PA 87-048 Dublin Planning Commission approved a Conditional Use Permit and Site Development Review for Oil Changers to construct and operate an oil change, lubrication and smog certification facility on June 1, 1987. APPLICABLE REGULATIONS: Section 8-20.12 of the Zoning Ordinance defines drive-in business to include drive-in restaurants and automobile car washes. Section 8-49.1 of the Zoning Ordinance permits auto repair garages in the C-2 District. Section 8-49.2 of the Zoning Ordinance requires approval of a Conditional Use Permit for drive-in businesses in the C-2 District. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the public need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions. ENVIRONMENTAL REVIEW: The City proposes to adopt a Negative Declaration of Environmental Significance which finds the proposed project will not have a significant effect on the environment. NOTIFICATION: Public Notice of the September 28, 1987, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. -2- ANALYSIS: I. Background On August 17, 1987, the Planning Commission adopted Resolution 87-061 unanimously approving PA 87-100 Oil Changers Conditional Use Permit request to operate a drive-through car wash in addition to the drive-through oil change lubrication and smog certification facility (PA 87-048) previously approved by the Commission on June 1, 1987. There was no public opposition to the drive- through car wash proposal (PA 87-100) at the August 17, 1987 public hearing. The initial Site Development Review (PA 87-048) approval was for a 2,700+ square foot building with four service bays, an office with restroom facilities, and a basement area on a 20,291 square foot site. Approved improvements included perimeter landscaping, a trash enclosure, and eight parking spaces. The Applicant proposed to utilize the fourth service bay for the drive-through car wash. No expansion of the approved plans is proposed under PA 87-100 Oil Changers Car Wash Conditional Use Permit. On August 27, 1987, the Planning Department received two letters (received from Roger Woodward and Vernon A. Swiers) appealing the Planning Commission's decision to approve the Oil Changers drive-through car wash Conditional Use Permit PA 87-100. However, neither letter stated the grounds for the appeal as required under Section 8-102 of the City's Zoning Ordinance. In letters dated September 1, 1987, Staff requested the Appellants to specify the grounds for their appeal. II. Key Issues Vernon A. Swiers submitted a letter to the Planning Department dated received September 10, 1987, stating there are more than enough car wash facilities to meet the needs of the City of Dublin. Roger L. Woodward submitted a letter dated received September 10, 1987, indicating that: 1) "The finding that there is a public need for a drive through car wash service cannot be supported, i.e. , there are at present three car washes in the immediate area", and 2) "The finding that the use, under all the circumstances and conditions of this case, will not materially affect adversely the health and safety of persons residing or working in the vicinity or be materially detrimental to the public welfare . . . cannot be supported in that traffic circulation for the project as proposed would require the stacking of cars waiting for service on the adjacent street which would impede traffic and cause congestion. " In response to the Appellant's statement that there are enough car wash facilities in the area, there are currently three in the Village Parkway area. Whether or not the Applicant' s proposed car wash and the other car washes can operate profitably is a private market matter. All three provide slightly different services, and all meet the public need for varied reasons ranging from preference of location, to preference of service, to preference in the cost of the service. The proposed Oil Changers drive-through car wash will serve the public need in that it will provide an additional car wash facility for residents and business persons to choose to suit their needs in terms of. the location, the type of service offered and the cost of the service. In response to Mr. Woodward's concern with stacking and traffic congestion, TJKM, the City' s Traffic Consultant, reviewed the previously approved site plan for the Oil Changer use and indicated on-site circulation was adequate as proposed. The proposed drive-through car wash operation is consistent with the approved site plan and is not anticipated to result in circulation conflicts. The Applicants have stated that an attendant will be directing on-site traffic. Sufficient stacking space is available on site. The' attendant will be responsible for making sure that the vehicles will not stack out into the street nor cause any traffic congestion. -3- If deemed necessary, a specific condition could_be-applied -requiring that all operations,` including stacking, vehicular circulation, and parking take place entirely,onsite;and.no ,off-site .tacking,_:off-site•-vehicular:, _: r circulation, off-site parking, or off-site traffic congestion is allowed. III. Swiers and Roger L. NOTIFICATION: Public Notice of the August 17, 1987, hearing was published in The Herald, mailed to adjacent property owners, and posted in public buildings. ANALYSIS: At the June 1, 1987, Planning Commission meeting the Commission approved a Conditional Use Permit and Site Development Review for the Oil Changers drive-through oil change, lubrication and smog certification facility at 7194 Village Parkway. The Applicant is requesting approval of a Conditional Use Permit to operate a drive-through car wash in addition to the uses previously approved by the Commission. The initial Site Development Review approval was for a 2,700+ square foot building with four service bays, an office with restroom facilities , and a basement area. Approved improvements included perimeter landscaping, a trash enclosure, and eight parking spaces. The Applicant does not propose any modifications or physical expansion to the approved site plan or building elevations . To date the vacant service station on the site has been demolished and the underground tanks removed. The Applicant proposes to operate the automatic drive-through car wash within the previously approved building square footage, reducing the number of oil change service bays to three, and utilizing the fourth service bay for the automatic car wash. The proposed car wash will be a recycling type system in which the wash and rinse water collects in the wash bay drainage pit, then flows to a 1,500 gallon tank, and then to another 1,500 gallon tank. The two- tank recycling system results in the large dirt particles settling out of the water while also reserving the water. The proposed water recycling car wash system utilizes approximately a total of 7 to 10 gallons of fresh water per wash/rinse cycle, in contrast to the 15 to 20 gallons used in a standard car wash facility. The Applicant estimates the car wash will service 20 to 25 cars per day using an estimated total of 200 gallons of water per day, roughly equivalent to the average single family home water useage. -2- The oil change lubrication, smog certification and car wash uses as proposed by the Applicant will involve a completely drive-through service in which customers, upon entering the site, are met by an attendant who directs • them to a service bay. Customers drive their own vehicles into the designated service bay, remain• in the vehicle during the service, and upon completion, drive their vehicle through the rear exit of the building. Adequate on-site circulation is provided, allowing customers seeking more than one service per visit to obtain those services without exiting and re-entering the site. As a drive-through auto related use the proposed car wash is compatible with the previously approved uses for the site. The proposed drive-through car wash operation is consistent with the approved site plan, as the automatic car wash use will not alter or conflict with the site layout or circulation. As an auto related use the proposed car wash is consistent with the City' s General Plan land use designation for the site and is consistent with the Downtown Specific Plan. The Applicant's proposal has been reviewed by the applicable public agencies and City departments, and Conditions of Approval are included within the Draft Resolution. A condition has been included to require all run-off to be collected internally and to prohibit flow across sidewalks or driveways. RECOMMENDATION: FORMAT: 1) Open public hearing. 2) Hear Staff presentation. 3) Hear Applicant and public presentations. 4) Close public hearing. 5) Adopt related Resolutions approving PA 87-100, or give Staff direction and continue the item. Ms. O'Halloran reviewed the mechanics of the car wash operation and said it would service approximately 20 to 25 cars per day. She stated that adequate on-site circulation is provided, that the proposed drive-through car wash operation is consistent with the approved site plan, that it is consistent with the City' s General Plan land use designation for the site, and that it is consistent with the Downtown Specific Plan. She said Staff was recommending the Commission adopt the Resolutions approving the Conditional Use Permit and Negative Declaration. John Read, Vice President of Construction of the Lube Management Corporation, said that the proposed car wash was being requested for marketing purposes. He explained how the system would operate and said the tanks would have to be cleaned out approximately every six months to remove the sedement. He said this would be Oil Changer' s second facility with a car wash operation, and advised that the other one was in Oakland, off Park and MacArthur. Mr. Read indicated that the hours of operation would be weekdays from 7:30 a.m. to 8 :00 p.m. , Saturdays from 8:00 a.m. to 6:00 p.m. , and Sundays from 10:00 a.m. to 5:00 p.m. He indicated that the car wash would not operate when the oil change facility is closed. The finding that there is a public need for a drive through car wash service cannot be supported, i.e., there are at present three car washes in the immediate area. 2 .
