SUBJECT: County Flood Control District Fees for Development Review
The Alameda County Flood Control District has historically provided plan
check review for land development projects which impact flood control and
drainage facilities. In order to recover the County's cost of providing
these plan review services, the County implemented a schedule of fees for
which the developer pays an amount not to exceed the reasonable cost of
providing the service. This schedule of fees was amended by the Board of

Supervisors on May 11 , 1982 (see attached).
If the City Council wishes to have the County Flood Control District
continue to review land development projects which impact drainage facilities,
it is necessary to adopt the attached resolution.
Recommendation
It is staff's recommendation that the City Council adopt the resolution
concurring with the program of the Alameda County Flood Control District
and Water Conservation District for the following reasons:
1 . The County's program commences on June 1 , 1982 and the City would
be unable to make other arrangements prior to that date.
2. The City will not be subject to any expense from services provided.
3. The developer will pay no more than it costs to actually perform
the review.
4. The District is probably best equipped to review projects that
may impact facilities which it maintains and operates.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
CONCURRING WITH THE PROGRAM OF THE ALAMEDA COUNTY
FLOOD CONTROL AND WATER CONSERVATION DISTRICT
TO CHARGE FEES FOR SERVICES PROVIDED IN THE
INCORPORATED AREAS OF ALAMEDA COUNTY
WHEREAS, by authority of the Alameda County Flood Control and Water
Conservation District Act and by Resolution Number 12936 of the Board of
Supervisors of said District, the District is empowered to charge fees for
services performed in review of land development plans proposed by private
developers in the incorporated areas of Alameda County, those services being
the review of reports, maps and plans to assure provision for proper flood
control and drainage, to determine that suitable methods will be provided
for erosion and sedimentation control , and to oversee other matters related
to flood control and drainage; and
WHEREAS, the District now plans to commence charging fees to cover its
costs for providing said services;
NOW, THEREFORE, BE IT RESOLVED, that this City Council agrees to support
the District's program by continuing to refer appropriate land development
plans to the District for review and by indicating to each applicant that
the District may charge a fee for its review services. Further, that the
City Council reserves the right at any time to make other arrangements and
charge its own fees for the review of land development plans, which impact
flood control and drainage facilities.

SUBJECT: CHARGING FEES FOR FLOOD CONTROL DISTRICT SERVICES IN INCORPORATED AREAS
We met recently with members of your Public Works and Planning Departments
to discuss our new fee collection program. This program will enable us to recover
costs for services provided in the incorporated areas of the County, and will
commence about June 1, 1982.
Our meetings have been held with those cities that for some years have
been sending us plans to review for land development projects. As you know, we
review proposed flood control and drainage facilities, erosion and sedimentation
control measures, and related work. This effort is mainly directed to projects
which could have a significant effect on a natural watercourse or that would drain
into a District facility.
At the meetings we distributed copies of the County resolution which
authorizes this program, the current fee schedule and a proposed Model Resolution
which cities could adopt to indicate their support. We now would like to substitute
a new Model Resolution for the one we gave you. The new resolution is simpler and
has no attached fee schedule. Of course, whether a city adopts a resolution in
concurrence with our program is optional . From the meetings we have held, it
appears that staff personnel of some cities will propose that their city council
adopt a resolution of concurrence, while others will advise their city council of
this program. In all cases, it is apparent that the cities will continue to select
proposed land development plans for our review and inform applicants that a fee
is required for requested services. Where a city elects to do its own review
for a project which includes drainage facilities, it is important that a copy of
the development plans be sent to us for our records.

A copy of the new suggested Model Resolution is enclosed. We will send
letters out shortly to many developers, builders, architects and engineers to
apprise them of this program.

WHEREAS, Resolution No. 12936, which was adopted by the Board of
Supervisors on July 7, 1981 , includes a schedule of fees shown as Exhibit "A
said fees are to be charged for services provided by the Alameda County Flood
Control and Water Conservation District in the incorporated areas of Alameda
County; and
WHEREAS, it now has become desirable to amend said Exhibit "A" to
clarify certain parts thereof and to provide a schedule of required deposits where
the fee will be based on actual costs;
NOW, THEREFORE, BE IT RESOLVED, that the present fee schedule shown as
Exhibit "A" be rescinded and that the attached amended fee schedule, titled Exhibit
"A", Revision 1 , and dated March 30, 1982, be substituted therefor as the schedule
of fees to be charged by the District for services performed in the incorporated
areas of the County;

The following fees shall be paid for services provided by the Alameda County
Flood Control and Water Conservation District:
Service Referral Fee
1. Variance $ 6.00
2. Conditional Use Permit 10.00

For appropriate Service Referrals designated above, and for final stages of
Planned Development (PD), Subdivision Improvement Plans, Drainage Plans, and work
performed for Local Improvement Districts, actual costs will be charged. (Actual
costs include labor, fringe benefits, and allowance for overhead.) A deposit
will be generally charged for actual cost items based on the following schedule:
Required deposit for review of drainage plans, where required
fee is based on actual costs:
Subdivisions: 0 to 50 units $300.00
50 to 100 units 500.00
over 100 units 800.00
Other Plans: less than 1 acre . . 100.00
1 to 5 acres 200.00
5 to 10 acres 500.00
over 10 acres 800.00
As an alternative to the above schedule for actual cost deposits, upon request
of the applicant a deposit will be charged based on the estimated actual costs.
Payment of estimated cost or the above fee, as appropriate, shall be made to the
Alameda County Flood Control and Water Conservation District, 399 Elmhurst
Street, Hayward, California 94544, when filing the application.
Costs may be charged for other items, based on a cost estimate for required.
services. Fees will not be charged for preliminary inquiries or for review
referrals where the City provides a review service at no cost to the applicant.
Where a deposit is paid on the basis of estimated cost, or on the basis of the
above list of deposits, an adjustment shall be made as follows after completion of
services by the District and determination of actual cost:
1. An excess of deposit will be returned to the applicant.
2. Where the District incurs additional cost beyond the deposit for
its services, the applicant shall pay the amount of the excess cost.
