regarding illegal sandwich board or A-frame signs.

DESCRIPTION At its meeting of November 1, 1982, the Planning
Commission requested Staff to prepare a letter regarding illegal
sandwich board or A-frame signs. The letter was. to be distributed to
store owners or operators by the zoning investigator as she came upon
such illegal signs. A draft of the letter is attached.
The reason for the letter was the perceived increase in the number and
visibility of illegal sandwich board signs especially along Village
Parkway and Dublin Blvd. The letter requests voluntary removal of the
illegal signs. If necessary, formal zoning enforcement actions would
begin five days after the zoning investigator delivered the letter.
At present, new signs requests are reviewed for compliance to the
zoning ordinance and zoning enforcement is handled on a site specific
conplaint basis.
As the City Council may recall, during the Council ' s consideration
of the Kentucky Fried Chicken sign, the City Council agreed not to take
action against an existing sign until the City reviewed and revised its
present sign ordinance. Pro-active enforcement of that portion
of the ordinance which regulates A-frame signs as requested by the
Planning Commission, would be a departure from the City Council ' s
earlier action. Therefore, before Staff enforces that portion of the
ordinance, Council direction is requested.

SUBJECT: Illegal Sandwich Board or A-Frame Signs in C-1 and C-2
Districts (Excludes C-2-B-40 Districts)
Store Owner or Operator:
It has been noted that you have placed a sandwich board or A-frame
sign on the property around your business. The Zoning Ordinance
adopted by the City of Dublin specifically regulates the size,
location and height of free standing business signs (such as
sandwich board and A-frame signs) . Sandwich board and A-frame
signs which do not meet the specific zoning regulations are
illegal and considered zoning violations .
The Zoning Ordinance reads in part as follows :
Section 8-48 . 8 . 1 BUSINESS SIGNS. Business signs are
permitted according to either of the following two
options, provided that if one option is used, the right
to the use of the other is waived:
Option I : Wall Signs and Projecting Signs. . . .
Option II : Wall Signs and Free Standing Signs: .
Size: Area of all signs shall not exceed one and one-
half (12) square feet for each lineal foot of lot
frontage on an approved street at the front lot line.
The total sign area of any one sign shall not exceed
three hundred (300) square feet and no wall sign (s)
shall be utilized so as to exceed frontage ratios
contained in this Section. No business sign shall be
limited by this Section to less than twenty-five (25)
square feet.
Type and Location: Wall signs are permitted. Only
one (1) freestanding sign shall be permitted for
each lot subject to the conditions that: (1) said
freestanding sign shall be located in a planter of
appropriate dimension; (2) said freestanding sign
shall be located within the middle one-third (1/3) of
the street frontage when said freestanding sign is
within twenty (20) feet of said street frontage; (3)
said freestanding sign shall be a maximum of ten (10)
feet high and have a maximum area of thirty (30)
square feet, provided that for each one (1) foot that
said freestanding sign is set back from the nearest
street frontage the maximum height may be increased by
one-half (2) foot and the area may be increased
five (5) square feet; (4) said freestanding sign shall
not in any case exceed thirty-five (35) feet in height.
A sign for a service station may be combined with a

8-70 . 65 (p) , and the area of the combined sign may
exceed these height-area-setback regulations by
thirty-two (32) square feet.
Character: No sign shall be flashing or intermittent,
.contain moving parts, or be located so as to be
directed towards lands in any adjacent R District.
Section 8-107 . 0 VIOLATION A MISDEMEANOR. Any person, firm,
or corporation, whether as principal, agent, employee
or otherwise, violating or causing or permitting the
violation of any of the provisions of this Chapter is
guilty of a misdemeanor. . Such person, firm or corpor-
ation is guilty of a separate offense for each and every
'day during which any portion of which any violation
of this Chapter is committed, continued or permitted
by such person, firm or corporation.
Section 8-107.1 PENALTY.. . The violation of any of the
provisions of this Chapter is punishable by a fine of
not more than five hundred (500) dollars or by imprison-
ment in the County jail for a term not exceeding six (6)
months or both.
I would appreciate it if you would remove any illegal sandwich
board or A-frame signs immediately. Your cooperation in the
early removal of illegal signs will:
- allow the permitted signs to function more effectively
in communicating business information to potential
customers;
- improve the sight distance and traffic safety of shoppers
travelling to .and from our stores; and
- improve the overall attractiveness and economic vitality
of our commercial areas.
If illegal signs are not removed within five days of this letter
being delivered to you, I will begin formal zoning enforcement
actions to have the zoning violations corrected.
