City Council approval is needed to file the map and to amend an existing deed restriction that encumbers the new lots. FINANCIAL IMPACT: KB Homes previously provided Performance and Labor & Materials Bonds to guarantee construction of the street, grading, utility improvements and landscaping within Silvera Ranch Phase 4, and will pay the cost of construction inspection. These improvements are under construction and the bonds remain in place. Therefore, additional security will not be required as part of this map. Once these improvements are accepted, the City will incur maintenance costs for City- maintained improvements within Tract 7540. The Homeowners' Association will be responsible for maintaining the project - related landscape features within the public right -of- way. Community Parkland and Neighborhood Parkland dedication requirements will be satisfied through payment of in -lieu fees at the time of building permits for the lots. RECOMMENDATION: Staff recommends that the City Council: 1) Adopt the Resolution Approving the Final Parcel Map for Parcel Map 10053 and 2) Adopt the Resolution Amending the Declaration of Deed Restrictions for Tract 7441. x Submit ed By Public Works Director Submitted By Administrative Services Director Reviewed by Assistant City Manager Page 1 of 2 ITEM NO. 4.12 DESCRIPTION: KB Homes, dba KB Home South Bay, Inc., is filing the Final Parcel Map for Parcel Map 10053 to create 4 additional lots within Tract 7540, Silvera Ranch Phase 4 (Attachment 1). The map includes an offer of dedication for right -of -way on Cydonia Court and for a public service easement. KB Homes purchased Tract 7540, Silvera Ranch Phase 4 from Pinn Brothers Fine Homes in 2011 and subsequently filed the Final Map to create 44 individual lots for the construction of homes on these lots. The map also included Parcels "J" and "K ", which were reserved for open space purposes. KB Homes later filed Tentative Parcel Map 10053 to re- subdivide Parcel "K" to create an additional four lots for the construction of single family homes. The majority of Parcel "K" will remain open space. The tentative map was approved by the Planning Commission on March 27, 2012 (Resolution No. 12 -16). The Final Parcel Map for Parcel Map 10053 has been reviewed and found to be in conformance with the Tentative Map and Conditions of Approval approved by the Planning Commission. KB Homes had previously executed an Improvement Agreement in December 2010 for the tract improvements for Tract 7540 and guaranteed the improvements through bonds. For this City Council action, KB Homes is only securing approval of the Final Parcel Map and there is no need to execute an Improvement Agreement or provide bonds for the parcel map. The resolution approving the final map is attached (Attachment 2). Parcel "K" is currently encumbered by an open space deed restriction, which was recorded simultaneously with the filing of the Tract 7441 final map ( Silvera Ranch Phase I, the parent map of Tract 7540). The deed restriction forbids development or other alteration of the parcel, to ensure that it remains open space into perpetuity. The attached Resolution Approving Amendment to Declaration of Deed Restrictions for Tract 7441 (Attachment 3) would approve the Amendment to Declaration of Deed Restriction (Attachment 4). The amendment would remove the deed restriction from the area covered by the four proposed lots while leaving the current restrictions on the remainder of the parcel. NOTICING REQUIREMENTS /PUBLIC OUTREACH: Public noticing occurred as part of the Tentative Map process. Approval of the Final Parcel Map is affirmation of the Final Map's concurrence with the approved Tentative Map. A copy of this report has been provided to KB Homes. ATTACHMENTS: 1.
