HomeMy WebLinkAboutReso 230-03 AmdAgmtDebUngoMcCorRESOLUTION NO. 230 - 03 A RESOLUTION OF THE CITY COUNCIL OF THE cITY OF DUBLIN APPROVING AN AMENDMENT TO AGREEMENT WITH DEBORAH UNGO-MCCORMICK WItEREAS, the City of Dublin (hereinafter referred to as "CITY") and Deborah Ungo- MCCormick (hereinafter referred to as "CONSULTANT'), entered into an agreement on December 1, 2001, to provide Planning and other development services to CITY; and WItEREAS, the City and the Consultant are desirous of continuing the agreement for an indefinite period of time; and WItEREAS, the CONSULTANT agrees to continue performing services at the rate outlined in Exhibit B (revised July 1, 2003) of the contract; and WItEREAS, all services performed by this CONSULTANT are performed at the direction of the Community Development Director on an as needed basis; and NOW TItEREFORE BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the amendment to the agreement with Deborah Ungo-McCormick which is attached hereto as "Exhibit A." BE IT FURTttER RESOLVED that the Community Development Director is authorized to execute the agreement. PASSED, APPROVED AND ADOPTED this 2nd day of December, 2003. AYES: Councilmembers McCormick, Oravetz, Sbranti and Zika and Mayor Lockhart NOES: None ABSENT: None ABSTAIN: None ATrEST~~ ' ~lty dler~ K2/G/12-2-03/reso-un~r6-mccormiek.doc (Item 4.4) Mayor AMENDMENT NO. 2 TO THE CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF DUBLIN AND DEBORAH UNGO-MCCORMICK This amendment is made and entered into this 2nd day of December 2003 by and between the City of Dublin ('°dae City"), a municipal corporation, and Deborah ungo-McCormick, AICP ("Consultant") (collectively the City and Consultant are referred to as '°dae Parties.") o RECITALS On December !, 2001, the Parties entered into the Consulting Services Agreement (''the Agreement") in which Consultant agreed to provide planning and development entitlement processing services to the City in return for hourly compensation, as set forth in the agreement, not to exceed $50,000 per fiscal year. The Parties amended the Agreement on July 1, 2003 to increase the hourly compensation. The Agreement expires on December 1, 2003. The Parties desire to extend the Agreement for an indefinite period and delete the $50,000 annual cap on compensation under the contract. NOW, bo Co THEREFORE, the Parties agree as follows: Subsection 1.1 of the Agreement is amended to read as follows: "1.1 Term of Services. The term of this Agreement shall begin on the date first noted above and shall continue indefinitely, unless the term of the Agreement is otherwise termed, as provided for in Section 8. The first sentence of Subsection 2 of the Agreement is amended to read as follows: "City hereby agrees to pay Consultant at a rate not to exceed $90.00 per hour, notwa~tanding any contrary indications that may be contained in Consultant's proposal, for services to be performed and reimbursable costs incurred under this Agreement." The last two sentences of Exhibit A to the Agreement ("Scope of Services") are amended to read as follows: "Said services are to be performed at the direction of the Community Development Director on an as-needed basis." IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed as of the date and year first above written.
