Foss, City Manager SUBJECT: Human Services Commission Vacancy Prepared by Caroline P. Soto, City Clerk/Records Manager EXECUTIVE SUMMARY: The City Council will discuss options for filling a recent, unanticipated vacancy on the Human Services Commission. That term has an ending date of December 2018. FINANCIAL IMPACT: None. RECOMMENDATION: Staff recommends that the City Council discuss options for filling the unscheduled vacancy and provide Staff direction on proceeding with the appointment process. Reviewed By Assistant City Manager DESCRIPTION: A member of the Human Services Commission, Melissa Sladden, resigned from the Human Services Commission on October 13, 2015, leaving an unscheduled vacancy. Ms. Sladden’s term would have ended in December 2018. California Government Code Section 54974. (a) states, “Whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, whether due to resignation, death, termination, or other causes, a special vacancy notice shall be posted in the office of the clerk of the local agency, the library designated pursuant to Section 5473, and in other places as directed by the legislative body, not earlier than 20 days before or not later than 20 days after the vacancy occurs. Final appointment to the board, commission or committee shall not be made by the legislative body for at least 10 working days after the posting of the notice in the clerk’s office.” The City Clerk’s Office has not posted the vacancy as of yet, pending discussion and direction by the City Council. Options for the City Council’s consideration are: ITEM NO. 8.5 Page 1 of 2  Direct Staff to post the unscheduled vacancy no later than 20 days after the vacancy occurred and request applications, for the Mayor’s consideration, from interested Dublin citizens for consideration of filling the term ending December 2018; or  Direct Staff to post the unscheduled vacancy no later than 20 days after the vacancy occurred and have the Mayor recommend from the applications submitted by citizens in November 2014, for the term ending December 2018. Those applicants include: Bruce Gekko Thanh Hoang Antonio Ticsay Rajan Patel Anjing Wang  Provide alternate direction to Staff, in conformance with the Government Code 54974, to fill the unscheduled vacancy on the Human Services Commission. For any of the above options, the appointment could be made at the November 3, 2015 Regular City Council meeting. The next regularly scheduled Human Services Commission meeting is scheduled for November 19, 2015. NOTICING REQUIREMENTS/PUBLIC OUTREACH: None. ATTACHMENTS: 1. (b) Notwithstanding subdivision (a), the legislative body may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. A person appointed to fill the vacancy shall serve only on an acting basis until the final appointment is made pursuant to this section.
