improvements
associated with Tract 8037, also known as Neighborhood C -2 of the Positano development
within the area covered by the Fallon Village Specific Plan. These improvements included

construction of the streets internal to Neighborhood C -2, including Urbino Street; La Strada
Drive between Amantea Way and Valentano Drive; Valentano Drive between Avellina Drive and
La Strada Drive; Brandini Drive between Avellina Drive and La Strada Drive; a portion of
Moorjani Street north of Valentano Drive; a portion of Lattari Street north of Valentano Drive;
and Avellina Drive between Amantea Way and Encanto Way. D.R. Horton Bay, Inc. provided a
Faithful Performance Bond and a Labor & Materials Bond to guarantee construction of these
improvements.
In April 2011, because D.R. Horton had completed approximately 80% of the required tract
improvements, the City Council approved the partial release of these bonds to an amount equal
to twenty five percent (25 %) of the original bond amounts. The tract improvements are now
complete and the developer is requesting that the bonds for this work be released.
D.R. Horton has provided a Warranty Bond in the amount of $427,845.00 (Bond No.
016059457) issued by Liberty Mutual Insurance Company. The bond amount is equal to twenty
five percent (25 %) of the full cost of completion of the improvements and is equivalent to the
reduced bond amounts approved by City Council in April 2011.
The following regulatory traffic control devices will be accepted and approved as part of this
project and added to the City of Dublin Traffic Code:
A. "STOP" signs and markings installed at the following intersections:
• Brandini Drive and Avellina Drive
• Brandini Drive and La Strada Drive
• Urbino Street and Brandini Drive
• Avelllina Drive and Valentano Drive
• Moorjani Street and Valentano Drive
• Lattari Street and Valentano Drive
• Valentano Drive and La Strada Drive

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF TRACT IMPROVEMENTS FOR TRACT 8037, NEIGHBORHOOD C -2,
POSITANO/ FALLON VILLAGE AND APPROVAL OF REGULATORY TRAFFIC CONTROL
DEVICES (D.R. HORTON BAY, INC.)
WHEREAS, D.R. Horton Bay, Inc., the developer of Tract 8037, previously entered into a
Tract Improvement Agreement dated August 17, 2010, Resolution No. 125 -10, with the City of
Dublin, to complete tract improvements associated with Tract 8037, in accordance with plans
on file with the City Engineer; and
WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor
and Materials Bond, each in the amount of $1,711,380.00 to guarantee the installation of these
improvements; and
WHEREAS, the developer previously completed more than 80% of the required
improvements in accordance with said plan, to the satisfaction of the City Engineer; and
WHEREAS, the original Faithful Performance Bond and Labor and Materials Bond were
previously reduced by City Council Resolution No. 37 -11 on April 19, 2011 to $427,845.00
each, equal to 25% of the original bond amounts, to guarantee the installation of the remaining
improvements; and
WHEREAS, the improvements are now complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer, and
WHEREAS, certain traffic regulatory devices have been installed as part of the tract
improvements; and
WHEREAS, the Faithful Performance Bond and Labor and Materials Bond can be
released, in accordance with the authority contained in Section 66499.7 of the Government
Code of the State of California, "Manner of Release of the Security," and replaced with a
Warranty Bond to guarantee the completed work for a one -year period; and
WHEREAS, D.R. Horton Bay, Inc. has provided a Warranty Bond in the amount of
$427,845.00, issued by Liberty Mutual Insurance Company (Bond No. 016059457) to
guarantee the improvements for a one -year period;
NOW, THEREFORE, BE IT RESOLVED that:
1. The tract improvements for Tract 8037 are hereby approved and accepted subject
to a one -year guarantee period.

2. The submitted Warranty Bond issued by Liberty Mutual Insurance Company in the
amount of $427,845.00 (Bond No. 016059457) for the tract improvements for
Tract 8037, be accepted as security for the aforesaid one -year warranty period,
said period to commence on this date and terminate on the 19th day of August,
2015.
3. The original Faithful Performance Bond issued by Safeco Insurance Company of
America (Bond No. 6679180 with bond reduction rider) in the amount of
$427,845.00 for the tract improvements be released.
4. The original Labor and Materials Bond issued by Safeco Insurance Company of
America (Bond No. 6679180 with bond reduction rider) in the amount of
$427,845.00 for the tract improvements be released in accordance with the
requirements of Section 66499.7 of the Government Code of the State of
California.
5. The traffic regulatory devices installed by the developer within the development
are hereby included in the City of Dublin Traffic Code, said regulatory devices to
include the following:
A. "STOP" signs and markings installed at the following intersections:
• Brandini Drive and Avellina Drive
• Brandini Drive and La Strada Drive
• Urbino Street and Brandini Drive
• Avelllina Drive and Valentano Drive
• Moorjani Street and Valentano Drive
• Lattari Street and Valentano Drive
• Valentano Drive and La Strada Drive
