HomeMy WebLinkAbout85-073 Texaco Food StoreTO: FROM: SUBJECT: CITY OF DUBLIN PLANNING COMMISSION AGENDA STATEMENT/STAFF REPORT Meeting Date: October 7, 1985 Planning Commission Planning Staff PA 85-073 Texaco Food Store Conditional Use Permit and Site Development Review GENERAL INFORMATION PROJECT: Conditional Use Permit and Site Development Review applications for a proposed remodeling of an existing service station to add a convenience food store for the sale of prepackaged sandwiches, candy, soft drinks, cigarettes, beer, wine and novelties. APPLICANT AND REPRESENTATIVE: Jean S. Mesick Michael J. Majors, Civil Engineers 2500 Old Crow Canyon Road, Suite 118 San Ramon, California 94583 PROPERTY OWNER: Texaco, Inc. 3350 Wilshire Blvd. Los Angeles, California 90050 PROPERTY, ZONING AND LOCATION: 7840 Amador Valley Blvd., Zoned C-i; Retail Business District (APN 941-305-20-2) SURROUNDING LAND USE AND ZONING: The subject property is surrounded by various existing retail business uses. All properties immediately adjoining the service station carry the C-l; Retail Business District Zoning Classification. ZONING HISTORY: The service station constructed as a Type A Service Station in 1972 based on the approval of a Conditional Use Permit by the Alameda County Zoning Administrator on May 12, 1971 (C-2292). APPLICABLE REGULATIONS: Section 8-48.2 establishes Conditional Uses in C-l; Retail Busines Districts. Subsection 1) establishes Type A Service Stations, as Conditional Uses Type A (facility retailing automotive parts and supplies which are installed and serviced on the site but which do not include engine, transmission or differential rebuilding or auto repair). A new Conditional Use Permit Application is required to amend the range of uses and/or services provided in an existing Type A Service Station. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; ITEM NO. and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions, includinq but not limited to the following matters: a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; e) compliance with requirements of other departments of the City/County Government. ENVIRONMENTAL REVIEW: Categorically exempt NOTIFICATION: Public Notice of the October 7, 1985, hearing was published in the Tri-Valley Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: The addition of the food convenience store operation is proposed to occur within the existing foot print of the 30' x 60'+_ service station structure. The range of sales items listed by the applicant include the sale of prepackaged sandwiches, candy, soft drinks, cigarettes, beer, wine and novelties. A review of the site revealed that several minor up-grades to the subject property appear warranted in conjunction with the expansion of uses at the site to give it a "finished" appearance. These up-grades include: - Removal of illegal signs and adjustment to the size/number of price signs to conform with existing sign ordinance standards. - Provision of formal on-site parking. - Repair of exterior brick veneer areas that have fallen into disrepair (south west corner of building). - Repair, replacement or modification of existing yard lights. - Modification of location of the telephone booth and adjustment to the screen-wall of the south west corner of the building to provide improved access around the subject building (or alternatively, formal closure of access around th~ building). - Upgrading of site landscaping, including the introduction of 15 gallon trees. Use of the site as a service station-food convenience store appears to be an appropriate use of the subject property, consistent with the intent of the C-1 District and with existing, surrounding uses. -2- RECOMMENDATION FORMAT: 1 ) Open public hearing and hear staff presentation 2) Take testimony from applicant and the public 3) Question staff, applicant and the public 4) Close public hearing and deliberate 5) Adopt Resolution regarding the Conditional Use Permit/Site Development Review. ACTION: Staff recommends the Planning Commission approve the Conditional Use Permit/Site Development Review Application PA 85-073.
