HomeMy WebLinkAboutItem 3.4 Rhoda Ave Extension Tr 4668 Accpt Work H CITY OF DUBLIN AGENDA STATEMENT MEETING DATE : February 28 , 1983 SUBJECT Acceptance of Work - Tract 4668 Substitution of Performance Bond EXHIBITS ATTACHED Resolution; Location Map; Letter from County Public Works Director OION Adopt resolution to: 1) accept the work completed in Tract 4668, and 2 ) accept letter of credit as a substitution for the performance bond ( $1, 450, 000) in connection with the guarantee of work performed in Tract 4668 . FINANCIAL STATEMENT: City Manager has a letter of credit in the amount of $362 , 500 to guarantee against defects for one year. No immediate maintenance costs other than street lights and sweeping. DESCRIPTION All work in connection with the subject tract has been completed in accordance with the terms of the subdivision contract, and acceptance of the work is now in order. The original approvals and inspection was performed under County of Alameda jurisdiction and personnel . Pertinent information concerning the tract is as follows : a. Subdivider : Santa Barbara Savings & Loan Association, a California Corporation b. Tract location: Southwesterly corner of the intersection of San Ramon Road and the .extension of Alcosta Boulevard adjacent to and northerly of Tract 3733 providing for the extension of Rhoda Avenue, Southwick Drive in the City of Dublin. C . Tract size: 87 lots on 26 .47 acres d. Resolution approving Final Map: 190413 e. City streets affected: Fenwick Way, Southwick Drive Bloomington Way, Putnam Court, Rhoda Place, Rhoda Avenue, Augusta Court, San Ramon Road At the time the County and the subdivider executed the contract for the Tract improvements, the subdivider was required to post a performance bond in the amount of $1, 450, 000 to provide the necessary security for the performance of the work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with the authority contained in Section 66499 . 7 of the Government Code, to an amount necessary to guarantee maintenance of the work for a one-year period following acceptance of the work. The subdivider has provided a letter of credit in the amount of $362 , 500 which is 25% of the original bond required, and which is sufficient to cover the one-year maintenance guarantee period. ---------------------------------------------------------------------------- COPIES TO: Santa Barbara Savings ITEM NO. Z/ & Loan Association RESOLUTION NO. - 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ---------------------------------- FOR THE ACCEPTANCE OF IMPROVEMENTS TRACT 4668 WHEREAS, the owner-subdivider of the aforesaid tract previously entered into a contract with the County of Alameda to improve the said tract in accordance with plans and specifications on file with the Director of Public Works of the said County of Alameda, said tract identified as follows : a. Subdivider: Santa Barbara Savings & Loan Association, a California Corporation b. Tract location: Southwesterly corner of the intersection of San Ramon Road and the extension of Alcosta Boulevard adjacent to and northerly of Tract 3733 providing for the extension of Rhoda Avenue, Southwick Drive and the City of Dublin. , C . Tract size: 87 lots on 26 . 47 acres d. Resolution approving Final Map: 190413 e . City .streets affected: Fenwick Way, Southwick Drive, Bloomington Way, Putnam Court, Rhoda Place, Rhoda Avenue, Augusta Court, San Ramon Road WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said Director of Public Works of the County and the City Engineer; and WHEREAS, as a condition of said contract, the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as the tract work is now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499 . 7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; NOW, THEREFORE, BE IT RESOLVED that : 1 . The improvements completed within the said tract be and they are hereby approved and accepted subject to the aforesaid one-year guarantee; 2 . The aforesaid original performance bond security requirement be and it is hereby reduced from the amount of $1, 450, 000 to a revised security requirement in the amount of $362 , 500 and the replacement letter of credit in the said amount of $362 , 500 be and it is hereby accepted as security for .the aforesaid one-year guarantee period. 3 . That the said original performance bond in the amount of $1, 450 , 000 posted in connection with the work involved in the construction of the said tract be and it is hereby released in full . Box 2340 Dublin, CA 94568 Dear Mr. Thompson: Tract 4668 has been inspected by Alamda County during the construction of the improvements under the contract between Alameda County Board of Supervisors and Santa Barbara Savings and Loan Association, a California corporation, the subdivider. This office is satisfied that all improvements have been completed except as noted below: Fifty-three street trees remain to be planted. A Letter of Credit to guarantee the tree planting has been accepted by this office. We will request that you be named in a new Letter of Credit to supersede the one on file. Monument adjustments are necessary and an Instrument of Credit has been accepted by this office to guarantee the completion of monument adjustment. The guarantee for 1 year maintenance, a Letter of Credit, in the amount of Three Hundred Sixty Two Thousand, Five Hundred Dollars ($362,500) is enclosed. Subject to the above conditions this office can recommend that the City accept the improvements for Tract 4668. Contra Costa County has accepted those improvements constructed on Alcosta Boulevard within Contra Costa County. The Dublin San Ramon Services District has accepted the sanitary sewer mains, water mains and appurtenant facilities in Tract 4668. Enclosed are copies of the following documents: location map, copy of contract, Resolutions of Alameda County Supervisors accepting final map and in lieu park fees, letters from San Ramon Services District accepting facilities, Guarantee Letter of Credit.
