Item 7.1 June 5, 2012 OH-e, Industrial Carting Mayor Tim Sbranti and Honorable City Council Members The City of Dublin I00 Civic Plaza Dublin, CA 94568 RE: CONSTRUCTION AND DEMOLITION DEBRIS COLLECTION OPTIONS Dear Mayor Sbranti and Honorable City Council Members: Industrial Carting is a debris box and construction and demolition recycling facility located in Sonoma County. Industrial Caning has been in business for over 60 years and operates in several counties where open market competition for debris box and Construction and Demolition services are permitted Upon recent review of the June 5, 2012 Staff Report to the Dublin City Council, we have found options that we believe the Council may want to consider: 1) Request that all C&D haulers meet the same obligations negotiated with AVI. 2) Implement strict reporting requirements that provide for the revocation of the C&D non-exclusive franchise, if reporting requirements are not satisfied. 3) Require all C&D haulers to report haulers that are not approved by the City to assist in the enforcement effort. 4) Consider negotiating an increased franchise fee or other revenue sharing opportunities that would net the same amount of money to fund the small business program and school discount offered by AVI. Note that the school districts are legally allowed to bid their garbage services separately from the City's exclusive franchise, therefore, obtaining significant rate reductions, which could far exceed the$100,000 economic benefit offered by AVI. 5) Consider the exclusive contract, which may be worth several million dollars in comparison with the$200,000"economic benefit"offered by AVI. The non-exclusive C&D franchises are a small part of the overall exclusive garbage contract that the"economic benefit"would not make a significant difference, especially considering the schools can legally bid their garbage services at any time and could receive more than the$100,000 in "economic benefit". two to - I P.O. Box 2638• Batmen Park.CA 94927•phone•/71171 Catlin _ e_ .. .._ _ __ ", A m «t June 5,2012 City of Dublin Additionally,as we have previously presented to the Dublin City Council in our letter dated April 17, 2012, we reiterate the following regarding exclusive franchise agreements for Construction and Demolition services: 1) Customer rates increase significantly and the ratepayer loses their freedom to choose the hauler that best meets their requirements(e.g.: Leed and CalGreen reporting). 2) Specialized services (e.g.: weekend delivery and emergency services). 3) Compliance with regulations (e.g.: AB 341 Mandatory Commercial Recycling, Climate Protection and CEQA impacts). Further, competition and free markets are essential to a strong local economy, where competition drives innovation,fair market pricing and the best service. Therefore, Industrial Carting urges the Dublin City Council to continue allowing open market competition for the non-exclusive franchises for Construction and Demolition debris box haulers.
