Foss, City Manager " SUBJECT: CalRecycle Payment Program Participation Prepared by Kathy Southern, Environmental Technician EXECUTIVE SUMMARY: CITY CLERK File #810 -60 The City Council will consider adopting a resolution authorizing the City's participation in programs offered through the California Department of Resources, Recycling and Recovery (CalRecycle). The new resolution covers both existing and future all payment programs for CalRecycle and rescinds Resolution No. 109 -10 that authorized the filing for only one of their payment programs. FINANCIAL IMPACT: The City participates annually in CalRecycle's Beverage Container Recycling Payment Program, and Used Oil Payment Program, through which it receives funds to be used for those purposes. Adoption of this resolution will have no impact on any City funds, but would allow the City to continue to apply for various recycling programs for which it is eligible. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Authorizing Submittal of Applications for CalRecycle Payment Programs and Rescinding Resolution No. 109 -10. ubmitte` By Public Works Director DESCRIPTION: \ Reviewed By Assistant City Manager As part of CalRecycle's annual Beverage Container City /County Payment Program, the City receives funds each year to promote recycling programs. Starting in 2016, the State is requiring the City to adopt a resolution that authorizes all of its applications to CalRecycle. The resolution is general in nature and covers both existing payment programs that the City participates in with CalRecycle, and future programs that CalRecycle may create. Currently, the payment programs available for local governments to participate in are the Used Oil Payment Program and the Beverage Container City /County Payment Program. In July Page 1 of 2 ITEM NO. 4.5 2010, the City Council approved Resolution No. 109 -10 that authorized the filing of only the Used Oil Payment Program Application to CalRecycle. The new resolution (Attachment 1) will cover all payment programs and will rescind Resolution No. 109 -10 (Attachment 2). NOTICING REQUIREMENTS /PUBLIC OUTREACH: None. ATTACHMENTS: 1. Resolution to be rescinded: Resolution 109 -10 Authorizing the Filing of a Used Oil Payment Program Application to CalRecycle Page 2 of 2 Attachment 1 RESOLUTION NO. -16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AUTHORIZING SUBMITTAL OF APPLICATIONS FOR CALRECYCLE PAYMENT PROGRAMS AND RESCINDING RESOLUTION 109 -10 WHEREAS, pursuant to California Public Resources Code Section 48000 et seq. the Department of Resources Recycling and Recovery (CalRecycle) was established to administer various payment programs to make payments to qualifying jurisdictions; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program; and WHEREAS, the City of Dublin adopted Resolution 109 -10, which authorized the CalRecycle Payment Program for the Used Oil Program only and will be replaced by this Resolution. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby: 1) Authorize the submittal of application(s) to CalRecycle for any and all payment programs offered, for which the City of Dublin is eligible; and 2) Authorize the City Manager, or his /her designee to execute in the name of the City of Dublin all payment program documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to implement and secure payment program funds; and 3) Make these authorizations effective as of the date of this resolution until rescinded by the City Council; and 4) Rescind Resolution 109 -10, which authorized the CalRecycle payment program for the used oil program only. AYES: 1 NOES: ABSENT: ABSTAIN: ATTEST: City Clerk Mayor A+- F,hme-� �, RESOLUTION NO. 109 - 10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AUTHORIZING THE FILING OF A USED OIL PAYMENT PROGRAM APPLICATION TO CALRECYCLE WHEREAS, Public Resources Code sections 48690 et seq, authorize the Department of Resources Recycling and Recovery (CalRecycle), formerly known as the California Integrated Waste Management Board, to make payments to qualifying jurisdictions for implementation of their used oil programs as required by PRC § 48690 et seq.; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the Used Oil Payment Program; and WHEREAS, CalRecycle's procedures for administering the Used Oil Payment Program require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the Used Oil Payment Program; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Dublin does hereby authorize the submittal of a Used Oil Payment Program application to CalRecycle; and BE IT FURTHER RESOLVED, that the City Manager, or his /her designee, is hereby authorized and empowered to execute in the name of the City of Dublin all documents, including but not limited to, applications, agreements, annual reports including expenditure reports and amendments necessary to secure said payments to support our Used Oil Collection Program ; and BE IT FURTHER RESOLVED, that this authorization is effective until rescinded by the City Council.
