Foss, City Manager " SUBJECT: Resolution of Intention to Approve an Amendment to Contract between the Board of Administration California Public Employees' Retirement System (CaIPERS) and the City of Dublin Prepared by Julie Carter, Human Resources Director EXECUTIVE SUMMARY: The City of Dublin is a contracting agency of the California Public Employees' Retirement System (CaIPERS). The Employees' Pension Reform Act of 2013 (PEPRA) was implemented effective January 1, 2013. The City of Dublin has only non-represented employees. With the passing of PEPRA, the City of Dublin is required to approve a Resolution to begin a contact amendment process to continue to share the costs of CaIPERS employer contributions with its non-represented employees. FINANCIAL IMPACT: There is no fiscal impact associated with initiating a CaIPERS contract amendment process. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution of Intention to Approve an Amendment to Contract between the Board of Administration California Public Employees' Retirement System (CaIPERS) and the City of Dublin. Reviewed By Assistant City Manager DESCRIPTION: The City of Dublin is a contracting agency of the California Public Employees' Retirement System (CaIPERS). The Employees' Pension Reform Act of 2013 (PEPRA) was implemented as law on January 1, 2013. The City of Dublin has only non-represented employees. With the passage of PEPRA, Section 20516 of the Government Code was amended to read 20516 (a): Page 1 of 2 ITEM NO. 4.4 Notwithstanding any other provision of this part, with or without a change in benefits a contracting agency and its employees may agree, in writing, to share the costs of the employer contribution. The cost sharing pursuant to this section shall also apply for related non- represented employees as approved in a resolution passed by the contracting agency, and The City of Dublin desires to start a CaIPERS contract amendment process to continue to share the costs of CaIPERS employer contribution with its employees. Dublin's non-represented employees have, by individual signature, provided an acknowledgment of the City's desire to start the contract amendment process pursuant to Government Code Section 20516 (a). As required by the passing of PEPRA, Exhibit A is provided within the City Council's Resolution for approval. NOTICING REQUIREMENTS/PUBLIC OUTREACH: Not applicable. ATTACHMENTS: 1. Exhibit A— CaIPERS Non-Represented Employees (Classic and New) 3.05% Employee Cost Sharing Signature Acknowledgement Page 2 of 2 RESOLUTION NO. - 15 A RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (Ca1PERS) AND THE CITY OF DUBLIN WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in the California Public Employees' Retirement System (Ca1PERS) by the execution of a contract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said Law; and WHEREAS, the City of Dublin is a contracting agency of the California Public Employees' Retirement System (Ca1PERS); and WHEREAS, Employees' Pension Reform Act of 2013 (PEPRA) was implement as law on January 1, 2013; and WHEREAS, with the passing of PEPRA Section 20516 of the Government Code was amended to read 20516 (a): Notwithstanding any other provision of this part, with or without a change in benefits a contracting agency and its employees may agree, in writing, to share the costs of the employer contribution. The cost sharing pursuant to this section shall also apply for related non-represented employees as approved in a resolution passed by the contracting agency; and WHEREAS, the City of Dublin employees are non-represented; and WHEREAS, the City of Dublin desires to start a Ca1PERS contract amendment process to share the costs of the employer contribution of 3.05% with all New and Classic Ca1PERS members; and WHEREAS, all preexisting agreements of cost-sharing for Classic Ca1PERS members remains in place at 3.95%; and WHEREAS, the amount of the new cost sharing 3.05% shall be in addition to the previously approved cost sharing amount for Classic Ca1PERS members for a total of 7%; and WHEREAS, the non-represented employees of the City of Dublin have by individual signature provided their acknowledgment of the City's desire to start the Ca1PERS contract amendment process (Exhibit A). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby give notice of the intent to amend the contract between the City of Dublin and the Board of Administration of the California Public Employees' Retirement System (Ca1PERS) for cost sharing pursuant to Government Code Section 20516 (a), and authorize staff to work with Ca1PERS on receipt of the schedule of agency actions for planning and finalize such contract amendment.
