Foss, City Manager " Acceptance of Tract Improvements and Approval of Regulatory Traffic Control Devices for Tract 7654, Neighborhood 8 North, Sorrento East (D.R. Horton Bay, Inc.) Prepared by Jayson Imai, Senior Civil Engineer EXECUTIVE SUMMARY: D.R. Horton Bay, Inc. has constructed the improvements for Tract 7654, Neighborhood 8 North, Sorrento East, in accordance with their Tract Improvement Agreement. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: D.R. Horton Bay, Inc. has provided Maintenance Bonds (Bond Nos. 0180643 and 0180642) in the amounts of $76,775.00 and $69,750.00. Both of the bonds have been issued by Berkley Insurance Company to guarantee the public and private improvements associated with Tract 7654 for one year. Upon acceptance of the improvements, the City will incur annualized maintenance costs estimated to be $3,200 for street sweeping and street lighting (monthly), slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years). Horton Bay, Inc. (D.R. Horton) entered into a Tract Improvement Agreement with the City of Dublin on July 17, 2012, for the construction of street and other tract improvements associated with Tract 7654, also known as Neighborhood 8 North of the Sorrento East development. These improvements included construction of the streets internal to Neighborhood 8 North, including Bramante Lane. D.R. Horton provided Faithful Performance Bonds and Labor & Materials Bonds to guarantee construction of these public and private improvements. The tract improvements are now complete and the developer is requesting that the bonds for this work be released. D.R. Horton has provided a Maintenance Bond for Tract 7654 Public Improvements in the amount of $76,775.00 (Bond No. 0180643) issued by Berkley Insurance Company, and a Maintenance Bond for Tract 7654 Private Improvements in the amount of $69,750.00 (Bond No. 0180642) issued by Berkley Insurance Company. The maintenance bond amounts are equal to twenty five percent (25 %) of the full cost to construct the improvements. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Horton Bay, Inc., the developer of Tract 7654, previously entered into a Tract Improvement Agreement dated July 17, 2012, Resolution No. 124 -12, with the City of Dublin, to complete tract improvements associated with Tract 7654, in accordance with plans on file with the City Engineer; and WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor and Materials Bond, each in the amount of $307,100.00 to guarantee the installation of Tract 7654 public improvements; and WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor and Materials Bond, each in the amount of $279,000.00 to guarantee the installation of Tract 7654 private improvements; and WHEREAS, the improvements are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer, and WHEREAS, certain traffic regulatory devices have been installed as part of the tract improvements; and WHEREAS, the Faithful Performance Bonds and Labor and Materials Bonds can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, "Manner of Release of the Security," and replaced with a Maintenance Bond to guarantee the completed work for a one -year period; and WHEREAS, D.R. Horton Bay, Inc. has provided a Maintenance Bond in the amount of $76,775.00, issued by Berkley Insurance Company (Bond No. 0180643) to guarantee the Tract 7654 public improvements for a one -year period; and WHEREAS, D.R. The original Faithful Performance Bond issued by Berkley Regional Insurance Company (Bond No. 0160522) in the amount of $307,100.00 for the Tract 7654 public improvements be released. 4. The original Labor and Materials Bond issued by Berkley Regional Insurance Company (Bond No. 0160522) in the amount of $307,100.00 for the Tract 7654 public improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 5. The private improvements for Tract 7654 are hereby approved subject to a one - year guarantee period. 6. The submitted Maintenance Bond issued by Berkley Insurance Company in the amount of $69,750.00 (Bond No. 0180642) for the private improvements for Tract 7654, be accepted as security for the aforesaid one -year warranty period, said period to commence on this date and terminate on the 16th day of September, 2015. 7. The original Faithful Performance Bond issued by Berkley Regional Insurance Company (Bond No. 0160523) in the amount of $279,000.00 for the Tract 7654 private improvements be released. 8. The original Labor and Materials Bond issued by Berkley Regional Insurance Company (Bond No. 0160523) in the amount of $279,000.00 for the Tract 7654 private improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 9. The traffic regulatory devices installed by the developer within the development are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: A.
