A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING THE TRACT IMPROVEMENTS AND APPROVING THE REGULATORY
TRAFFIC CONTROL DEVICES FOR TRACT 7654, NEIGHBORHOOD 8 NORTH, SORRENTO
EAST (D.R. HORTON BAY, INC.)
WHEREAS, D.R. Horton Bay, Inc., the developer of Tract 7654, previously entered into a
Tract Improvement Agreement dated July 17, 2012, Resolution No. 124-12, with the City of
Dublin, to complete tract improvements associated with Tract 7654, in accordance with plans on
file with the City Engineer; and
WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor
and Materials Bond, each in the amount of $307,100.00 to guarantee the installation of Tract
7654 public improvements; and
WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor
and Materials Bond, each in the amount of $279,000.00 to guarantee the installation of Tract
7654 private improvements; and
WHEREAS, the improvements are now complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer, and
WHEREAS, certain traffic regulatory devices have been installed as part of the tract
improvements; and
WHEREAS, the Faithful Performance Bonds and Labor and Materials Bonds can be
released, in accordance with the authority contained in Section 66499.7 of the Government
Code of the State of California, "Manner of Release of the Security," and replaced with a
Maintenance Bond to guarantee the completed work for a one-year period; and
WHEREAS, D.R. Horton Bay, Inc. has provided a Maintenance Bond in the amount of
$76,775.00, issued by Berkley Insurance Company (Bond No. 0180643) to guarantee the Tract
7654 public improvements for a one-year period; and
WHEREAS, D.R. Horton Bay, Inc. has provided a Maintenance Bond in the amount of
$69,750.00, issued by Berkley Insurance Company (Bond No. 0180642) to guarantee the Tract
7654 private improvements for a one-year period
NOW, THEREFORE, BE IT RESOLVED that:
1. The public improvements for Tract 7654 are hereby approved and accepted
subject to a one-year guarantee period.

2. The submitted Maintenance Bond issued by Berkley Insurance Company in the
amount of $76,775.00 (Bond No. 0180643) for the public improvements for Tract
7654, be accepted as security for the aforesaid one-year warranty period, said
period to commence on this date and terminate on the 16th day of September,
2015.
3. The original Faithful Performance Bond issued by Berkley Regional Insurance
Company (Bond No. 0160522) in the amount of $307,100.00 for the Tract 7654
public improvements be released.
4. The original Labor and Materials Bond issued by Berkley Regional Insurance
Company (Bond No. 0160522) in the amount of $307,100.00 for the Tract 7654
public improvements be released in accordance with the requirements of Section
66499.7 of the Government Code of the State of California.
5. The private improvements for Tract 7654 are hereby approved subject to a one-
year guarantee period.
6. The submitted Maintenance Bond issued by Berkley Insurance Company in the
amount of $69,750.00 (Bond No. 0180642) for the private improvements for Tract
7654, be accepted as security for the aforesaid one-year warranty period, said
period to commence on this date and terminate on the 16th day of September,
2015.
7. The original Faithful Performance Bond issued by Berkley Regional Insurance
Company (Bond No. 0160523) in the amount of $279,000.00 for the Tract 7654
private improvements be released.
8. The original Labor and Materials Bond issued by Berkley Regional Insurance
Company (Bond No. 0160523) in the amount of $279,000.00 for the Tract 7654
private improvements be released in accordance with the requirements of Section
66499.7 of the Government Code of the State of California.
9. The traffic regulatory devices installed by the developer within the development
are hereby included in the City of Dublin Traffic Code, said regulatory devices to
include the following:
A. "STOP" signs and markings installed at the following intersections:
• Bramante Lane at Lee Thompson Street
• Bramante Lane at Palermo Way

PASSED, APPROVED AND ADOPTED this 16th day of September, 2014, by the
following vote:
AYES: Councilmembers Biddle, Gupta, Hart, Haubert, and Mayor Sbranti
