DESCRIPTION: On March 9, 1988 the City received a letter from JEB Enterprises requesting the City Council to amend the Zoning Ordinance to permit (subject to approval of a Conditional Use Permit) a Hot Dog Cart in the C-2 District at the Pak N Save site, 6605 Dublin Boulevard. JEB Enterprises is proposing to locate the Hot Dog Cart on a permanent basis outdoors adjacent to the exit door of the Pak N Save Market. The City's Zoning Ordinance requires all principal uses in the C-2 District to be conducted within a building. Exceptions to this requirement are limited to specific uses such as automobile sales lots, drive-in restaurants and plant nurseries, all of which require approval of a Conditional Use Permit. On a temporary basis the Zoning Ordinance also permits arts and craft's fairs subject to approval of a Conditional Use Permit or Administrative Conditional Use Permit depending upon the number of fairs held per year. Outdoor seating for a restaurant use requires approval of a Conditional Use Permit as an ancillary use to the principal restaurant use. JEB's proposal to locate a Hot Dog Cart in front of the Pak N Save Market is not consistent with the Zoning Ordinance or City policy concerning outdoor venders. The proposal would be similar to the outdoor brass sales and outdoor fruit sales which the City Council previously found were not consistent with the Zoning Ordinance. There are several properties in the City Zoned C-2 General Commercial. An amendment to allow Hot Dog Carts with an approved Conditional Use Permit at the Pak N Save site would apply to all C-2 District properties in the City unless a Planned Development rezoning was approved for the Pak N Save site. Staff does not believe that outdoor venders are an appropriate use in the C-2 District unless the shopping center is specifically designed to accommodate the outdoor vender. If the Council does not choose to initiate an amendment to the Zoning Ordinance to permit Hot Dog Carts and similar outdoor venders in the C-2 district, no action is necessary. The Conditional Use Process would, for a fee, allow the City of Dublin Planning Department to make recommendations to you based on their findings. But more importantly, they would maintain control over the uses for the subject land in all cases. We do not want the City Council or the Commissioners to be put would in a position of making a decision that/permit use of the land we're asking for, to any person(s) that request its use subsequently. In particular, as a private citizen, I will resist any effort to plare the Council in the position of granting a request that will adversely affect the city of Dublin if the request is granted. We are not 'street vendors' . We are merchants building a franchise. I'm enclosing an article that the San Francisco Examiner did on our business a month ago. We are not itinerant on public streets. We are permanently located on private property. The private property owner is PAK'n SAVE. The location is adjacent to the exit under the overhang. We pay monthly rent to our landlord. We hire persons only over 50 years old. This keeps our operation from be- coming 'hang outs' . Our landlord fully endorses our operation. I will be happy to ask Mr. Gary Spence, president of PAK'n SAVE to provide additional information on our operation, if you'd like. We operate at other PAK'n SAVE stores. Briefly, let me tell you a little about us. We are backed by the Bank of America, who heard our concept, provided the seed money and supports it. In this one particular location, 6605 Dublin Blvd. , the carosel already there would be enhanced with a charming hot dog cart run by responsible mature—minded adults on a steady basis. Our caveat is, when we close down anyone passing by would never know where we were. To help with any consideration by the City Council, I have already sent to the planning department, labels of all legal owners of property within 300 feet of PAK'n SAVE who may be able to provide input.
