HomeMy WebLinkAboutPC Reso 91-055 PA91-069 DbHondaRESOLUTION NO. 91 - 055 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 91-069 DUBLIN HONDA CONDITIONAL USE PERMIT TO ALLOW THE INSTALLATION OF ONE 35-FOOT TALL FREESTANDING SIGN WITH CHANGEABLE COPY (ELECTRONIC READERBOARD) AT 7099 AMADOR PLAZA ROAD WHEREAS, Ken Allen of Arrow Sign Company, on behalf of the property owner, Ken Harvey, filed a Conditional Use Permit and Site Development Review application requesting approval to remove the existing freestanding sign and install a new freestanding sign with changeable copy (electronic readerboard) and to relocate an existing wall sign to the southern Dublin Honda building elevation; and WHEREAS, the Planning Commission did hold a public hearing on said application on November 4, 1991; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15311(a), Class 11; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the proposed signage, if conditionally approved, is appropriate for the subject property in terms of being compatible with existing land uses in the area and will not overburden public services; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing business identification to the general public for an auto dealership in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D o The use will not be contrary to the specific intent clauses or performance standards established for the district in which it is to be located. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 91-069 Dublin Honda Conditional Use Permit as generally depicted on the plans labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the approval of the related Site Development Review and to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The followinq codes represent those departments/agencies responsible for monitorinq compliance of the conditions of approval. [PL] Planning, [BI Building, [PO] Police, [PW] Public Works, [ADM[ ~dministration/Cit¥ Attorney, [FIN] Finance, [F] Dougherty Regional Fire Authority, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health, [CAL] Caltrans Outdoor Advertising Branch. 1. This Conditional Use Permit approval for PA 91-069 is to allow the installation of a new 35-foot tall double-faced freestanding sign with changeable copy (electronic readerboard). This approval shall generally conform to the plans labeled Exhibit A stamped approved, as modified by the following conditions of approval and associated Site Development Review consisting of a freestanding sign plan, wall sign plan and site plan prepared by Arrow Sign Co. (3 sheets) dated received by the Planning Department October 18, 1991. [PL, B] 2. This Conditional Use Permit approval is for the following freestanding sign: [PL, B] a) "Honda" - internally illuminated cabinet sign Maximum Sign Area: 132 square feet (double-faced) b) Electronic Readerboard - Indirectly illuminated (during nighttime hours) Glow Cubes Maximum Sign Area: 153 square feet (double-faced) Total Maximum Sign Area: Maximum Sign Height: Minimum Setback from Interstate 680 Freeway: Minimum Setback from Rear Property Line: Minimum Setback from Southern Property Line: 285 square feet 35 feet 50 feet (from edge of sign cabinet) 0 feet 40 feet - 2 - o o 10. 11. Prior to the installation of the new freestanding sign, the Applicant shall remove the existing freestanding sign and planter located in the front half of the property. [PL] Prior to issuance of building permits, the Applicant shall receive an outdoor advertising sign permit approval from Caltrans and submit a copy of this approval to the Planning Director. [Pm] The electronic readerboard display of Dublin Honda information/ messages (i.e., identification, inventory, marketing and directional) versus general community interest information/ messages shall be limited to periods that cumulatively do not exceed two (2) Dublin Honda messages for each one (1) community service message during a 12-month period. Display items of general interest to the community shall be limited to items such as time, temperature, and/or date (unless other community service messages are authorized by Caltrans). The message display ratio approved under this Conditional Use Permit (two Dublin Honda messages for every one community service message) shall be reviewed twelve (12) months from the effective date of this approval at the request of the Dublin Planning Commission and/or the Applicant, Dublin Honda. During this review, the Planning Commission may change the approved ratio to not less than a fifty (50) percent dis'play of Dublin Honda messages and a fifty (50) percent display of community service messages during a 12-month period. [PL] The Applicant shall comply with Caltrans regulations regarding the types of messages that are allowed to be displayed on the electronic readerboard. [CAL, PL] The Applicant shall provide to the City of Dublin Planning Department at the beginning of each month a summary indicating the proposed and cumulative to-date number of hours used to display Dublin Honda information/messages and community service messages. [PL] The freestanding sign shall be located within a landscaped area or planter. [PL, B] Ail building permits for the proposed freestanding sign shall be secured and construction commenced within six (6) months of the date of approval of this use permit. The Applicant and/or property owner shall comply with all applicable building code requirements. [B, PL] Any modifications to said freestanding sign shall be subject to review and approval of the Dublin Planning Department. [PL] This approval shall become null and void, in the event the approved use ceases to operate for a continuous one-year period. [PL] - 3 - 12. This use shall be subject to Zoning Investigator review and determination as to compliance with the conditions of approval. [PL] 13. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. [PL] 14. To apply for building permits, the Applicant shall submit six (6) sets of construction plans to the Building Department for plan check. Each set of plans shall have attached an annotated copy of the Resolution of Approval, as well as the applicable Site Development Review resolution. The notations shall clearly indicate how all conditions of approval will be complied with. Construction plans will not be accepted without the annotated resolutions attached to each set of plans. The Applicant will be responsible for obtaining the approvals of all participating non- City agencies prior to the issuance of building permits.
