EXECUTIVE SUMMARY:
The City Council will discuss options for filling a recent, unanticipated vacancy on the Human
Services Commission. That term has an ending date of December 2016.
FINANCIAL IMPACT:
None.
RECOMMENDATION:
Staff recommends that the City Council fill the unscheduled vacancy through an appointment
process at its November 17, 2015, regular City Council meeting.

DESCRIPTION:
A member of the Human Services Commission, Claudia McCormick, resigned from the Human
Services Commission on October 19, 2015, leaving an unanticipated vacancy. Ms.
McCormick’s term would have ended in December 2016. California Government Code Section
54974. (a) states, “Whenever an unscheduled vacancy occurs in any board, commission, or
committee for which the legislative body has the appointing power, whether due to resignation,
death, termination, or other causes, a special vacancy notice shall be posted in the office of the
clerk of the local agency, the library designated pursuant to Section 5473, and in other places as
directed by the legislative body, not earlier than 20 days before or not later than 20 days after
the vacancy occurs. Final appointment to the board, commission or committee shall not be
made by the legislative body for at least 10 working days after the posting of the notice in the
clerk’s office.”

At its October 20, 2015, regular meeting, Staff informed the City Council of another recent
unanticipated vacancy on the same Commission. The City Council’s direction at that time was
to post the vacancy, accept applications for consideration of appointment by the Mayor, with
approval of the full City Council, at its November 17, 2015 regular meeting. The City Council
also directed Staff to use these same applications for any subsequent unanticipated vacancies
on the Commission. Staff posted this vacancy on Wednesday, October 28, 2015, and will
present the Mayor’s two recommendations for approval of the full City Council, at the
November 17, 2015 regular City Council meeting.
The next regularly scheduled Human Services Commission meeting is scheduled for
November 19, 2015.

54974. (a) Whenever an unscheduled vacancy occurs in any board,
commission, or committee for which the legislative body has the
appointing power, whether due to resignation, death, termination, or
other causes, a special vacancy notice shall be posted in the office
of the clerk of the local agency, the library designated pursuant to
Section 54973, and in other places as directed by the legislative
body, not earlier than 20 days before or not later than 20 days after
the vacancy occurs. Final appointment to the board, commission, or
committee shall not be made by the legislative body for at least 10
working days after the posting of the notice in the clerk's office.
(b) Notwithstanding subdivision (a), the legislative body may, if
it finds that an emergency exists, fill the unscheduled vacancy
immediately. A person appointed to fill the vacancy shall serve only
on an acting basis until the final appointment is made pursuant to
this section.
