FINANCIAL STATEMENT: $120 to be assessed to single-family property owners for
1989-90 landscaping and lighting maintenance costs. The
assessment per multi-family lot is $60. No cost to the
City.
DESCRIPTION:
As part of the review and approval of the 145-unit single family development
(Village VI) and the other, multi-family Villages, certain landscaping and open
space maintenance was made a condition of approval. This maintenance assessment
district provides funds for this work. The City Council approved formation of the
District on November 10, 1986, with the initial assessment in the 1987-88 tax
year.
The County Assessor collects these monies for the City for the maintenance of
landscaping and irrigation systems, right-of-way fencing, walls and entrance
signs, trash removal, and maintenance of the open space lots (firebreaks, weed
abatement, and slope drainage) . The open space parcel maintenance will be charged
to the District for three years only, similar to the agreement made for Tract
4719. The upcoming year will be the third and final year that the District will
pay for open space maintenance. The District's boundaries include all of Tract
5511; Villages IV and V were previously excluded but are proposed to be annexed
this year.
The assessment per single family lot last year was $96.46, as it was anticipated
that the City would maintain landscaping for only a part of the year. This year's
assessment is proposed to be $120 per single-family lot and $60 per condominium or
townhouse lot.
On April 10, 1989, the City Council authorized preparation of the Preliminary
Engineer' s Report which is attached to this agenda statement. On June 12th, the
City Council adopted resolutions approving the preliminary Engineer's Report and
setting July 10, 1989, as the date of the protest hearing. Notice of the hearing
was published, posted, and mailed to property owners in accordance with Government
Code regulations.
Staff held an informational meeting with interested property owners on June 21st
in order to explain the scope of work and answer any questions. Eight homeowners
attended the meeting. A concern was raised at this meeting regarding maintenance
and litter pickup to date. The City's Maintenance Superintendent explained that
the City had just recently assumed the maintenance reponsibility from the
developer and that the maintenance crew was establishing a regular schedule for
landscape maintenance and beautification (Exhibit 1) . Additionally, Staff advised
the residents that the City has been experiencing vandalism problems with respect
to the irrigation system.
Staff recommends that the City Council conduct a public hearing and adopt the
resolution.

WHEREAS, on April 10, 1989, the City Council of the City of Dublin,
California, pursuant to the provisions of the Landscaping and. Lighting Act of
1972, adopted its Resolution Directing Preparation of Annual Report for
Maintenance Assessment District for the maintenance of improvements more
particularly therein described; and
WHEREAS, said Resolution directed the undersigned to prepare and file a
report pursuant to Section 22565, et: seq. of said Act;
NOW, THEREFORE, the undersigned, by virtue of the power vested in me
under said Act and the order of the Council of said City, hereby make the
following assessment to cover the portion of the estimated cost of the •
maintenance of said improvements and the cost and expenses incidental thereto, to
be paid by said District.

As required by said Act, a diagram is hereto attached showing the
exterior boundaries of said landscaping maintenance assessment district and also
the lines and dimensions of each lot or parcel of land within said landscaping
maintenance assessment district as the same existed at the time of the passage of
said resolution, each of which lots or parcels having been given a separate
number upon said diagram. '
I do hereby assess the net amount to be assessed upon all assessable
lots or parcels of land within said landscaping maintenance assessment district
by apportioning that amount among the several lots or parcels in proportion to

the estimated benefits to be received by each such lot or parcel from the
• maintenance of said improvements, and more particularly set forth in the list
hereto attached and by reference made a part hereof.
Said assessment is made upon the several lots or parcels of land within
said landscaping maintenance assessment district in proportion to the estimated
benefits to be received by said lots or parcels respectively from the maintenance
of said improvements. The diagram and assessment numbers appearing herein are
the diagram numbers appearing on said diagram, to which reference is hereby made
for a more particular description of said property.
Each lot or parcel of land assessed is described in the assessment list
by reference to its parcel number as shown on the Assessor's Maps of the County
of Alameda for the fiscal year 1988-1989 and includes all of such parcel
excepting those portions thereof within existing public roads or right-of-way to
be acquired in these proceedings for public road purposes. For a more particular
description of said property, reference is hereby made to the deeds and maps on
file and of record in the office of the County Recorder of said County. Because
the names of the several owners are unknown to me, I hereby place the word
"Unknown" opposite the number of each lot or parcel of land assessed, the amount
assessed thereon, and the number of the assessment.

SCOPE OF WORK
The following areas are to be maintained by this Maintenance Assessment District:
1) The median and roadside landscaping (north side of street) along the length
of Willow Creek Drive.
2) Roadside landscaping along Shady Creek Drive within Lots 1, 2, 3, 4, 5, 6,
15, 16, 37, 38, and south of Lot 145, all within Tract 5511.
3) Roadside landscaping, wall, fence, and pathway improvements along Dougherty
Road between Amador Valley Boulevard and the northerly City Limit line, and along
Amador Valley Boulevard between Dougherty Road and Wildwood Road.
4) Roadside landscaping, fence, and pathway improvements along the west side of
Wildwood Road.
5) Roadside landscaping, fence, wall, and pathway improvements along .the west
side of Dougherty Road and the south side of 'Amador Valley Boulevard adjacent to
Lot 150.
6) Roadside landscaping, fence, and pathway improvements along the west and
north sides of Fall Creek Road.
7) Cutting of firebreaks and maintaining slope drainage along the open space
Lots A and D of Tract 5511 and Parcel A of Tract 5780. The maintenance within
item number 7 is limited to three" years, the last year being the 1989-1990 fiscal
year; the City will assume cost of maintenance after three years.

METHOD OF APPORTIONING
Each single family lot shall be assigned a benefit unit of one, each multifamily
unit assigned a benefit unit of one-half, the commercial lot shall have a benefit
unit of 4, and the open space lots shall have a benefit unit of zero. This gives

APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT,
AND ORDERING LEVY OF ASSESSMENT
CITY OF DUBLIN LANDSCAPING AND LIGHTING
MAINTENANCE ASSESSMENT DISTRICT NO. 1986-1

WHEREAS, by its Resolution No. 44-89, a resolution directing
preparation of Annual Report for Maintenance Assessment District, City of
Dublin Landscaping and Lighting Maintenance Assessment District No. 1986-1
(the "district") , this Council designated the City Engineer as Engineer and
ordered that Engineer to make and file a report in writing in accordance with
and pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of Work has made and filed with the City
Clerk a preliminary report in writing as called for, which report was
presented to the City Council on June 12, 1989; and
WHEREAS, said Engineer of Work has filed with the City Clerk an
Engineer's Report for final consideration; and _
WHEREAS, the City Council has duly considered said Report and
each and every part thereof, and finds that each and every part of said
Report is sufficient; and that said Report nor any part thereof requires
modification in any respect;
NOW, THEREFORE, BE IT RESOLVED as follows:
a) That the Engineer's estimate of the itemized and total costs
and expenses of maintaining said improvements and of the incidental expenses
in connection therewith, be; and each of them are hereby finally approved;
b) That the diagram showing the assessment district, description
of improvements to be maintained; and the boundaries and dimensions of the
respective lots and parcels of land within said district as contained in said
district as contained in said report be, and it is hereby finally approved;
c) The assessment of the total amount of cost and expenses of
the proposed maintenance of said improvements upon the several lots and
parcels of land in said District in proportion to the estimated benefits to
be received by such lots and parcels, respectively, from said maintenance and

• of the expenses incidental thereto, as contained in said report be, and they
are hereby finally approved and those assessments are hereby ordered levied
as contained in said reports.
