HomeMy WebLinkAboutReso 050-90 ROW LineAccessRdRESOLUTION NO. 50 - 90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ADOPTING A RESOLUTION OF INTENTION TO ESTABLISH A RIGHT-OF-WAY LINE FOR A TWO-LANE ACCESS ROAD CONNECTING TO THE HACIENDA INTERCHANGE AND FROM DOUGHERTY ROAD TO TASSAJARA ROAD RECITALS The City Council of the City of Dublin does resolve as follows: The Council has received a report and recommendation from the Planning Commission recommending the establishment of a right-of-way line for a two-lane access road connecting to the Hacienda Interchange and from Dougherty Road to Tassajara Road. It is the intention of the City Council to establish a right-of-way line for the abovesaid road. Pursuant to the provisions of Sections 3 and 6 of Dublin Ordinance No. 44-87, the City Council hereby calls a public hearing on May 14, 1990, 7:30 p.m. in the City council Chambers, 100 Civic Plaza, Dublin California, to hear protests and objections to the establishment of proposed right-of-way lines as hereinafter set forth: All that certain real property situate in the City of Dublin, State of California, described as follows: Two Lane Access Road All that certain real property situated in the City of Dublin, County of Alameda, State of California, described as follows and as described on the attached Exhibit A. A copy of this Resolution shall be posted in accordance with Section 7 of Ordinance No. 44-87 at least ten (10) days before the date of the hearing. Any person having any interest in any land as described above upon which said right-of-way lines are proposed to be established may file a written objection with the City Clerk at any time not later than the hour set for hearing objections. AYES: NOES: ABSENT: Councilmembers Hegarty, Jeffery, Snyder, Vonheeder and None None Mayor C t [intent2] A strip of land of the uniform width of 110 feet measures at right angles, and lying 65 feet southerly of, and 45 feet northerly of the following described line: COMMENCING at the southeasterly corner of Tract 4978, as said Tract was recorded June 5, 1984, in Book 144 of Maps, at Pages 3 thru 5, Office of the Recorder, County of Alameda, said point also being on the southwesterly right-of-way line of a 50' strip belonging to Southern Pacific Transportation Company, thence northwesterly along the southwesterly side line of 50' foot strip, and the easterly line of said Tract 4978, North 46 degrees 29'26" West, 49.77 feet; to the True Point of Beginning; thence, leaving said sidelines, South 88 degrees, 47' 37" East, at 74.29 pass the northeasterly right- of-way line of said 50' foot strip, also being the southwesterly line of that certain parcel of land described as Parcel No. 3 in the deed from Southern Pacific Transportation Company, a Delaware Corporation, to the County of Alameda, in a deed dated November 27, 1985 and recorded December 12, 1985, Series No. 85-264889, Official Records of Alameda County, continuing through said Parcel No. 3, a total distance of 148.58 feet terminating on the northeasterly sideline of said Parcel No. 3. Side lines of said strip of land to be lengthened or shortened so as to terminate on the West at the northeasterly sideline of said Tract 4978, and on the East at the northeasterly sideline of said Parcel No. 3, land to the County of Alameda (85~264889).
