Steven Yee, GHAD Staff EXECUTIVE SUMMARY: Construction of Geologic Hazard Abatement District (CHAD) improvements within Tract 6765 of the Schaefer Ranch development is complete. In accordance with the Plan of Control, the developer is requesting to transfer property and ownership responsibility to the CHAD. FINANCIAL IMPACT: Acceptance of the GHAD property will transfer the ownership and maintenance responsibility from the developer, Schaefer Ranch Holdings, LLC, to the CHAD. Maintenance costs, and all other GHAD costs, will be paid from revenue generated from the assessment levied on residential and non - residential parcels within the Schaefer Ranch GHAD boundary. Assessments have been levied since Fiscal Year 2008 -2009. RECOMMENDATION: District Staff recommends that the Board adopt the Resolution Authorizing the District Manager to Accept Title to Certain Real Property and to Assume Responsibility for the Maintenance of Certain Improvements within the Boundaries of the District. ( U-1-'711 tl_­4 Reviewed By District Engineer DESCRIPTION: The Schaefer Ranch Geologic Hazard Abatement District (CHAD) was formed on December 5, 2006, and included the Plan of Control, dated November 1, 2006. The GHAD consists of a total of twenty -one (21) parcels, totaling approximately 310 acres within Tracts 6765 and 8000 of Schaefer Ranch (Attachment 1). The Plan of Control describes the geologic hazards, provides a plan for prevention, mitigation, abatement, and control of geologic hazards, and identifies the Page 1 of 2 ITEM NO. 8.1 parcels that will be conveyed to the CHAD. The Plan of Control also describes the process for conveyance of property and transfer of responsibility from the Schaefer Ranch developer to the CHAD. On October 1, 2013, City of Dublin accepted improvements as complete for certain parcels within Tract 6765, Schaefer Ranch Unit 1 Phase 2, which included 15 GHAD parcels. The City also accepted improvements as complete within easements over lots 297 through 302 of Tract 6765. Improvements include storm water detention basins, drainage system and maintenance trails. The developer continues to maintain GHAD improvements for a one -year period from City's acceptance. Once the GHAD parcels are transferred from the developer, Schaefer Ranch Holdings, LLC, to the Schaefer Ranch CHAD, all improvements within the GHAD parcels will be maintained by the GHAD as described in the Plan of Control. The cost of on -going maintenance and control of geologic hazards will be funded by assessment levied on residential and non- residential parcels within the Schaefer Ranch GHAD boundary. Schaefer Ranch Holdings LLC is granting 15 parcels and storm drain easements within Tract 6765 to the CHAD. The parcels total approximately 297 acres of land, the majority of which is open space within parcel "U ". The authority in the California Public Resources Code that allows the GHAD to accept title to these properties or easement interests is section 26577. A district may purchase, lease, obtain an option upon, acquire by gift, grant, bequest, or devise, or otherwise acquire any property or any interest in property. The GHAD will receive additional property that is within Schaefer Ranch Unit 2, Tract 8000. Homes within Tract 8000 are still under construction and the City of Dublin has not yet accepted the subdivision improvements within the future GHAD parcels in Tract 8000. Exhibit B to Resolution — Grant Deed Page 2 of 2 RESOLUTION NO. -14 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SCHAEFER RANCH GEOLOGIC HAZARD ABATEMENT DISTRICT AUTHORIZING THE DISTRICT MANAGER TO ACCEPT TITLE TO CERTAIN REAL PROPERTY AND TO ASSUME RESPONSIBILITY FOR THE MAINTENANCE OF CERTAIN IMPROVEMENTS WITHIN THE BOUNDARIES OF THE DISTRICT WHEREAS, California Public Resources Code section 26577 authorizes the District to acquire interests in real property; and WHEREAS, the Plan of Control that was presented to the Board of Directors with the formation documents for the District anticipated that title to the open space parcels would be transferred from the Schaefer Ranch Developer to the District following the construction of improvements and the expiration of a warranty period; and WHEREAS, Staff for the District has reviewed the formation documents and advised the Board of Directors that the Developer has satisfied its necessary obligations to the transfer of title of the open space parcels. NOW THEREFORE, THE BOARD OF DIRECTORS OF THE SCHAEFER RANCH GEOLOGIC HAZARD ABATEMENT DISTRICT DOES HEREBY RESOLVE that Christopher L. Foss, the District Manager, is authorized to accept Grant Deeds, direct the District Clerk to record the Grant Deed and this Resolution of Acceptance, and take such other actions as may be necessary for the District to accept fee title to the open space property depicted and described as Parcels B -1, C -1, D, E, F, G, H, I, L, O, P, Q, R, U, and V, of Tract 6765, and to accept title to the easement depicted and described as GHAD Storm Drain Easement, in the attached Exhibit A, pursuant to the Grant Deed attached as Exhibit B.
