HomeMy WebLinkAbout4.1 Approve 06-26-1989 Minutes A 1 REGULAR MEETING - June 26, 1989 A regular meeting of the City Council of the City of Dublin was held on Monday, June 26, 1989, in the meeting room of the Dublin Library. The . meeting was called to order at 7 : 47 p.m. , by Mayor Paul Moffatt. * * * * ROLL CALL PRESENT: Councilmembers Hegarty, Jeffery, Vonheeder and Mayor Moffatt. ABSENT: Councilmember Snyder. * * * * PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of alle- giance to the flag. * * * * Award City Manager Ambrose announced that on Thursday, June 22, 1989, Lou Ann Texeira had been honored for receiving the William Shephard Award for outstanding young professional administrator. Lou Ann was among 5 other recipients of awards which were presented by the American Society of Public Administration. The Council offered their congratulations . * * * * CONSENT CALENDAR On motion of Cm. Hegarty, seconded by Cm. Jeffery, and by unanimous vote (Cm. Snyder absent) , the Council took the following actions : Approved Minutes of Regular Meeting of June 12, 1989; Authorized Staff to appropriate 1988-89 unappropriated revenues to each fund' s reserve for authorized projects; Accepted improvements for Street Slurry Seal Program Contract 89-4 and authorized payment to McReynolds Paving in the amount of $39, 581 . 60; Approved City Manager' s Employment Agreement and authorized the Mayor to execute the Agreement; Adopted RESOLUTION NO. 72 - 89 AUTHORIZING DIRECTOR OF PUBLIC WORKS TO SIGN APPLICATION FOR STATE-LOCAL TRANSPORTATION DEMONSTRATION PROGRAM FUNDS (SB 140) X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X CM-8-191 Regular Meeting June 26, 1989 k77LJLY'k2?% 4Ed Approved the Bid Packet for exercise equipment for physical training room at Civic Center and authorized Staff to circulate it among providers; Adopted RESOLUTION NO. 73 - 89 APPROVING AN AGREEMENT WITH NORMA J. HISLOP ASSOCIATES FOR IMPLEMENTATION OF A RECORDS MANAGEMENT PROGRAM Adopted RESOLUTION NO. 74 - 89 FIXING EMPLOYER'S CONTRIBUTION UNDER THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT AND RESCINDING RESOLUTION NO. 110-88 ($338 to $355 per month) and RESOLUTION Nb. 75 89 ADOPTING A BENEFIT PLAN IN ACCORDANCE WITH THE PERSONNEL RULES and RESOLUTION NO. 76 - 89 AMENDING RULE XVI, SECTION 5 OF THE PERSONNEL RULES RELATING TO HOLIDAYS WHICH OCCUR ON A WEEKEND DAY AS ADOPTED IN RESOLUTION NO. 85-87 . Approved the Bid Packet for the purchase of a 'copier and authorized Staff to circulate it among providers and waived the formal bidding require- ments and authorized Staff to negotiate a package for approval by the City Council; Adopted RESOLUTION NO. 77 - 89 APPROVING PRELIMINARY ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT LANDSCAPING & LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 and RESOLUTION NO. 78 - 89 " APPOINTING TIME AND PLACE OF HEARING PROTESTS IN RELATION TO PROPOSED ASSESSMENTS LANDSCAPING & LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 Approved Warrant Register in the amount of $1 , 752, 247.89. * * * * DUBLIN DAY @ ALAMEDA COUNTY FAIR City Manager Ambrose advised that the City had received a letter from. the Dublin Chamber of Commerce requesting that the City participate in the "Dublin Day" at the Alameda County Fair on June 27, 1989 . This partici- pation would include sharing one-half the cost for a trophy and flowers presented to the winner of the Dublin race at the Fair. Dublin's cost would be half of $75, or $37 . 50 . (Cm. Snyder absent) , the Council approved the City's participation in Dublin Day at the Fair. * * * * PROMOTIONAL SIGN REQUEST FROM DUBLIN SHAMROCK POTATO FESTIVAL Planning Director Tong advised that the Dublin Shamrock Potato Festival is requesting the City to waive the promotional sign processing fees, and waive one week of promotional sign display for individual businesses that obtain promotional sign permits, include Dublin Shamrock Potato Festival in the signage, and display the signage one week or less prior to the August 5-6 Festival dates. The City Attorney' s Office has reviewed the request. and determined that the Council has the authority to grant the request. Cm. Jeffery asked for clarification that the businesses would not only be advertising- themselves, but also the Festival. Mr. Tong advised that this was correct. Mayor Moffatt asked if any of this time would be charged against the individual businesses. Mr. Tong advised that the one week would, be waived. Cm. Jeffery requested that the businesses be cautioned that this should not be abused. • On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote (Cm. Snyder absent) , the Council adopted ' RESOLUTION NO. 79 - 89 APPROVING THE REQUEST OF THE DUBLIN SHAMROCK POTATO FESTIVAL REGARDING .PROMOTIONAL SIGNS * * * * PUBLIC HEARING - PLANNED DEVELOPMENT REZONING REQUEST TO MODIFY CONDITION #47 OF THE PLANNED DEVELOPMENT APPROVING THE VILLAGES PA 89-041 Mayor Moffatt opened the public hearing-. Planning Director Tong advised that on June 12, 1989, the City Council adopted a Resolution approving the Villages Planned Development rezoning request and introduced an Ordinance amending the Zoning Ordinance. The Application involves a request from Rafanelli & Nahas to modify Condition of Approval #47 of the original PD approving The Villages (PA 85-041 . 1 , City Council Resolution No. 31-86) . The modification would, eliminate the cost of moving several power poles along Dougherty Road and X%X%X%X%X%X%X%X%X$X$X$X$X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X CM-8-193 ' Regular Meeting - June 26, 1989 eliminate the requirement for payment of the cost of a new free right turn lane southbound on Dougherty Road at Dublin Boulevard. In lieu of this work, the developer will install all underground conduit, pull boxes and structures for undergrounding the existing overhead lines as well as conduit and pull boxes for street lights.- . In the future, the City would pay for pulling wires and installing equipment for the underground utility system as well as removing the wood poles, thereby opening up the second southbound lane of traffic on Dougherty Road. This would result in a $87, 205 savings to the City. No comments were made by members of the public relative to this item. Mayor Moffatt closed the public hearing. On motion of Cm. Vonheeder, seconded by Cm. Jeffery, and by unanimous vote (Cm. Snyder absent) , the Council waived the reading and adopted ORDINANCE NO. 10 - 89 AMENDING THE ZONING. ORDINANCE TO PERMIT THE PLANNED DEVELOPMENT REZONING MODIFICATION TO CONDITION #47 OF PA 85-041 .1 (CITY COUNCIL RESOLUTION NO. 31-86) FOR THE VILLAGES AT ALAMO CREEK RAFANELLI & NAHAS REAL ESTATE DEVELOPMENT * * *. * PUBLIC HEARING CIVIC CENTER GENERAL PLAN AMENDMENT STUDY PA 89-068 Mayor Moffatt opened the public hearing. Planning Director Tong advised that on April 10, 1989, the City Council authorized the Civic Center General Plan Amendment Study to consider designating the Civic Center site as a public/semi-public facility or similar land use designation. The purpose of the Study is to ensure that the Civic Center is consistent with the General Plan. The General Plan currently designates the site as 'retail/office" and "parks/recreation" . The General Plan has a "public/ semi-public facilities" land use designation that includes "uses other than parks owned by a public agency that are of sufficient size to warrant differentiation from adjoining uses. . . " The Civic Center would clearly fit the existing General Plan description of a public/semi-public facility that is large enough to be differentiated from surrounding uses. No comments were made by members of the public relative to this issue. Mayor Moffatt closed the public hearing. On motion of Cm. Jeffery, seconded by Cm. Hegarty, and by unanimous vote (Cm. Snyder absent) , the Council adopted X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X%X CM-8-194 Regular Meeting June 26, 1989 RESOLUTION NO. 80 - 89 ADOPTING A NEGATIVE DECLARATION FOR THE CIVIC CENTER GENERAL PLAN AMENDMENT and RESOLUTION NO. 81 - 89 ADOPTING THE CIVIC CENTER GENERAL PLAN AMENDMENT DRAFT TRI-VALLEY TRANSPORTATION COUNCIL (TVTC) BYLAWS Planning Director Tong advised that on May 24,- 1989, the Technical Advisory Committee of the "Tri-Valley Transportation Council prepared a draft set of bylaws which were to be presented to the various councils/boards for review and approval. The draft bylaws are Rules of Procedure that address the TVTC composi tion, membership and meetings . Cm. Vonheeder sits on this Council as Dublin's representative. Mr. Tong advised that the City had received notice that the June 29th meeting has been changed to Thursday, July 13th. Cm. Jeffery felt that 3 days notice for cancellation of a meeting is not a sufficient amount of time. It should be extended to a week. Also, Cm. Jeffery wanted to make sure that the section related to special meetings would comply- with "the. Brown Act, and also that enough notice is given. Ms. Jeffery felt that even though these are just working rules, she would like to see some kind of a comment. that in matters of expenditures and policy, decisions of this body are advisory only. Cm. Vonheeder stated she had a problem with the voting member having to be an elected person or their designated alternate. It states further that the appointee must remain elected in order to serve. City Manager Ambrose stated this could be reworded to make it clearer that the appointing person must be an elected official and the official who appointed" the alternate must stay in office. Cm. Vonheeder stated that these changes would necessitate the bylaws being sent back to each jurisdiction. On motion of Cm. Jeffery, seconded by Cm. Hegarty,' and by unanimous vote (Cm. Snyder absent) , the Council directed Staff to forward their comments related to the drafted Rules of Procedure. * * * X%X$X%X%X$X$X%X%X%X%X$X$X%X%X$X%X%X%X$X$X%X$X$X$X$X$X%X%X%X%X%X%X%X%X%X%X CM-8-195 Regular- Meeting June 26, 1989 OTHER BUSINESS School District/Joint Use Agreement City Manager Ambrose advised that the School District would like to schedule a meeting to discuss the Joint Facilities Use Agreement with the Liaison Committee. They indicated that the first or third Tuesdays of the month worked best for them. _ Cm. Jeffery and Cm. Vonheeder directed Staff to schedule a meeting on the evening of July 18th. * * * * Contract Review/Adoption of Budget &Update to CIP Mr. Ambrose reminded the Council that the following evening had been noticed for the annual contract review and budget hearings. If the Council needed more time, Thursday. night had also been scheduled. * * * Bus Bench Ads Cm. Jeffery questioned if Dublin could, as a City, set policy that says bus bench ads are not allowed in the City. Mr. Ambrose advised that the City is waiting for LAVTA to set their bus shelters . The City collects a fee for bus bench ads to permit this type of advertising to occur. He advised that Staff could bring back a list of the benches which are proposed to be replaced by LAVTA. Dublin only collects about $350 per year. Cm. Jeffery felt that they destroy the landscaping affect that has been put in, plus she did not feel that some of. the advertising was. appropriate. Acting City Attorney Steve Meyers advised the Council that the City could control whether or not it allows bus benches, but not the advertising that goes on them. ADJOURNMENT There being no further business to come before the Council, the meeting was adjourned at 8 : 18 p.m. * * * * .
