SUBJECT: Authorization of Units from the Downtown Dublin Development Pool and Related
Community Benefit Agreement Deal Points with Trumark Homes

EXECUTIVE SUMMARY:
Trumark Homes seeks units from the Downtown Dublin Specific Plan Development Pool in
order to develop a project at 7144 Regional Street. Staff will present the negotiated deal points
to be included in the Community Benefit Agreement and is requesting authorization from the
City Council to proceed in its preparation.
FINANCIAL IMPACT:
None.
RECOMMENDATION:
Staff recommends that the City Council authorize preparation of a Community Benefit
Agreement that includes the negotiated deal points summarized in this report.

DESCRIPTION:
Trumark Homes is seeking to develop a residential project at 7144 Regional Street, a 2.6 acre
site that is currently home to Horizon Irrigation. The site currently includes an 8,640 square foot
building, surface parking lot, and outdoor storage area for the irrigation supply company. This
site is located in the Retail District within the Downtown Dublin Specific Plan, as shown the
figure below:

The Downtown Dublin Specific Plan identifies the number of residential units that may be
constructed in the Plan area and establishes a pool of these units. A developer must request
City Council authorization to pull units from this pool and must provide a benefit to the
community for the use of these units. A Community Benefit Agreement is required to ensure
that a benefit is provided and establishes a timeframe in which the developer must construct the
units. The units are returned to the pool at the end of the established timeframe if not
constructed.
The developer, Trumark Homes, has prepared a concept site plan for the development of 64
urban townhome residences (Attachment 1). The developer is currently requesting authorization
for an allocation of up to 70 residential units from the Downtown Dublin Specific Plan
Development Pool in order to proceed with this project. In order to construct the project, the
applicant will need approval of a Community Benefit Agreement, Site Development Review and
a Tentative Map.
Trumark Homes and City Staff have discussed the terms of the proposed Community Benefit
Agreement, as follows:

• Trumark Homes would receive an allocation of up to 70 units from the Downtown Dublin
Specific Plan Development Pool to construct the units. In exchange for the allocation of
development capacity, Trumark Homes will pay a Community Benefit payment of
$10,000 per unit, for a total of $640,000-$700,000 (depending on the size of the final
project), or will construct physical improvements in the Downtown area of an equivalent
value. Potential improvements include the construction of streetscape improvements
along Regional Street and/or the installation of an off-site media filter/trash capture
device that will clean the stormwater for a larger area of Downtown.
• Under the City's Inclusionary Zoning Regulations, the project proposed by Trumark
Homes would require the construction of eight units of affordable housing (12.5% x 64
units). If Trumark modified their concept site plan to accommodate 70 units on the
project site, the affordable requirement would be nine units. Instead of building the
affordable units on the project site, Trumark proposes to comply with the requirements of
the Inclusionary Zoning Regulations by paying an in-lieu fee of $150,000 per unit, due at
the time of Final Map approval.
• The term of the reserving the units obtained from the Development Pool is two years from
the City approval of project entitlements, which in this case will be Site Development
Review and a Vesting Tentative Map, unless that timeframe is extended by the City.
City Council authorization to prepare the Community Benefit Agreement does not imply any
endorsement of the development project. The applicant will need to submit a Site Development
Review (SDR) and Vesting Tentative Map (VTM) application for complete review. This
application will be reviewed concurrently with preparation of the Community Benefit Agreement.
Staff is recommending that the City Council authorize Staff to prepare the Community Benefit
Agreement that contains the deal points as described in this staff report. The Community Benefit
Agreement will be brought to the City Council for consideration after the Planning Commission
approves the SDR and VTM. If the SDR and VTM applications do not move forward, or the
project is not approved, the 70 units will not be allocated from the Development Pool and the
Community Benefit Agreement will not be approved.
