HomeMy WebLinkAboutReso 219-00 MartinCanyonCreekRESOLUTION NO. 219 - 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR MARTIN CANYON CREEK (HANSEN RANCH) AND CREEK PARCEL DECICATION WHEREAS, the owner-subdivider of Tract 5766 previously entered into a contract with the City of Dublin to improve Martin Canyon Creek in accordance with plans and specifications on file with the City Engineer and dedicate 17.99 acres of Creek parcels, said Tract 5766 identified as follows: a) Subdivider: b) Tract Location: c) Tract Size (Phases I & II): d) Resolution Approving Final Map: e) City Streets Affected: Warmington Homes Intersection of Silvergate Drive and Martin Canyon Creek 180 single-family lot Subdivision No. 110-95, City Council of Dublin None WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as improvements are now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; and WHEREAS, the Final Map for Tract No. 5766, in the incorporated territory of the City of Dublin, County of Alameda, State of California, was accepted by the City Council on September 26, 1995, all in accordance with the provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the Hansen Ranch Owner' s Association, has offered to grant to the City of Dublin all rights, title and interest in the real property of four parcels, which encompass the Creek area through the Hansen Ranch Development, and shown and described in the attached Exhibit A; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within the said Creek parcels be, and they are hereby approved and accepted subject to the aforesaid one-year guarantee; and 2. The aforesaid original performance bond security requirement may be reduced from the amount of $4,000,000 to an amount of $1,000,000, upon acceptance by Staff of the replacement maintenance bond as security for the aforesaid one-year maintenance period; and 1 , The said original performance bond in the amount of $4,000,000 posted in connection with the work involved in the construction of said Tract be hereby released upon acceptance of said maintenance bond. , The said parcels as described in Exhibit A of each Grant Deed, are offered to public use in conformity with the terms of the grant be, and they are hereby accepted; and that the Clerk of this City Council be and is hereby directed to transmit said Grant Deeds to the County Recorder for filing.
