HomeMy WebLinkAboutReso 48-15 Brannnigan St. Accept Improv RESOLUTION NO. 48 - 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING THE TRACT IMPROVEMENTS, APPROVING THE TRAFFIC SIGNAL MODIFICATIONS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES INSTALLED WITH TRACT 8093, BRANNIGAN SUBDIVISION WHEREAS, Lennar Homes of California, Inc., a California Corporation, the developer of Tract 8093, previously entered into a Tract Improvement Agreement dated February 19, 2013, Resolution No. 15-13, with the City of Dublin, to complete tract improvements associated with Tract 8093, including public improvements along Brannigan Street and traffic signal modifications at the intersection of Gleason Drive and Brannigan Street, in accordance with plans on file with the City Engineer; and WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor and Materials Bond, each in the amount of $864,000.00 to guarantee the installation of Tract 8093 private improvements; and WHEREAS, the developer originally provided a Faithful Performance Bond and a Labor and Materials Bond, each in the amount of $144,000.00 to guarantee the installation of Tract 8093 public improvements; and WHEREAS, the public and private improvements are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer, and WHEREAS, the traffic signal modifications at the intersection of Gleason Drive and Brannigan Street are complete in accordance with said plans and any approved modifications thereto to the satisfaction of the City Engineer; and WHEREAS, the Faithful Performance Bonds and Labor and Materials Bonds can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, "Manner of Release of the Security," and replaced with a Maintenance Bond to guarantee the completed work for a one-year period; and WHEREAS, Lennar Homes of California, Inc. has provided a Warranty Bond in the amount of $216,000.00, issued by Platte River Insurance Company (Bond No. 387888M) to guarantee the Tract 8093 private improvements for a one-year period; and WHEREAS, Lennar Homes of California, Inc has provided a Warranty Bond in the amount of $36,000.00, issued by RLI Insurance Company (Bond No. CMS0270318-M) to guarantee the Tract 8093 public improvements for a one-year period; and WHEREAS, the traffic signal modifications at the intersection of Gleason Drive and Brannigan Street is a regulatory traffic control device. Page 1 of 3 NOW, THEREFORE, BE IT RESOLVED that: 1. The private improvements for Tract 8093 are hereby approved and accepted subject to a one-year guarantee period. 2. The submitted Warranty Bond issued by Platte River Insurance Company in the amount of $216,000.00 (Bond No. 387888M) for the private improvements for Tract 8093, be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 21st day of April, 2016. 3. The original Faithful Performance Bond issued by Developers Surety and Indemnity Company (Bond No. 387888S) in the amount of $864,000.00 for the Tract 8093 private improvements be released. 4. The original Labor and Materials Bond issued by Developers Surety and Indemnity Company (Bond No. 387888S) in the amount of $864,000.00 for the Tract 8093 private improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 5. The public improvements for Tract 8093 are hereby approved subject to a one- year guarantee period. 6. The submitted Warranty Bond issued by RLI Insurance Company in the amount of $36,000.00 (Bond No. CMS0270318-M) for the public improvements for Tract 8093, be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 21st day of April, 2016. 7. The original Faithful Performance Bond issued by RLI Insurance Company (Bond No. CMS0270318) in the amount of $144,000.00 for the Tract 8093 public improvements be released. 8. The original Labor and Materials Bond issued by RLI Insurance Company (Bond No. CMS0270318) in the amount of $144,000.00 for the Tract 8093 public improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 9. The regulatory traffic control devices installed by the developer within the City's right-of-way are hereby included in the City of Dublin Traffic Code, and said regulatory devices to include the following: • Traffic signal modifications at the intersection of Gleason Drive and Brannigan Street Page 2 of 3 PASSED, APPROVED AND ADOPTED this 21st day of April, 2015, by the following vote: AYES: Councilmembers Biddle, Gupta, Hart, Wehrenberg, and Mayor Haubert NOES: None ABSENT: None ABSTAIN: None - Mayor ATTEST: !?
