HomeMy WebLinkAbout4.01 Approve 10-09-1989 Minutes % REGULAR MEETING — October 9, 1989 A regular meeting of the City Council of the City of Dublin was held on Monday , October 9, 1989 , in the Council Chambers of the new Dublin Civic Center . Mayor Moffatt welcomed everyone who had come to the first meeting held in the new Council Chambers,. The meeting was called to order at 7 : 35 p . m. , by Mayor Moffatt. * * * * ROLL CALL PRESENT: Councilmembers Jeffery , Snyder , Vonheeder and Mayor Moffatt. ABSENT: Councilmembers Hegarty . * PLEDGE OF ALLEGIANCE The Mayor led the Council , Staff and those present in the pledge of alle- giance to the flag . PEDESTRIAN SAFETY CITATION AWARD Dan Downey congratulated the City of Dublin for winning a Pedestrian Safety Citation Award based on 1988 pedestrian statistics and safety activities . The award is given to communities that have between one and ten consecutive years without a pedestrian death . A plaque was presented to Mayor Moffatt . BART UPDATE ON DUBLIN/PLEASANTON EXTENSION PROJECT Planning Director Tong advised that BART has released the Draft Environmental Impact Report for the Dublin/Pleasanton Extension Project . Staff and TJKM have begun reviewing and analyzing the report , but have not yet completed the analysis . A meeting has been scheduled with BART Staff to discuss the detailed comments on October 18th. Written comments regarding the DEIR are due at BART by October 23 , 1989. Earlene DeMarcus , BART representative , stated that it is her intent to have a very good dialogue between BART Staff and City Staff . City input is vital. Marianne Payne discussed the community workshops that were held in June . The proposed project is a 2 station project . The first station will be in Castro Valley , one on Golden Gate Drive and an alternative is having 2 stations located in Dublin/Pleasanton . They have added another alterna- tive which would scrap the second station with a terminus in Dublin/ Pleasanton. @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 4 O _ J 4 � • Steve Kellogg with Woodward Clyde Consultants advised that they had reviewed the DEIR. Traffic and parking were discussed. Two inter- sections were identified as having unacceptable levels of service . The intersections were Dublin Boulevard @ San Ramon Road and Dublin Boulevard @ Regional Street . It should be noted , however , that there would be a reduction in freeway traffic. Public hearings start Wednesday in San Leandro with a second in Castro Valley on October 12th and a third in Dublin at Dublin High School on October 16th . They have about 3, 000 people on their mailing list . Mayor Moffatt asked if the east Dublin station is included, does this affect the amount of property that the west Dublin station will need . Mr . Kellogg advised that the requirements for parking would be less at the west Dublin station. Cm. Jeffery advised that with alternative 2 , there is a 12% reduction in traffic on I-580. She also asked if information on the costs of mitigation would be available by the time of the public hearings . Earlene DeMarcus advised that they are working on this , but it will not be available until the BART Board has given final approval of the projects . On motion of Cm. Snyder, seconded by Cm. Vonheeder , and by unanimous vote , (Cm. Hegarty absent) , the Council directed Staff to complete its analysis and provide comments to BART by October 23rd , and also to request mitigation costs . * * Garage Sale Signs , Bus Bench Ads , Newspaper Racks , Flea Market CUP ' s Bill Pennington, 7065 Portage Road stated that he had 3 complaints . The first related to garage sale signs not being allowed on Village Parkway . Why then are bus seats allowed to have ads? 2) Sidewalks are not wide enough where newspaper racks are located. 3) Why was the Police Department called to halt the First Baptist Church ' s garage sale in the Lucky parking lot a couple of Sundays ago? Mayor Moffatt advised that new bus benches will be going in soon that will contain no advertising . Lee Thompson stated that the current bus benches are there as a carryover under the conract with Alameda County . The City Council has made a decision to replace them this year and they will not have advertising . Mr . Thompson advised that the newspaper racks can be moved back if they are in an unsafe location . He asked if Mr . Pennington could provide a list of locations . Mr . Pennington stated this would apply to any location where there are bus stops and newspaper racks . It is particularly bad in front of Corwood Car Wash. @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 • Mr . Thompson added that when the new bus shelters are put in, there should be room on the pad. Mr . Tong advised that with regard to the garage sale, the church was holding a flea market in the Lucky Shopping Center and they need a Conditional Use Permit . They understood after a discussion that they need to get this permit prior to holding such an event . Mayor Moffatt stated that he was the one that reported this and that he feels very strongly about this . ;; Stop Sign Request — Callan @ Brighton Drive Kathy O' Rourke , 7168 Brighton Drive , addressed the Council and requested that a stop sign be placed at the intersection of Callan and Brighton Drive . A petition was presented containing over 600 signatures . Maria Lorello questioned how long it would take to get signs in . Mr . Thompson advised that this will be discused at the next Traffic Safety Committee meeting on Wednesday at 2 : 00 p . m. The Traffic Engineers will look at whether "stop signs are warranted . Mr . Ambrose advised that the City Council has to authorize the placement of stop signs and the next possible meeting that they could consider this item would be on October 30 , 1989. Cm. Jeffery requested that the Police Chief have more patrol vehicles visible while the City is looking at this intersection . * x T CONSENT CALENDAR On motion of Cm. Vonheeder , seconded by Cm. Jeffery , and by unanimous vote , (Cm. Hegarty absent) , the Council took the following actions : Approved Minutes of Regular Meeting of September 25, 1989 ; Accepted the City Treasurer ' s Investment Report for Period Ending September 30 , 1989 ; Rejected the bids received for an unmarked police vehicle ; and authorized Staff to solicit new bids for an unmarked vehicle and emergency equipment ; Adopted RESOLUTION NO. 112 — 89 ESTABLISHING A SALARY PLAN FOR FULL—TIME PERSONNEL IN ACCORDANCE WITH THE PERSONNEL RULES @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 • J Approved Warrant Register in the amount of $223 , 631 . 75 . SKATEBOARD PARK Recreation Director Lowart presented the Staff Report related to a group of residents requesting a study for possible construction of a skateboard park. The Park & Recreation Commission studied the issues involved at 3 meetings and have recommended that the City Council pursue development of a skateboard park in Dublin. Staff presented and discussed the various liability issues , location issues and a survey of other jurisdictions . Three options were reviewed by Staff : A City owned facility ; A City owned/vendor operated facility ; and Private Ownership . Cm. Jeffery questioned if there would be difficulty in getting an outside vendor to accept the liability . She felt it would be better to line up a vendor before building a park. Ms . Lowart stated that if you compare the number of vendors currently operating , there is probably about the same number that have failed . Shawn Holmes stated they do not want to have to pay to get into a skateboard park. Mayor Moffatt clarified that the Council at this meeting is only discussing whether to have neighborhood hearings to discuss some of the problems . Sunshine Pennington stated that most people think that skaters are drug users and vandals , etc . Some are like this but most aren ' t. Bill Pennington stated that he and his kids instigated this issue to get it this far . The City has liability no matter how you look at it . Benicia has a workable plan and it has worked out beautifully . Skate- boarding is growing and the only place the kids can now skate is in the Zone 7 diches . There is nothing in this town for teenagers . Jody Pennington stated she hopes this issue will be pursued , and questioned if a skateboard park is put in, would this then prohibit skating on the sidewalks . Ms . Lowart advised that this issue has not yet been addressed . Lenora Holmes advised that she attended the Park & Recreation Commission meeting and they were told that they would get notice when the issue went before the City Council . She found out shortly before this meeting . She felt there should be a committee or public hearings so that everyone gets a chance to address the issues .. @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 • , Jeanine Holmes felt that there should be some children and students on the committee. Joe Rasmussen stated the only place they can use is the Sunol Ditch and some kids might get hurt pretty bad . If someone gets hurt , it will be difficult to notify anyone . Zev Kahn suggested that input be solicited by a canvass of the elementary schools , as input from children is important . Lenora Holmes stated that she noticed a Park & Recreation Commissioner present and requested that they comment . Cm. Vonheeder stated she felt it was very difficult to put something like this in a neighborhood without input . She agreed with the Park & Recreation Commission recommendation because we need to identify the various issues . It is difficult to walk down the sidewalk dodging the skateboarders . We need more community input , however . A young man named Jason stated he had a friend who was skateboarding at Dublin High School and he tried to do a trick and got hurt . He now goes up to Danville . Cm. Jeffery stated she sees some real problems with liability and location . We have already gone through public hearings to design the various parks . A skateboard park night not be appropriate in this area , as a concept has already been developed . The concept included family areas for picnics, etc . Cm. Vonheeder indicated she had some of the same concerns , but would like to have the Park & Recreation Commission continue to look at other alternatives. This does not preclude other locations that they might come up with for consideration. Jody Pennington stated she feels that skateboarding is a family event , just as families can go out picniking together and that this should be taken into consideration. Mayor Moffatt again advised that these types of things would come out later in discussions . On motion of Cm. Snyder , seconded by Cm. Vonheeder , and by majority vote , (Cm. Hegarty absent) , the Council authorized the P&R Commission to hold neighborhood hearing(s) to solicit public comments regarding locating a skateboard park in the Dougherty Hills Park and report back to the City Council . Cm. Jeffery voted against this motion. PUBLIC HEARING ORDINANCE RELATING TO OVERSIZE/OVERWEIGHT VEHICLES Mayor Moffatt opened the public hearing . @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 Public Works Director Thompson explained that the purpose of this Ordinance is to regulate the passage of vehicles on City streets which are of sufficient weight to damage the street or of sufficient dimension to obstruct traffic or potentially damage facilities such as light standards , signs , or utilities . Regulations pertaining to oversize/ overweight vehicles have been included in the Alameda County Encroachment Ordinance which was adopted by reference when the City incorporated . Staff proposed to separate provisions relating to oversize/overweight vehicles from the encroachment ordinance which is also on this agenda. No comments were made by members of the public relative to this issue . Mayor Moffatt closed the public hearing . On motion of Cm. Vonheeder , seconded by Cm. Snyder , and by unanimous vote , (Cm. Hegarty absent) , the Council waived the reading and INTRODUCED an Ordinance relating to oversize/overweight vehicles on City streets . * * PUBLIC HEARING-ORDINANCE AMENDING ORDINANCE NO. 55-87 PERTAINING TO REGULATION OF PARKING ON HILLS Mayor Moffatt opened the public hearing . Public Works Director Thompson advised that following a recent runaway vehicle accident report on Creekside Drive , a request was made to consider the installation of "Curb Your Wheels" signs on streets in Dublin that are steeper than a 3% grade. No comments were made by members of the public relative to this issue . Mayor Moffatt closed the public hearing . On motion of Cm. Jeffery , seconded by Cm. Vonheeder , and by unanimous vote , (Cm. Hegarty absent) , the Council waived the reading and INTRODUCED an Ordinance amending Ordinance No . 55-87 (Traffic Ordinance) regarding hill parking regulation. * * * PUBLIC HEARING RESOLUTION PROHIBITING PARKING IN BICYCLE LANES Mayor Moffatt opened the public hearing . Public Works Director Thompson advised that the Traffic Safety Committee recently observed that vehicles occasionally park in the eastbound bicycle lane on Amador Valley Boulevard , east of Stagecoach Road , generally in front of the Heritage Commons condominium development . Bicycle lanes have been established on Village Parkway , Amador Valley Boulevard , the portion of Dublin Boulevard west of San Ramon Road, and the east and west sides of San Ramon Road except for the portion between Vomac Road and Silvergate which will be added as part of San Ramon Road Phase IV. @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9 , 1989 When vehicles park in a bicycle lane , a bicyclist must ride out into the traffic lane in order to pass , creating a safety hazard . No comments were made by members of the public relative to this issue . Mayor Moffatt closed the public hearing . On motion of Cm. Snyder , seconded by Cm. Jeffery , and by unanimous vote , (Cm. Hegarty absent) , the Council adopted RESOLUTION NO. 113 - 89 RESTRICTING PARKING IN DESIGNATED BICYCLE LANES * a; * PUBLIC HEARING ORDINANCE RELATING TO ENCROACHMENTS Mayor Moffatt opened the public hearing. Public Works Director Thompson advised that this proposed Ordinance is part of the municipal code update and covers essentially the same subjects as the Alameda County encroachment Ordinance which was adopted by reference in 1982. The main purpose of this Ordinance is to regulate performance of work or placement of objects in the public right-of-way . The ordinance requires that utilities , contractors, and any other persons intending to do work within the public right-of-way obtain a permit , and establishes general conditions such as bonds , insurance, standards for performance , and compliance with safety regulations . Cm. Jeffery questioned if this would apply to the Misheloff posters . Mr . Thompson advised that if the City sponsors it , it can go up . We allow certain things and this would be one. Cm. Jeffery questioned if there were provisions for emergencies in the 3 year moratorium. Mr . Thompson stated that he can grant permission and waive requirements . Cm. Snyder questioned if this Ordinance would preclude the use of portable trash bins . Mr . Thompson advised that under Section 2 exemptions , since the City has a franchise agreement , this would be an example where we would allow the trash company to drop these bins . Hegarty absent) , the Council waived the reading and INTRODUCED an Ordinance relating to encroachments . * * ,. * @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 INTERIOR PLANT INSTALLATION AND MAINTENANCE Assistant City Manager Rankin advised that in accordance with Council direction, bids were solicited for plant installation and maintenance at the Civic Center . The specifications requested live plants in the public areas and artificial silk plants located in the upper soffits along public corridors . The bid also requested the cost for monthly maintenance , which would include a guarantee to replace damaged or diseased plants . Four bids were received . The low bidder was Plant Design, with offices in San Francisco and Dublin . On motion of Cm. Vonheeder , seconded by Cm. Jeffery , and by unanimous vote , (Cm. Hegarty absent) , the Council authorized Staff to execute a Purchase Order with Plant Design, based on the bid specifications for $8, 701 . 45 . * VALLEY PERFORMING. ARTS CENTER REQUEST On September 25 , 1989 , Mr . Gib Marguth addressed the Council and requested clarification of the position taken by the Council at their meeting of September 11 , 1989 regarding the performing arts feasibility study . The request was for Dublin to contribute $25 , 000 toward the project . The Council direction was to not contribute funding at this time and the Council also expresed concern that the group initiating the study appeared to have predetermined the location and components of the facility. The Council also suggested that the concept should be discussed at a meeting of the Tri-Valley City Councils . The Citizens for a Valley Performing Arts Center (CVPAC) group has requested that the City Council consider appointing members to a committee which will evaluate the proposal . It was suggested that the appointments include represen- tation from the City Council . Gib Marguth , 1152 Farmington Way , Livermore, advised the Council that they hope to move forward with this study . Cm. Jeffery suggested that the Council proceed with appointing 1 Councilmember and 3 citizens . She still felt that Danville and San Ramon should be contacted . Mr . Marguth advised that there has been some discussion regarding building ' a competing facility at Bishop Ranch . Cm. Vonheeder stated she would like to also have a Park & Recreation Commissioner on the committee. On motion of Cm. Jeffery , seconded by Cm. Vonheeder , and by unanimous vote , (Cm. Hegarty absent) , the Council directed Staff to contact members of the local arts society , theatre groups , schools , and Park & Recreation Commission to determine whether there are other members of the community interested in participating on this committee . Staff was also directed to contact the newspapers to advertise the openings . @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 The Council representative on the committee will be Cm. Jeffery . SHANNON PARK RENOVATION - AWARD OF BID - CONTRACT NO. 89-7 Recreation Director Lowart advised that proposed improvements to Shannon Park include play areas for both young and older children, a shallow pond and spray pool , a plaza area and fountain, landscaping and drainage improvements , an additional pedestrian bridge over the creek, and parking and lighting improvements . The landscape architect incorporated several alternates in the proposed bid so _that if the bid were over the amount budgeted , ' the City Council could delete certain items for installation at a later date . These included : Alternate A-Railroad tie path under the existing pedestrian bridge to Shannon Center . Alternate B-Installation of a new pedestrian bridge over the creek at the west end of the park. Alternate C- Demonstration garden on the slope behind Shannon Center . Alternate D- Clean-up of creek and pruning of trees and shrubs along creek. Alternate E-Replacement of concrete culvert with river rock culvert. The City received a total of 4 bids for this project . The low bidder was A. V. & C. Construction with a base bid of $862, 138. 25, and alternate bids which were detailed, for a grand total of $925 , 138 . 25. Cm. Jeffery questioned if the clean up of the creek was also from a safety standpoint . Public Works Director Thompson advised that it was more to keep the creek from washing away and to not impede the flow. The Council determined that all alternates should be included in the construction contract authorized an additional appropriation from unallocated reserves in the appropriate amount if the alternates result in the cost of the project exceeding the budget amount for the project. On motion of Cm. Snyder , seconded by Cm. Jeffery, and by unanimous vote , (Cm. Hegarty absent) , the Council adopted RESOLUTION NO. 114 - 89 AWARDING CONTRACT 89-7 SHANNON PARK RENOVATION TO A. V. & C. CONSTRUCTION (Base Bid $862, 138. 25 & Alternates A thru E $63,000) 3� * OTHER BUSINESS Civic Center Dedication Ceremonies City Manager reminded the Council of the dedication and open house events scheduled for October 19th and 21st . Staff will be putting together an itinerary which will be distributed next week. * * * @&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@&+@ CM-8- Regular Meeting October 9, 1989 E ' Business Registration Ordinance - Presentation at Chamber Luncheon Cm. Vonheeder advised that next Wednesday is the date for the Chamber of Commerce luncheon where City Officials will speak about the Business Registration Ordinance . Cm. Vonheeder requested that either Mr . Ambrose of Cm. Snyder advise the Chamber that she. will be out of town on City business. She questioned if there had been any interest in response to the ad for non-Chamber members . Mr . Ambrose suggested that he , Cm. Vonheeder , Cm. Snyder and Chamber representatives meet prior to the Wednesday meeting . He stated he would schedule a meeting for Wednesday morning or Friday afternoon. Cm. Vonheeder advised that she flies out on Saturday to the NHRO conference in Seattle and will not return until Thursday, October 19th. Antennas Cm. Snyer stated that he would like for the Council to discuss from a planning standpoint , the antenna and satellite dish issue on a future agenda. Acting City Attorney Silver advised that satellite dishes are handled differently than antennas . Mr . Ambrose advised that Staff would bring the current ordinance to he City Council . as * * Next Regular Meeting Date Changed Mayor Moffatt reminded everyone that the next meeting of the City Council had been changed from October 23rd to October 30th.
