PATRICK WAY BETWEEN REGIONAL sTREET AND GOLDEN GATE O~' (PA 9S'043) WHEREAS, the City of Dublin established a right-of-way aligmnent for a road south of and parallel to Dublin Boulevard between Regional Street and Amador Plaza Road (once known as the Parallel Road, now known as St. Patrick Way) on October 10, 1988, by adopting City Council Ordinance 19-88, in anticipation of further development of the area; and WHEREAS, the City of Dublin approved a Mitigated Negative Declaration for the Parallel Road Project on September 26, 1988, by adopting City Council Resolution 132-88; and WHEREAS, on February 28, 1994, the City Council, at the request of impacted property owners, authorized a study to realign St. Patrick Way between Golden Gate Drive and Regional Street; and WHEREAS, the study recommended a realignment of the established right-of-way line for St. Patrick Way between Regional Street and Golden Gate Drive, an alignment subsequently approved by the Planning Commission on September 24, 1996 and presented to City Council on December 4, 1996; and WHEREAS, the City Council did not take action on the realignment because the property owners withdrew their request for realignment; thus the existing alignment, approved in 1988, remained; and WHEREAS, a recent realignment study has now been completed; and WHEREAS, the recent realignment is similar to the proposed 1996 alignment, although minor technical adjustments have been made, and is generally consistent with the original 1988 because it does not increase or decrease capacity of the proposed roadway; and WHEREAS, the realignment of St. Patrick Way between Regional Street and Golden Gate Drive is compatible with existing land uses and conforms to the underlying land use designations, and because it will not overburden public services; and WHEREAS, the realignment will not have a substantial adverse effect on health or safety, or be substantially detrimental to the public welfare, or be injurious to property or public improvements; and WHEREAS, the City Council has received a report and recommendation from the Planning Commission recommending the realignment of a right-of-way line for St. Patrick Way between Regional Street and Golden Gate Drive; and WHEREAS, it is the intention of the City Council to realign the established right-of-way line for the abovesaid road; and WHEREAS, Sections 7.68.080 through 7168.100 of the Dublin Municipal Code require that a resolution be adopted that sets the time and place for a public hearing and the method and time period to file a protest. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby calls a public hearing pursuant to the provisions of Sections 7.68.080 through 7.68.100 of the Dublin Municipal Code, on December 2, 2003, at 7:00 p.m. in the City Council Chambers, 100 Civic Plaza, Dublin, California, to hear protests and objections to the realignment of the established right-of-way line hereinafter set forth: Right-of-Way Line parallel to and south of Dublin Boulevard between Golden Gate Drive and . . All that certain real property situated in Alameda, State of California, described on the Legal Description (Exhibit A) and illustrated on the Plat Map (Exhibit B). A copy of this Resolution shall be posted in accordance with Section 7.68.070 of the Dublin Municipal Code at least ten (10) days before the date of the he~ng.
