FINANCIAL STATEMENT: No cost to City.
DESCRIPTION: The applicant proposes to construct a
18 ' x 10'-8" solarium at the rear of the dwelling at 8662 Fenwick
Way. The addition of the solarium will cause the existing family
room to become an inside room with no glazed openings to the
outside.
Section 1205 (a) requires each habitable room to have glazed
openings which open directly to the outside. The purpose of this
requirement is to provide natural light and ventilation to
habitable rooms. The existing sliding class door in the family
room satisfied the above requirement. By adding the solarium the
sliding glass door no longer opens to the outside.
Section 1205 (a) also provides that in lieu of natural
ventilation, mechanical ventilation may be used. The mechanical
ventilation must provide two air exchanges per hour with 20% of
the air supply taken directly from the outside.
The solarium could be constructed without a variance if the wall
between the solarium and the family room were 50% open. This
approach has a catch 22, because then the solarium would become
conditioned space and the solarium would have to comply with the
State Energy Conservation regulations. Since the solarium is
practically all glass, it would be very difficult, if not
impossible, to comply.
The solarium also could be built without a variance if windows
could be installed on either side of the fireplace. This also is
not practical because these walls are shearwalls.
If the family has the required ventilation and the solarium is
all glass, it is the Building Officials opinion, the intent and
purposes of Section 1205 (a) of the building code, of providing
light and ventilation to habitable rooms would be satisfied.
Therefore, it is recommended that the variance be granted,
subject to the condition that the existing heating and air
conditioning equipment be modified so that 20% of the supply air
is taken from the outside and a minimum of two air changes per
hour be provided in the family room. - V

PURPOSE:
Variance to add a solariun off our family room on Feriwick Way,
CODE 1205A:
Window ventilation requirement.
Light Restriction:
No light restriction will exist because of the all glass solariun.
Ventilation restriction:
Our home is equipped with original mechanical air conditioning. ;•'hen we
install the solarium unit it will be equipped with a fan, four windows
and a sliding door.
This solarium addition will enhance the annearence of our hone and
studies show a significant increase in value.

t RESOLUTION NO. - 87
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
GRANTING A VARIANCE TO SECTION 1205(a) OF UNIFORM BUILDING CODE
WHEREAS, Douglas & Leslie Holt have applied for a variance to
Section 1205(a) of the Uniform Building Code, so as to construct an
18'x 10' -8" addition of a solarium at the rear of 8662 Fenwick Way; and
WHEREAS, Section 1205(a) requires that rooms have glazed openings
that open to the exterior; and
WHEREAS, by adding the solarium the existing family room will not
have glazed openings to the exterior; and
WHEREAS, the City Council finds that granting the variance is
consistent with the intent of the Building Code and will not lessen the
protection to the people of the City of Dublin and property situated therein.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
grant said variance subject to the following conditions:
A) the solarium be constructed substantialy in conformance with
the drawings attached to Exhibit 1.
B) that the existing heating and airconditioning system be
modified so that 20% of the supply air be taken from the
outside and that the family room be provided with a minimum of
two air changes per hour.
PASSED, APPROVED, AND ADOPTED this 22nd day of February, 1988 .
