CONFERENCE WITH LEGAL COUNSEL-EXISTING LITIGATION (Paragraph (1) of subdivision (d) of Section 54956.9) Name of case: Zovich & Sons, Inc. v. City of Dublin; Alameda Superior Ct. Case No. RG15760263 A regular meeting of the Dublin City Council was held on Tuesday, March 17, 2015, in the City Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:03 p.m., by Mayor Haubert. ROLL CALL PRESENT: Councilmembers Biddle, Gupta, Hart, Wehrenberg, and Mayor Haubert ABSENT: None PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the City Council, Staff and those present. REPORT ON CLOSED SESSION ACTION 7:03 p.m. Mayor Haubert stated there was no reportable action during Closed Session. ORAL COMMUNICATIONS Proclamation for Youth Art Month, March 2015 7:04 p.m. 3.1 The City Council presented the proclamation for Youth Art Month, March 2015. Steve Minniear, Dublin resident, provided public comment. Anita Carr, Dublin resident, provided public comment. David Bewley, Dublin resident, provided public comment. By consensus, the City Council agreed to hear Item 8.3 as the first item of New Business. CONSENT CALENDAR 7:18 p.m. Items 4.1 through 4.5 On motion of Cm. Biddle, seconded by Cm. Hart and by unanimous vote, the City Council took the following actions: Approved (4.1) Minutes of the March 3, 2015 Special City Council Meeting, March 3, 2015 Regular City Council Meeting, and the March 7, 2015 Special City Council Meeting; Received (4.2) the Payment Issuance Report and Electronic Funds Transfers Listing. Continued (4.3), by motion as required by Government Code Section 8630(c), which states that the City Council shall review the need for continuing a local emergency at least once every 30 days until the governing body terminates the local emergency, the State of Emergency that was declared on March 18, 2014, based on the fact that extreme drought conditions continue to exist within both the State of California and the City of Dublin, and the threat to the safety and welfare of Dublin residents remains. Biddle as the City's representatives to discuss conditions of employment for the City Manager. WRITTEN COMMUNICATIONS - None. PUBLIC HEARINGS - None UNFINISHED BUSINESS - None NEW BUSINESS General Plan and Dublin Crossing Specific Plan Amendment Study Initiation Request 9:11 p.m. 8.1 Amy Miller, President of Dublin Unified School District (DUSD) Board, provided public comment on this item. David Bewley, Dublin resident, provided public comment on this item. On motion of Cm. Biddle, seconded by Vm. Gupta and by unanimous vote, the City Council adopted RESOLUTION NO. 36 - 15 APPROVING THE INITIATION OF A GENERAL PLAN AND DUBLIN CROSSING SPECIFIC PLAN AMENDMENT STUDY TO: 1) INCORPORATE THE 1.5 ACRE CHABOT CREEK INTO THE COMMUNITY PARK AND INCREASE THE ACREAGE DEVOTED TO MEDIUM DENSITY RESIDENTIAL BY 1.5 ACRES; 2) RE-DESIGNATE THE 13 ACRE "MIXED USE" SITE TO "GENERAL COMMERCIAL/DC MEDIUM-HIGH DENSITY RESIDENTIAL"; 3) ALLOW USE OF THE SITE DESIGNATED "SCHOOL" FOR BOTH SCHOOL AND PARK PURPOSES (APNS 986-0001-001-15 (PARTIAL), 986-0034-002-00, AND 986-0034-006-00.) Approval of Memorandum of Understanding (MOU) Between the City of Dublin and the Dublin Unified School District(DUSD), and Initiation of General Plan and Eastern Dublin Specific Plan Amendment Study, and Other Required Entitlements, to Allow Use of Approximately 10 Acres of Property Currently Designated as Parks/Public Recreation (Community Park) for Both School and Park Purposes 9:57 p.m. 8.2 Amy Miller, President of Dublin Unified School District (DUSD) Board, provided public comment on this item. Greg Tomlinson, DUSD Boardmember/Dublin resident, provided public comment on this item. David Bewley, Dublin resident, provided public comment on this item. Dr. Stephen Hanke, DUSD Superintendent, provided public comment on this item. On motion of Vm. Gupta, seconded by Cm. Biddle and by unanimous vote, the City Council adopted RESOLUTION NO. 37 - 15 RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DUBLIN AND THE DUBLIN UNIFIED SCHOOL DISTRICT DUBLIN CITY COUNCIL MINUTES 4 VOLUME 34 REGULAR MEETING MARCH 17, 2015 Informational Report on Residential Development Projects 7:19 p.m. 8.3 Marlene Massetti, Dublin resident, provided public comment. David Bewley, Dublin resident, provided public comment. Richard Bond, Dublin resident, provided public comment. By consensus, the City Council asked Staff to schedule a study session to discuss options regarding non-vested properties in the City. OTHER BUSINESS 10:55 p.m. Brief information only reports were provided by the City Council and Staff, including committee reports and reports by City Council related meetings attended at City expense (AB1234). Vm. Gupta asked that an item be brought back to City Council regarding community outreach for tree removals on City property. ADJOURNMENT 10.1 There being no further business to come before the City Council, the meeting was adjourned at 11:01 p.m. in memory of Staff Sgt. Sean Diamond and our fallen troops.
