HomeMy WebLinkAboutReso 76-15 Jordan Rch Tr8074 Accpt Improvements RESOLUTION NO. 76 - 15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING TRACT 8074 IMPROVEMENTS; APPROVING THE REGULATORY TRAFFIC CONTROL DEVICES FOR TRACT 8074; AND APPROVING THE IMPROVEMENTS WITHIN FUTURE FALLON VILLAGE GHAD PARCELS CONSTRUCTED WITH TRACT 8074, JORDAN RANCH WHEREAS, BJP-ROF Jordan Ranch, LLC, the developer of Tract 8074, previously entered into a Tract Improvement Agreement, dated June 5, 2012, City Council Resolution No. 71-12, with the City of Dublin, to complete improvements associated with Tract 8074, in accordance with plans on file with the City Engineer; and WHEREAS, with said Tract Improvement Agreement, the developer also agreed to construct landscape and irrigation improvements within future Fallon Village GHAD Parcels — Parcel A of Tract Map 8074, Parcels C and I of Tract Map 8024, Parcel K of Tract Map 7855, and Parcels A and C of Tract Map 7853; and WHEREAS, the developer provided Faithful Performance and Labor and Materials Bonds, each in the amount of $3,929,410.00 (Bond No. 0582780) issued by International Fidelity Insurance Company to guarantee the said Tract 8074 and future Fallon Village GHAD Parcel improvements; and WHEREAS, the developer subsequently completed more than 80% of the required Tract 8074 and future Fallon Village GHAD Parcel improvements in accordance with said plans, to the satisfaction of the City Engineer; and WHEREAS, the original Faithful Performance Bond was reduced by City Council Resolution No. 14-14 on February 18, 2014 to $982,352.50, equal to 25% of the original bond amount, to guarantee the installation of the remaining improvements; and WHEREAS, the Tract 8074 improvements are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, certain traffic regulatory devices have been installed as part of the Tract 8074 improvements; and WHEREAS, the improvements within the future Fallon Village GHAD Parcels — Parcel A of Tract Map 8074, Parcels C and I of Tract Map 8024, Parcel K of Tract Map 7855, and Parcels A and C of Tract Map 7853 — are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the Faithful Performance Bond and Labor and Materials Bonds can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period; and Page 1 of 3 WHEREAS, BJP-ROF Jordan Ranch, LLC, has provided a Maintenance Bond in the amount of $982,352.50 issued by International Fidelity Insurance Company (Bond No. 0582780) to guarantee the improvements for a one-year period. NOW, THEREFORE, BE IT RESOLVED that: 1. The tract improvements for Tract 8074 are hereby approved and accepted, subject to a one-year guarantee period. 2. The landscape and irrigation improvements within the future Fallon Village GHAD Parcels — Parcel A of Tract Map 8074 and Parcels C and I of Tract Map 8024, Parcel K of Tract Map 7855, and Parcels A and C of Tract Map 7853 — are hereby approved. 3. The submitted Maintenance Bond issued by International Fidelity Insurance Company (Bond No. 0582780) in the amount of $982,352.50 for the Tract 8074 Improvements and improvements within future Fallon Village CHAD parcels constructed with Tract 8074, be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 2nd day of June, 2016. 4. The original Faithful Performance Bond issued by International Fidelity Insurance Company (Bond No. 0582780 with bond reduction rider) in the amount of $982,352.50 for the Tract 8074 Improvements be released. 5. The original Labor and Materials Bond issued by International Fidelity Insurance Company (Bond No. 0582780) in the amount of $3,929,410.00 for the Tract 8074 Improvements be released in accordance with the requirements of §66499.7 of the Government Code of the State of California. 6. The traffic regulatory devices installed by the developer within the development are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: A. "STOP" signs, markings and crosswalks installed at the following intersections: • La Vina Street near station 0+50 • Jordan Ranch Drive at the intersection of Valley Vista Drive and La Vina Street • Jordan Ranch Drive at the intersection of Vinton Avenue • Jordan Ranch Drive at the intersection of Avery Way • Avery Court at the intersection of Avery Way • Kinsley Street at the intersection of Vinton Avenue • Kinsley Street at the intersection of Avery Way • Avery Way at the intersection of Alta Terra Road Page 2 of 3 B. Curve Warning with 10 MPH advisory speed signs on the following street: • North and South sides of Jordan Ranch Drive near Station 18+50 C. Curve Warning with 15 MPH advisory speed signs on the following street: • North and South sides of La Vina Street near Station 13+50 D.
