Kauffman Seconded by Commissioner John P. Gardella WHEREAS Tom Gentry, (V-3669) has filed with the Alameda County Planning Commission an application for an adjustment to (1 ) permit a private recreation center (swim club) in a residential district without a Use Permit; (2) to permit a six foot high fence to be built upon the front property line where a setback of 20' from the right of way is required; and (3) to reduce front yard from required 20' to JO' in an "R-1-B-5" (Single Family Residence, 7,000 square feet minimum building site area; 70' minimum average width; 7' side yards) District, located on the south side of Silvergate Drive, 85 ' west of Amarillo Road and opposite the inter- section with Castilian Road, Dublin Area, Pleasanton Township, as shown on a map on file with this Commission; and WHEREAS this Commission did hold a public hearing on said application at the hour of 1 :30 p.m . on the 2nd day of May, 1966, in the County of Alameda Public Works Building, 399 Elmhurst Street, Hayward, California; and WHEREAS it satisfactorily appears from affidavits on file that newspaper notice of said public hearing was given in all respects as required by law; and WHEREAS this Commission does find that : (a) There are special circumstances applicable to the property which deprive the property of privileges enjoyed by other property in the vicinity under the identical zoning classification. (b) The granting of the application will not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone. (c) The use will not be detrimental to persons or property in the neighborhood or to the public welfare: Now Therefore BE IT RESOLVED that this Commission does hereby approve said application as shown on a plot plan labelled "Exhibit A" on file with this Commission, a copy of which shall be forwarded to the County Building Official , subject to the following conditions; (1 ) Slope the driveway as shown on the plan at a minimum slope of 0.3%. These grades shall not conflict with the curb grades approved by the County Surveyor's Office. (2) Do not block the runoff from the adjacent properties. (3) Do not augment the runoff to the adjacent properties. (4) A public water supply shall be made available to the premises. (5) The premises shall be connected to a public sewage disposal system. (6) The construction and operation of the public swimming and wading pool shall be in accordance with the California Health and Safety Code. Except as specifically stated above, the land and use of this property shall comply with all the provisions of the County Zoning Ordinance. Resolution No. 7546 Page 2 May 2, 1966 There shall be full compliance with all conditions prior to final inspection by the Building Inspection Division. Said adjustment shall be subject to revocation for cause by the Planning Commission after seven (7) days notice and a hearing by said Commission.
