CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: February 27, 1989 SUBJECT Presentation by Dublin Fine Arts Foundation (Prepared by Paul S. Rankin, Assistant City Manager) . 1 EXHIBITS ATTACHED Letter dated February 15, 1989 from Mr. Ronald Nahas of the Dublin Fine Arts Foundation RECOMMENDATION • Receive presentation and determine whether the City + should work with the Fine Arts Foundation to receive the artwork. If appropriate, direct Staff to work with the Art Foundation on the development of the necessary agreements. FINANCIAL STATEMENT: The Foundation has offered the artwork to the City as a gift. It is anticipated that design changes to the courtyard will be required to accommodate the placement of the art work. Whether the full cost of the change would be paid by the City or the Foundation or a sharing arrangement with the Foundation has not been determined. DESCRIPTION : The City has received correspondence from the Dublin Fine Arts Foundation. The Foundation has requested an opportunity to make a"` presentation to the City Council. The purpose of the presentation is to apprise the City Council and the Community of the efforts of the Foundation to acquire a commissioned piece of art for the Civic Center. An artist has been selected and a design proposal has been prepared. The Foundation' s intent is to provide the artwork to the City as a gift. The City Attorney's Office has advised that it would be appropriate to accept the gift upon specified assurances from the. Foundation and the artist. Among the recommendations by the City Attorney' s Office is the acceptance of the artwork pursuant to a written agreement which would include provisions related to future property rights, including artistic rights related to placement, maintenance, and use of the artwork by the City. It is anticipated that the City Attorney' s Office can work with representatives of the Foundation to develop an agreement which would be presented at a future meeting. The Foundation has requested an opportunity to provide background on -the organization. Also, the artist will be in attendance to present the proposed design. � ` It should be noted that the artist has worked in conjunction with the Project Design Team, to develop the appropriate environment for the placement of the art. In order to accommodate this element, it will require construction revisions to the courtyard area. Staff and the Construction Manager have obtained a preliminary price of $50, 000 - $60, 000 . It is recommended that the City Council Civic Center Advisory Committee explore methods of funding these costs and the scope of the changes with representatives of the Arts Foundation. A proposal would be submitted to the City Council at a future meeting. The proposal by the Dublin Fine Arts Foundation represents a significant community effort which will further enhance the Civic Center project. After receiving the presentation from the Artist and the Dublin Fine Arts Foundation, it is recommended that the City Council provide Staff with further direction. COPIES TO: Ronald C. Box 2340 Dublin, CA 94568 RE: ART WORK DUBLIN...CIVIC CENTER Dear Mr. Rankin: For the past year the Dublin Fine Arts Foundation has been raising funds for the acquisition of a major fine art piece to be contributed to the City of Dublin for placement in the new Civic Center. During that period of time we have engaged the services of a fine art consultant and researched artists from across the United States and around the world, to acquire for Dublin the highest quality art work. We have selected an artist and he has completed the design proposal for the piece. It is our intention to offer this artwork as a gift to the City of Dublin. We would very much appreciate being scheduled before the City Council on February 27th for a brief presentation on the Dublin Fine Arts Foundation as well as a presentation from the artist on the artwork itself. Due to the schedule of the artist who is coming out from New York, it would be most helpful if we could be the first item of business for the evening. - Cordiall Ronald C.
