FINANCIAL STATEMENT: Acceptance of property deeds will be in accordance
with City Council approved projects and expenditures.
DESCRIPTION State Law requires governmental agencies to execute a
certificate or resolution of acceptance whenever deeds or grants conveying
any interest in or easement upon real estate are prepared for recordation.
The consent must be attached to or printed on the deed or grant.
The City currently has several transactions involving real property which
are now pending. These include: purchase of Valley High School site;
purchase of Kolb Park; and miscellaneous right-of-way dedications along
public streets. State Law authorizes a City Council to adopt a general
resolution. This resolution would authorize one or more officers or agents
to accept and consent to such deeds or grants. This would simplify the
processing of property grants and easements, since often the formal deed is
not prepared until near the completion of escrow. This may not always
coincide with the City Council agenda preparation schedule.
Staff recommends that the City Council adopt the proposed resolution which
will authorize the City Manager and/or City Engineer to authorize the
recordation of deeds on behalf of the City of Dublin.

TO ACCEPT AND DIRECT .RECORDATION OF DEEDS
WHEREAS, the City Council is desirous of developing an
efficient mechanism for the acceptance of deeds; and
WHEREAS, Section 27281 of the California Government Code
(CGC) requires that deeds or grants conveying any interest in or
easement upon real estate to a governmental for public
purposes must meet specific requirements; and
WHEREAS, the requirements include evidence of a
certificate or resolution of acceptance attached to the deed or
grant prior to recordation; and _
WHEREAS, Section 27281 provides that a governmental
agency may authorize one or more officers by general resolution to
accept and consent to such deeds or grants.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Dublin, pursuant to Section 27281 (CGC) , does hereby
authorize the City Manager and/or the City Engineer to accept and
consent to such deeds or grants, conveying any interest in or
easement upon real estate, on behalf of the City of Dublin.
