SUBJECT:
Supplement Agreement No. 007 with Caltrans to
Reimburse the City of Dublin for Purchase of Right-of-Way
for the Dublin Boulevard Widening Project

RECOMMENDATION:
1. Adopt Resolution approving Supplement Agreement
2. Authorize Director of Public Works to execute Supplement
Agreement
FINANCIAL STATEMENT:
The City of Dublin will be reimbursed for up to $446,014 from
Caltrans for the purchase of right-of-way on Dublin Boulevard for
the Widening project.
DESCRIPTION: At the end of 1994, the City of Dublin was notified by the
Metropolitan Transportation Commission and Caltrans that the Dublin Boulevard Widening Project,
from west of San Ramon Road to east of Village Parkway, had been approved for Federal funding
participation. As part of this project, Dublin needs to acquire some right-of-way for roadway widening.
Alameda County was hired by the City to perform appraisals and acquire the needed right-of-way.
The appraisal map was recently approved by Caltrans, and Caltrans is requiring the City to Sign a
Supplement Agreement prior to reimbursement for the' purchase of the right-of-way. By doing this, the
City will pay property owners for the necessary right-of-way for the project and be reimbursed by
Caltrans with ISTEA monies.
Staff, therefore, recommends that City Council adopt the Resolution approving the Supplement
Agreement and authorize the Director of Public Works to execute this Supplement Agreement.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AUTHORIZING THE SUBMISSION OF PROGRAM
SUPPLEMENT NO. 007 TO THE DEPARTMENT OF
TRANSPORTATION FOR RIGHT-OF-WAY FUNDING
OF THE DUBLIN BOULEVARD WIDENING PROJECT
WHEREAS, the City of Dublin has requested Federal funding for the
Dublin Boulevard Widening Project; and
WHEREAS, as part of this project, the City of Dublin must purchase
necessary right-of-way; and
WHEREAS, to receive this funding, the Department of Transportation
requires an authorizing Resolution to be submitted, along with the Program
Supplement for the project,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin hereby authorizes the Director of Public Works to execute Program Supplement
No. 007 for the Dublin Boulevard Widening Project to the State Local Transportation
Department Program.

State Agreement No. 04-5432 for Right-of-Way funding of the above-referenced
Federal aid Project.
If this Supplement is satisfactory, please have both copies signed by the
appropriate officials, and enter the resolution number and date of execution on the
first page. Return both copies of the Supplement together with a certified copy of
the City Council's Resolution approving the Program and authorizing its
execution.
Following our execution of the Supplemental Agreement, we will return a
copy for your files.

This Program Supplement is hereby incorporated into the Local Agency-State
Agreement for Federal Aid which was entered into between the Local Agency
and the State on 12/12/83 and is subject to all the terms and conditions
thereof. This Program Supplement is adopted in accordance with Paragraph 2
of Article II of the aforementioned Master Agreement under authority of
Resolution No. , approved by the Local Agency on

The Local Agency further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with the covenants or
remarks setforth on the following pages.

SPECIAL COVENANTS OR REMARKS
DATE: 01/04/95
1. Ail maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the Local Agency at regular intervals or as required
for efficient operation of the completed improvements.
2. The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway
Administration in the Federal-Aid Project Agreement (PR-2)/Detail
Estimate, or its modification (PR-2A) or the FNM-76, and accepts
any increases in Local Agency Funds as shown on the Finance or
Bid Letter or its modification as prepared by the Division of
Local Streets and Roads.
3. This Program Supplement will be revised at a later date to
include other phases of work.
4. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Program.
5. Whenever the local agency uses a consultant on a cost plus basis,
the local agency is required to submit a post audit report cover-
ing the allowability of cost payments for each individual consul-
tant or sub-contractor incurring over $25,000 on the project.
The audit report must state the applicable cost principles utili-
zed by the auditor in determining allowable costs as referenced in
CFR 49, part 18, Subpart C - 22, Allowable Costs.
