HomeMy WebLinkAboutReso 218-00 CentexDubRanL-5 TDARESOLUTION NO. 218 - 00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AN AMENDMENT TO THE TRACT DEVELOPER AGREEMENT FOR TRACT 6960 (DUBLIN RANCH, PHASE I - NEIGHBORHOOD L-5) WHEREAS, Centex Homes, a Nevada Corporation, the Developer of Tract 6960, Dublin Ranch, Phase I, Neighborhood L-5, executed a Tract Improvement Agreement (hereinafier referred to as Agreement) on February 19, 1999; and WHEREAS, pursuant to the requirements of said Agreement, the Developer has submitted the required bonds to guarantee construction of tract improvements for Dublin Ranch, Phase 1, Neighborhood L-5, and has paid the costs of construction inspection; and WHEREAS, the time limit for completion of tract improvements set by said Agreement has expired; and WHEREAS, the City Engineer has reviewed the Developer' s request for an extension of the time limit for completion of tract improvements to December 30, 2001; and WHEREAS, in order to extend the time limit set by the Agreement, an amendment to the Agreement is needed' NOW, THEREFORE, BE IT RESOLVED that the amendment (Exhibk "A" of this resolution) to the Tract Development Agreement for Tract 6960, Dublin Ranch, Phase 1, Neighborhood L-5, is hereby approved. PASSED, APPROVED AND ADOPTED this 19th day of December, 2000. AYES: Counciimembers Lockhart, McCormick, Oravetz, Zika and Mayor Houston NOES: None AB SENT: Non e ABSTAIN: None ATTEST% fi C/~ K2/G/12-19_00/reso~(itera 4.15) g:ldevelopldub ranch~L-5 Centexlreso amend tr dev agmt L-5 Mayor EXmmT "A" or REso,, TioN /8-2ooo AMENDMENT TO TRACT DEVELOPER AGREEMENT FOR DUBLIN RANCH-PHASE I, TRACT 6960(NEIGHBORHOOD L-5) BETWEEN CITY OF DUBLIN AND CENTEX HOMES WItEREAS, the City of Dublin (hereinafter referred to as "CITY"') and Centex Homes (hereinafter referred to as "DEVELOPER"), entered into a Tract Developer Agreement (hereinafter referred to as AGREEMENT) on February 19, 1999; and WHEREAS, lime limit for completion of certain on-site and off-site improvements (hereinafter referred to as WORK) as set forth in the AGREEMENT has expired, and the DEVELOPER has submitted a request to extend the time limit for completion of said WORK; and WHEREAS, the City Engineer has reviewed the DEVELOPER's request, and determined that, it is in the best interest of the City and the DEVELOPER to approve the request; and WHEREAS, in order to extend the time limit set by the AGREEMENT, an amendment to the AGREEMENT is needed; and WHEREAS, this Amendment hereby incorporates by reference all terms and conditions set forth in the AGREEMENT, and all terms and conditions which are not specifically modified by this Amendment shall remain in full force and effect; and NOW, THEREFORE, the parties hereto agree as follows: Timing of completion of WORK is extended to December 30, 2001.
