SUBJECT: Acceptance of In-Tract Improvements for Tract 7854, Neighborhood "B",
Positano/ Fallon Village (Braddock and Logan) and Approval of Regulatory Traffic
Control Devices

EXECUTIVE SUMMARY:
Braddock and Logan Services, Inc., dba Braddock and Logan Group II, L.P., has constructed
the tract improvements for Tract 7854, Neighborhood "B", Positano/ Fallon Village in
accordance with the Improvement Agreement for Tract 7854. It is now appropriate for the City
to accept these improvements and approve the regulatory traffic control devices.
FINANCIAL IMPACT:
Braddock and Logan has provided warranty bonds (Bond No. 227 43 63A, in the amount of
$962,120 and Bond No. 227 43 64A, in the amount of $244,310), issued by Insurance Company
of the West, to guarantee for one year the improvements associated with Tract 7854. Braddock
and Logan has also provided a performance bond and a labor and materials Bond, each in the
amount of $187,960 (Bond No. 724224S, provided by Developers Insurance and Indemnity
Company, to guarantee completion of landscaping in the Neighborhood "B" stormwater quality
pond, The City will incur annualized maintenance costs for these improvements, estimated to be
$62,000 for landscaping, street sweeping, and street lighting (monthly), slurry seal (every five
years) and asphalt concrete pavement overlay (every 20 years).
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution Accepting Improvements for Tract
7854 and Approving Regulatory Traffic Control Devices.

DESCRIPTION:
Braddock and Logan Services, Inc., dba Braddock and Logan Group II, L. P., entered into an
Improvement Agreement with the City of Dublin on April 15, 2008, for the construction of street
and other tract improvements associated with Tract 7854, also known as Neighborhood "B" of
the Positano development within the area covered by the Fallon Village Specific Plan. These
improvements included the internal streets for Neighborhood "B" as well as rough grading for
the 5-acre neighborhood park site and construction of a bio-retention pond for stormwater
treatment. (Attachment 1).
Braddock and Logan Group I I, L. P. provided performance bonds and labor and materials bonds
to guarantee construction of the improvements as outlined below:

The tract improvements (Phase I and II) are now complete (with the exception of landscaping
within the stormwater quality pond), and the developer is requesting that the bonds for this work
be released. Braddock and Logan has provided warranty bonds, for each phase, in the amount
of $962,120 (Bond No. 227 43 63A) and $244,310 (Bond No. 227 43 64A) by the Insurance
Company of the West. The bonds are in the amount of 25% of the full cost of completion of the
improvements ($4,826,080). The existing performance bonds were taken in the amount of
$1,206,520 because the in-tract work was approximately 75% complete at the time the Tract
7854 map was filed and there was no need for the developer to post bonds for 100% of the cost
of the work. For this reason, the performance bond and labor and materials bond is equal to the
value of the warranty bond.
The developer has also provided a performance bond and a labor and materials bond, each in
the amount of $187,960 (Bond No. 724224S), by the Developers Insuracne and Indemnity
Company, to cover the cost of completing the landscaping within the Neighborhood "B"
stormwater quality pond. The pond is currently being used to provide sediment control for
construction in Neighborhoods C, D, and E, and it is not currently practical to install the
landscaping located in the floor of the pond. The bond will ensure completion of the landscaping
prior to the pond being turned over to the Fallon Village Geologic Hazard Abatement District for
maintenance.
The following regulatory traffic control devices will be accepted and approved as part of this
project and added to the City of Dublin Traffic Code:

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF IN-TRACT IMPROVEMENTS FOR TRACT 7854, NEIGHBORHOOD "B ",
POSITANO/ FALCON VILLAGE (BRADDOCK AND LOGAN) AND APPROVAL OF
REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, Braddock and Logan Group II, L. P., the developer of Tract 7854, previously
entered into an Improvement Agreement dated April 15, 2008, Resolution No. 56-08, with the
City of Dublin, to complete in-tract improvements associated with Tract 7854, in accordance
with plans on file with the City Engineer; and
WHEREAS, the developer provided a performance bonds and a labor and materials
bonds, each in the amount of $ $962,120 for Phase 1 Improvements and $244,310 for Phase 2
improvements, to guarantee the installation of these improvements; and
WHEREAS, the improvements are complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer, and
WHEREAS, the performance bond and labor and materials bond can be released, in
accordance with the authority contained in Section 66499.7 of the Government Code of the
State of California, "Manner of Release of the Security," and replaced with a warranty bond to
guarantee the completed work for cone-year period; and
WHEREAS, Braddock and Logan Group II, L. P., has provided warranty bonds in the
amount of $1,206,430 issued by Insurance Company of the West (Bond No, 227 43 63A and
Bond No. 227 43 64A) to guarantee the improvements for cone-year period; and
WHEREAS, Braddock and Logan Group II, L. P., has provided a performance bond and
labor and materials bond, each in the amount of $187,960 issued by the Developers Insurance
and Indemnity Company (Bond No. 724224S), to guarantee completion of landscaping in the
Neighborhood "B" stormwater quality pond;
NOW, THEREFORE, BE IT RESOLVED that:
1. The in-tract improvements for Tract 7854, are hereby approved and accepted
subject to a one-year guarantee period.
2. The original Performance Bond issued by Insurance Company of the West (Bond
No. 227 43 63) in the amount of $962,210 for the improvements be released.
3. The original Labor and Material Bond issued by Insurance Company of the West
(Bond No. 227 43 63) in the amount of $962,210 for the improvements be
released.

4. The original Performance Bond issued by Insurance Company of the West (Bond
No. 227 43 64) in the amount of $244,310 for the improvements be released.
5. The original Labor and Material Bond issued by Insurance Company of the West
(Bond No. 227 43 64) in the amount of $244,310 for the improvements be

6. The traffic regulatory devices installed by the developer within the development
are hereby included in the City of Dublin Traffic Code, said regulatory devices to
include the following:
