A RESOLUTION OF THE PLANNING COM/~ISSION
OF THE CITY OF DUBLIN
APPROVING PA 85-073 TEXACO FOOD STORE CONIDITONAL USE PERMIT/SITE
DEVELOPMENT REVIEW 7840 APLADOR VALLEY BLVD.
WHEREAS, Michael J. Major Civil Engineers (Applicant)
and Texaco, Inc. (Owners) request approval of a Conditional Use
Permit/Site Development Review application for the proposed
remodeling of an existing Type A Service Station at 7840 Amador
Valley Blvd. (to add a convenience food store), more specifically
described as APN 941-305-20-2; and
WHEREAS, the adopted City of Dublin Zoning Ordinance
requires a Conditional Use Permit to amend the range of uses
and/or services of a Type A Service Station; and
WHEREAS, the Planning Commission did hold a public
hearing on said application on October 7, 1985; and
WHEREAS, proper notice of said public hearing was
given to all respects as required by law; and
WHEREAS, this application has been reviewed in
accordance with the provisions of the California Environmental
Quality Act and has been found to be categorically exempt; and
WHEREAS, the Planning Commission finds that the
Conditional Use Permit/Site Development Review will not have
significant environmental impact; and
WHEREAS, the Staff report was submitted recommending
that the Conditional Use Permit/Site Development Review
application be approved; and
WHEREAS, the Planning Commission did hear and consider
all said reports, recommendations and testimony herein above
setforth; and
WHEREAS, the proposed land use, if conditionally
approved, is appropriate for the subject property in terms of
being compatible to existing land uses in the area and will not
overburden public services;
NOW THEREFORE,
Commission finds:
BE IT RESOLVED THAT THE Planning
a)
Modification and expansion of the uses of the existing Type
A service station to add a convenience food store provides
for the public need to provide a range of services not
readily available in the City;

The uses will be properly related to other land uses, and
transportation and service facilities in the vicinity, as
the proposed uses of the building are compatible when
compared to the type and nature of operations typically
found in retail business district areas and the uses
currently in operation in the immediate vicinity;
The uses will not materially adversely affect the health or
safety of persons residing or working in the vicinity, or be
materially detrimental to the publc welfare or injurious to
property or improvements in the neighborhood, as all
applicable regulations will be met;

The uses will not be contrary to the specific intent clauses
or performance standards established for the District in
which they are to be located;
e)
The approval of the Conditional Use Permit will be
consistent with the Dublin General Plan;
BE IT FURTHER RESOLVED that the Planning Commission
does hereby conditionally approve said Conditional Use
Permit/Site Development Review application as shown by materials
labelled Attachment 3, on file with the Dublin Planning
Department, subject to the following conditions:
1. Operation of the convenience food store-Type A service
station shall be as generally as shown on the site and floor
plans and as described by the applicant's written statement,
collectively submitted with the application and dated received
August 20, 1985. Development shall be subject to final review
and approval by the Planning Director prior to the issuance of a
building permit and shall be subject to the conditions listed
below.
2. The permit is issued to the owner, Texaco, Inc., only and
shall not be transferable.
3. The permit for the food convenience store shall be valid for
a period of two (2) years, at which time the applicant may
request an administrative extension for an additional five (5)
years from the Zoning Administrator. The Zoning Administrator
may grant the extension upon making a determination that the
findings made as part of this resolution remain applicable.
Failure to establish the use within one year of the effective
date of the permit will cause the permit to become null and void.
4. No loudspeakers or amplified music shall be permitted
outside the enclosed building. All activities associated with
food convenience store shall be conducted entirely within
enclosed building.
5. Ail signs established at this site shall be subject to
review and approval by the Planning Director as regards size,
location, copy, construction materials and design.
6. Comply with the requirements of the Dublin Building
Inspection Department.
7. Prior to the issuance of a building permit, the developer
shall submit a letter documenting that the requirements of the
D.S.R.S.D. - Fire Department have been, or will be, satisfied.
8. Development shall comply with the City of Dublin Police
Services Standard Commercial Building Security Requirements.
9. The two existing pole mounted signs indicating the types of
credit cards that are honored at the subject service station
shall be removed, the total aggregate area of the existing
monument sign and the four existing free standing/portable price
signs shall be modified as necessary to conform with the maximum
aggregate sign area allowed by the existing sign ordinance
regulations. Any modifications to the existing monument sign
shall be subject to the Site Development Review process. It is
recommended that the gasoline pricing information be "formalized"
into a modified monument sign.
10. Formal on-site parking for a minimum of six parking spaces
shall be developed as generally depicted in the Staff Study
prepared for this project and dated September, 1985. An
alternate scheme may be utilized if approved by the Planning
Director.
11. The proposed remodeling/addition shall utilize exterior
materials to match or compliment the existing exterior materials.
The brick veneer of the screen wall at the southwest corner of
the site shall be repaired.
12. Existing "yard lights" shall be repaired, replaced or
modified as necessary to be brought up to "first-class"
operational status and to prevent glare unto adjoining properties
or along Amador Valley Blvd. or Regional Street. Lighting
utilized shall be of an energy efficient nature. Replacement of
the existing lighting system with a more up to date pole mounted
lighting system is recommended, foot candle and photometric
patterns shall be subject to review and approval by the Planning
Director.
13. correct deficiences in the existing frontage improvements to
the satisfaction of the City Engineer, (e.g., cracked, offset
sidewalks).
14. The applicant shall formally close off vehicular through
traffic around the southwest corner of the building by way of
installation of landscaping and parking improvements as generally
depicted on Staff Study B prepared for this project and dated
September, 1985. Alternatively, subject to review and approval
by the Planning Director, the location of the existing telephone
booth may be modified in conjunction with the adjustment to the
free standing screen wall at the southwest corner of the service
station to provide adequate room for vehicular passage.
15. The landscaping plan shall be modified to include the
planting of 15 gallon sized trees of a species and location
determined acceptable to the Planning Director. A minimum of
fifteen new trees shall be planted on this site.
16. The food convenience store use established under this permit
shall be subject to review after the one-year anniversary of
initial occupancy to determine compliance with the above
conditions or what additional requirements may be needed. The
Planning Director may refer the matter back to the Planning
Commission for disposition at that time.
17. At any time during the effectiveness of this approval, the
approval shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance.
