SUBJECT: Review of Policy for Use of San Ramon Road Banner -
Poles

RECOMMENDATION: �' Consider possible changes to policy and direct Staff
to take appropriate action.
FINANCIAL STATEMENT: The average cost for installation and removal of a
banner by the City's maintenance crew is $386.00,
including labor and equipment.
DESCRIPTION:
On December 13, 1983, the City Council adopted Resolution 73-83, which set the
policy for installation of a banner on the San Ramon Road banner poles. This
policy provided that non-profit organizations advertising events to be held
within the City of Dublin could apply for an encroachment permit for a banner,
and that the fee would be waived. _ Other 'conditions such as a requirement for
liability insurance coverage and specifications for the banner were adopted at
the same time.
At the March 13, 1989, meeting, the City Council agreed to waive the
requirement that an event be held within the City Limits and approved a banner
advertising the Rowell Ranch Rodeo. Staff has now received a request from
Wings for Charity, the sponsor of an air show to be held at the Livermore
Airport in July. This event provides funding for a number of organizations
such as Kaleidoscope Center, Tri-Valley Haven, Family Crisis Center, Lifeline,
and Meals on Wheels, which benefit Dublin residents, but again, the event is
not held within the City Limits.
Rather than continuing to grant waivers, the City Council may wish to consider
modifying the adopted policy. It -is suggested that consideration be given to
charging an encroachment permit fee for organizations that are holding events
outside the City in order to cover the cost of installing the banners. If
this course of action is desirable, the policy resolution would need to be
revised, as it specifically states that only-non-profit organizations
advertising events within the City may apply for a permit. -
In addition, the present encroachment permit fee schedule does not include a
fee for banner installation. In order to revise a fee schedule, a public
hearing must be held and must be noticed ten days in advance. If the City
Council wishes to proceed in this manner, the public hearing would need to be
-scheduled for the second April meeting in order to meet the noticing
requirement. It should be noted that if the fee is too high, it would
preclude the organizations from realizing any benefit from the banner.
Staff has contacted the Cities of Pleasanton and Livermore regarding their
policies for similar banner installations. Both cities require that the
applicants be nonprofit or civic organizations but not necessarily that the
event be held within City Limits. Pleasanton does not charge a fee for the
banner installation. Livermore charges a $50.00 encroachment permit fee,
which is below their minimum encroachment fee of $80.00 for other types of
work. The cities' respective maintenance departments install the banners.
Staff recommends that the City Council provide direction regarding this
matter.

APPROVING A POLICY OF THE CITY OF DUBLIN
FOR THE INSTALLATION OF ADVERTIZING BANNERS .
WITHIN THE PUBLIC RIGHTS-OF-WAY
WHEREAS, non-profit organizations do provide services
and support for the City of Dublin at large; and, -
WHEREAS, these organizations do provide events and
fund-raisers which ultimately benefit the residents of the City of.
Dublin; and,
WHEREAS, it is in the public interest that these events
receive inexpensive advertizing.
NOW THEREFORE, BE IT RESOLVED THAT THE Dublin -City

advertizing banners within the public rights-of-way.

POLICY OF CITY OF DUBLIN
Installation of Advertizing Banners
Within the Public Rights-of-Way
INTENT: This policy is to regulate the installation, materials, .
scheduling, removal, insurance, and other items related to banners
placed within the City of Dublin public right-of-way.
ELIGIBILITY: Non-profit organizations advertizing activities to
be held within the Dublin City Limits may apply for a permit to
erect and maintain .a banner.
APPROVING AGENCY: The City Council shall be the approving body
with the City Engineer issuing an Encroachment Permit and
inspecting the banner installation. 4
Encroachment permit and inspection fees shall be waived for banner
permitting .
.TIME LIMITS : The application for banner installation shall be
submitted not later than one month in advance of the desired
installation of the banner, and no sooner than one year in advance
of the proposed installation .
Any one agency may not erect a banner any more frequently than
four times in any one calendar year .
No banner, for any event, may be erected for longer than two •weeks
and no more than one banner erected for any one event.

LOCATION: The banner shall be erected and displayed at a location
approved by the City Council . It is anticipated that the City
will erect poles exclusively for the use of displaying banners .
MATERIALS: The banner shall be designed and made by a company
whose business it is to design and construct banners. The design .
shall be sufficient to handle wind loadings as specified in the
latest adopted Uniform Building Code.
INSURANCE: The applicant shall carry liability insurance in an
amount not less than $1, 000 , 000 and shall hold the City, its
agents and employees, harmless from liability arising out of the
installation, maintenance, and removal - of the banner.
OTHER REQUIREMENTS : The City Council and/or the City Engineer may
impose additional conditions as necessary to control banner
installation, maintenance and removal .
