HomeMy WebLinkAboutReso 056-91 Enea GazeboVariance RESOLUTION NO. 56-91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN GRANTING VARIANCE TO SECTION 2517(b)-7 & SECTION 3203(b) UNIFORM BUILDING CODE (UBG) WHEREAS, Enea Properties Company, 6670 Amador Plaza Road, has applied for a variance to Section 2517(b)-7 & Section 3203(b) Uniform Building Code (UBC) of the City of Dublin, so as to permit a 300 square foot gazebo to be constructed at 6698 Amador Plaza Road, without a Class "B" fire-retardant roof and without solid plywood sheathing; and WHEREAS, the City Council did hold a public hearing on this matter on June 24, 1991; and WHEREAS, the City Council finds that granting the variance is consistant with the purpose of the code and will not lessen the protection to the people of the City and the property situated therein for the following reasons: 1) 2) 3) 4) 5) 6) The structure is very small (approximately 300 square feet). The structure is located 42 feet from the nearest building. The structure does not have any enclosing walls. The structure is a decorative landscape feature and does not have any designated use or occupancy and is not likely to be used for any purpose. The structure is temporary because it is located in the right-of-way of a future street. The hazard of untreated wood shingles can be mitigated by having the surface of the shingles treated periodically. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin City Council does hereby grant the requested variance subject to the condition that the wood shingles be treated with fire-retardant chemicals which are capable of providing a Class B fire-retardant classification every two years.
