Banner Advertising Rodeo on San Ramon Road Banner

RECOMMENDATION: Approve request for banner installation for weeks of
May 7 and 14, 1989, and authorize Staff to issue
encroachment permit once insurance certificate has
been received.
FINANCIAL STATEMENT: Cost of banner installation is included in operating
budget.
DESCRIPTION:
In 1983, the City Council adopted a policy regulating use of the San Ramon
Road banner poles. This policy was intended to provide a means of inexpensive
advertising for non-profit organizations holding events within the City for
the general- benefit of the residents of Dublin.
The Rowell Ranch Rodeo Committee has submitted a request to use the banner
poles to advertise their annual rodeo, which will be held on May 20 and 21 at
the Rodeo Park on Dublin Canyon Road in the unincorporated area of Alameda
County. The Rodeo is a non-profit organization, but the event is not held
within the City Limits as stipulated in the adopted policy. However, the
Rodeo does appear to be of general benefit to Dublin residents.
The Rodeo Committee is able to provide the required liability insurance
certificate.
As indicated in the policy statement, the City Council has the ability to -
waive •or change the guidelines within the adopted policy. Staff feels that
this traditional event helps promote the Tri-Valley area and benefits area
residents. Therefore Staff recommends that the City Council waive the •
requirement that the event be held within the City Limits and authorize
issuance of the encroachment permit, subject to receipt of the liability
insurance certificate.

We respectfully request to have the Rowell Rodeo banner in the city of Dublin for the
week of May 7 and May 14, 1989.
The Powell Rodeo has been held in Dublin Canyon since the early 1900's and the pioneer
families of Dublin have been an intrical part of this great western tradition.
The Rodeo is a non-profit organization. Some of the benefits to the Dublin Community
include:

*Busing Dublin children to free exhibitions for "slack" and clown per-
. formances.
*Involvement of many Dublin people in the planning, publicity, ushering,
and in arena performances.
*Involvement of Dublin and neighboring service clubs; such as Moose,
Lions, and Rotary.
*Powell Rodeo has an entry in the Dublin parade and Festival of '89.

Liability and Damages:The permittee shall be responsible for all liability imposed by law for personal injury or property damage which may arise
out of the work permitted and done by permittee under this permit.or which may arise out of the failure on the part of the permittee to perform
his obligations under said permit in respect to maintenance and encroachment.The permittee shall protect and indemnify the City of Dublin.its
officers and employees,and save them harmless in every way from all action at law for damage or injury to persons or property that may arise out
of or be occasioned in any way because of his operations as provided in this permit.

RESOLUTION NO. 73-83
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING A POLICY OF THE CITY OF DUBLIN
FOR THE INSTALLATION OF ADVERTIZING BANNERS
WITHIN THE PUBLIC RIGHTS-OF-WAY
WHEREAS, non-profit organizations do provide services
and support for the City of Dublin at large; and,
•
WHEREAS, these organizations do provide events and
fund-raisers which ultimately benefit the residents of the City of
Dublin; and,
WHEREAS, it is 'in the public interest that these events
receive inexpensive advertizing.
NOW, THEREFORE., BE IT RESOLVED THAT THE Dublin City
Council does hereby adopt a policy regulating the installation of
advertizing banners within the public rights-of-way.

POLICY OF CITY OF DUBLIN
Installation of Advertizing Banners
Within the Public Rights-of-Way
INTENT: This policy is to regulate the installation, materials,
scheduling, removal, insurance, and other items related to banners
placed within the City of Dublin public right-of-way. •
ELIGIBILITY: Non-profit organizations advertizing activities to
be held within the Dublin City Limits may apply for a permit to
erect and maintain a banner.
APPROVING AGENCY: The City Council shall be the approving body
with the City Engineer issuing an Encroachment Permit and
inspecting the banner installation. :
Encroachment permit and inspection fees shall be waived for banner
permitting.
TIME LIMITS : The application for banner installation shall be
submitted not later than one month in advance of the desired
installation of the banner, and no sooner than one year in advance
of the proposed installation.
Any one agency may hot erect a banner any more frequently than
four times in any one calendar year .
No banner, for any event, may be erected for longer than two weeks
and no more than one banner erected for any one event. -
LOCATION: The banner shall be erected and displayed at a location
approved by the City Council . It is anticipated that the City
will erect poles exclusively for the use of displaying banners .
MATERIALS: The banner shall be designed and made by a company
whose business it is to design and construct banners . The design
shall be sufficient to handle wind loadings as specified in the
latest adopted Uniform Building Code .
INSURANCE : The applicant shall carry liability insurance in an
amount not less than $1, 000 , 000 and shall hold the City, its
agents and employees, harmless from liability arising out of the
installation, maintenance, and removal - of the banner.
OTHER REQUIREMENTS: The City Council and/or the City Engineer may
impose additional conditions as necessary to control banner
installation, maintenance and removal .
