FINANCIAL STATEMENT: The 1992-93 assessment was originally proposed to be $220.36 per single-family lot and $39.92 per multi-family (apartment) lot (total of $22,035.84 for Amador Lakes) . A second option is presented based upon the neighborhood meeting: The cost of providing additional planting on the interior slopes and design work for future changes on the Stagecoach Road slopes would increase the single family assessment to $265.36 and the Amador Lakes assessment to $23,537.28 (or $42.64 per unit) . The City's costs for maintaining landscaping within District boundaries are reimbursed by the District. DESCRIPTION: The Conditions of Approval for development of Tract 4719 required that a homeowners' association be formed to maintain certain common landscaping improvements within the Tract. Landscaping and Lighting Assessment District No. 1983-2 was formed at the request of the developer as an alternative to providing landscaping maintenance through the Amador Lakes and Dublin Hills Estates ITEM NO. 6.2 COPIES TO: Ron Nahas CITY CLERK FILE l 13 S O homeowners' associations. This District maintains landscaping and irrigation on the slopes along Stagecoach Road and also on the "interior" slopes of the Dublin Hills Estates development on Agate Way and Coral Way. The cost of maintenance of the Stagecoach Road landscaping is spread 60% to the Amador Lakes development, divided among the 552 condominium lots, and 40% to the Dublin Hills Estates development, divided among the 150 single-family lots. The "interior slopes" maintenance is spread among the 150 single-family lots only. The District diagram remains the same as last year's. Based on the approved Preliminary Engineer's Report, the proposed assessment for the 1992-93 tax year is $55,090, which is approximately $6,022 (12.2%) higher than last year's assessment. The increased cost is primarily due to a significant increase in water rates; i.e. , $9,775 water cost in 1991-92 vs. an estimated $15,150 for 1992-93. While it is proposed to utilize approximately $5,853 from existing reserves to help defray the increased water cost, the use of reserves will not totally offset these expenses. At the time of approval of the preliminary engineer's report, the proposed assessment per single-family lot was $220.36, as compared with $194.64 last year. This is an increase of $25.72 or 13.2%. The proposed assessment per condominium (Amador Lakes) lot was $39.92, as compared with $36.00 last year. This is an increase of $3.92 or 10.9%. A notice and newsletter (Exhibit 4) were mailed to the property owners to advise them of this information. On July 29, 1992, Staff held an informational meeting for property owners in the Assessment District. Fifteen people, representing ten different single family homes as well as Amador Lakes, attended the meeting. Staff presented a brief history of the assessment district and discussed and distributed copies of cost and labor hour comparisons between the Stagecoach Assessment District and other areas of the City. Those comparisons are attached as Exhibit 5. One of the most notable statistics contained in this information is the amount of bedding (ground cover) area maintained per single-family property owner (990 square feet) compared with the Dougherty Assessment District (160 square feet) . Staff has made an effort to keep the assessment as low as possible; however, the consequence is that only status quo maintenance is performed, with little or no funding available for replanting. After discussion of several different suggestions from those present at the meeting for improving the appearance of the interior slopes and Stagecoach Road slopes, the consensus reached among those at the neighborhood meeting was that a one-time increase in the assessment would be appropriate to fund (1) additional landscaping and irrigation on the interior slopes and (2) the cost of a preliminary revised landscape plan for the Stagecoach Road slopes. It was suggested by Ron Nahas, owner of Amador Lakes, that the upper and lower portions of the Stagecoach Road slopes be planted with drought-tolerant shrubs and the middle portion be allowed to return to native grasses and flowers which would require less maintenance and less water. This increase would provide for the following work which is not currently planned for in the budget presented with the Preliminary Report: 1) For the interior slopes: Replace 12,000 square feet of groundcover $3,600 Replace 5 15-gallon trees 500 Additional water, fertilizer, and irrigation upgrades 1,650 $5,750 Cost per single-family residence: $5,750 = $38.33 150 2) Preliminary Stagecoach slopes plan and plant palette: $2,500 Cost per single-family residence: 40% x 2,500 = $ 6.67 150 Cost for Amador Lakes: 60% x 2,500 = $1,500 Total additional assessment per single-family residence: $ 45.00 Total additional assessment for Amador Lakes: $1,500.00 This would increase the total paid by single family assessments to $39,804 (or $265.36 per unit) and the Amador Lakes assessment 'to $23,537.28 (or $42.64 per Page 2 unit) . The difference in the Amador Lakes assessment is actually slightly more than $1,500 because of having to spread the cost evenly among the 552 units. It was proposed that the actual type of plant material to be placed on the interior slopes would be reviewed by a committee of City Staff and the single-family homeowners. The preliminary landscape plan for the Stagecoach Road slopes is proposed to be reviewed by a committee of City Staff, single-family homeowners, and representatives of Amador Lakes. Cost estimates would be made for possible future one-time capital costs for implementing a new landscape plan. These estimates would also identify estimated reductions to maintenance and water costs. All future changes to the landscaping would be approved by action of the City Council. It should be noted that the $2,500 landscape plan cost is for a conceptual plan only. Any future design or implementation costs would need to be paid by the District in years to come. One of the ideas mentioned at the neighborhood meeting was to phase any future improvements so that the cost would be spread over several years; however, any expenses to be incurred in future years would need to be presented to the property owners and ultimately approved by the City Council as part of the assessment district hearing process. A notice regarding the results of the neighborhood meeting and the proposed increase in assessment (Exhibit 6) was mailed to all of the property owners on July 31st. Staff recommends that the City Council conduct a public hearing, review the information provided by Staff and comments from the property owners, determine whether the alternate budget which proposes an increase in assessment is appropriate, and adopt EITHER Resolution Exhibit 2 which approves the original Engineer' s Report and assessment as shown in the 1992-93 budget OR Resolution Exhibit 8 which approves the revised Engineer's Report with increased assessment. I do hereby assess the net amount to be assessed upon all assessable lots or parcels of land within said landscaping maintenance assessment district by apportioning that amount among the several lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the maintenance of said improvements, and more particularly set forth in the list hereto attached and by reference made a part hereof. Said assessment is made upon the several lots or parcels of land within said landscaping maintenance assessment district in proportion to the estimated benefits to be received by said lots or parcels respectively from the maintenance of said improvements. The diagram and assessment numbers appearing herein are the diagram numbers appearing on said diagram, to which reference is hereby made for a more particular description of said property. Each lot or parcel of land assessed is described in the assessment list by reference to its parcel number as shown on the Assessor's Maps of the County of Alameda for the Fiscal Year 1991-92 and includes all of such parcels excepting those portions thereof within existing public roads or rights of way to be acquired in these proceedings for public road purposes. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719 . The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single- family area (excluding those slopes and concrete culverts adjacent to Stagecoach Road) shall be evenly spread over Lots 1 through 150 of Tract 4719 . Lots 152 and 153 , being park and open space, shall have a zero assessment. Lots 154 and 155, being public agency owned, shall have a zero assessment. SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit. Further, the scope of work shall include the maintenance of the slopes and landscaping and irrigation of the slopes within a public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48, all within Tract 4719. The following areas are being maintained by the City at the present time: ■ Landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between Amador Valley Boulevard and the northerly City Limit. ■ Slopes and landscaping and irrigation of the slopes within a . public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48 of Tract 4719 . These are the "interior slopes" which face houses on Agate Way and Coral Way. In order to arrive at the annual assessment, estimated maintenance costs for the ensuing year are divided among residents of the single- family homes of Dublin Hills Estates and the owners of the Amador Lakes Apartments as follows: ■ Sixty percent (60%) of the annual cost of maintaining the • landscaping within and along Stagecoach Road has been assigned to the 552 apartment/condominium lots of Amador Lakes, distributed on an equal basis. The remaining 40% of this annual cost has been divided equally among the 150 single-family lots in Dublin Hills Estates. N The cost of maintaining the excavated slopes, concrete culverts, and landscaping on the interior slopes of the • single-family area (Agate Way and Coral Way) is divided evenly among the 150 Dublin Hills Estates lots. The monies collected through assessments are carefully accounted for separately from other City funds. These funds can only be used for • specified expenses within the boundaries of the Assessment District. • 4 , 4 Page 1 NEWSLe.Trt LANDSCAPING As of July 1, 1992 , the City of Dublin no longer contracts with Alameda County for weekend inmate workers. Basically, the program could not supply enough inmates to be efficient and productive. In place of the Work Alternative Program, the City' s maintenance contractor, MCE Corporation, has contracted with a local company to perform pre- and post-emergents and fertilization of all bedding areas City-wide, including the Stagecoach Assessment District. The groundcover areas have rebounded fairly well from the past freezes and pest problems. The trees in the District were not damaged any further by frost this past winter and are also coming back. IRRIGATION Since last year, the City has experienced a 50% increase in the cost of water from the Dublin San Ramon Services District. Unfortunately, vandalism of irrigation heads, while not as bad as in past years, is still a problem. The irrigation systems installed in this District were installed to water erosion control grasses, not permanent landscaping. The result is a less-than-efficient system. The City's maintenance department is appreciative of residents who have called regarding broken sprinklers. Our response to these requests will continue to be immediate so that water won't be wasted. If you happen to see a broken sprinkler head or a sprinkler system that is running too long, please call the Public Works Department at 833-6630. PARK IMPROVEMENTS The cost of park maintenance for the Dougherty Hills Open Space and Stagecoach Park, is paid entirely by the City and is not charged to the assessment district. The City' s park masterplans include a number of future improvements for the Dougherty Hills Park (the "hill" to the east of Stagecoach Road) . To date, trails have been cut to allow hiking on the hill. Due to the City' s present budget constraints, the Five Year Capital Improvement Program currently lists any future plans or improvements for this area as unfunded. The residents of Topaz Circle petitioned the City Council and the Dublin San Ramon Services District to aid in providing trees and bushes along the faces of the Dougherty Hills slopes which front Topaz Circle. The City Council allotted $17, 000, and DSRSD has allotted $26, 000 to landscape its access to the water reservoir. These neighbors are proposing to use the money primarily on plant and irrigation materials and to install the plants themselves. Page 2 • � 1 l • PUBLIC HEARING The City is required to hold a public hearing each year prior to establishing the assessment for the upcoming tax year. The attached notice provides information regarding the date, time, and place that the hearing will be held. An informational meeting has also been scheduled to give residents a chance to ask questions and gain information on an informal basis. The City again proposes to use a portion of the assessment district reserve fund to help defray the cost of plant material replacement and increased water rates. Use of this reserve will not, however, totally offset these costs nor the cost of repairs of vandalized irrigation systems. The 1992-93 assessment is therefore proposed to increase from $194 . 64 to $220. 36 per single-family lot. This amounts to an increase on a monthly basis of approximately $2 . 14 per month. The condominium/apartment lot assessment is proposed to be $39 .92 (as compared with $36. 00 last year) . There were concerns presented at that meeting that additional landscaping and irrigation repair work need to be done which would warrant a one-time assessment of $45.00 per single-family home. The annual assessment has, for several years, been set at a minimal level so as not to significantly increase the cost to each property owner. The budget has allowed sustenance watering, weeding (primarily using low-cost Work Alternative people from the Sheriff' s Department) , fertilizing, and minimal plant replacement. The two years of heavy freeze caused major damage to the plantings in the District, but about 65% to 70% of the ground cover has re-established itself. City Staff prepared a cost estimate to fill in the remainder of missing landscaping with trees and ground cover similar to that which had died and to add a water meter on Stagecoach Road to get better and longer irrigation coverage. The one time cost to individual homeowners would have been $92.00 per unit and $13,950 to the Amador Lakes development. Ron Nahas, owner of Amador Lakes, suggested that the planting on the slopes along Stagecoach Road be changed to a small band of landscaping along the bottom of the slopes and return the upper portions to native grasses and flowers. This would cut down the cost of both watering and maintenance. The final consensus was that City Staff would prepare an estimate to be presented at the public hearing to do the following: 1) Fill in the missing landscaping on the interior slopes (above Agate Way and Coral Way) and to upgrade the interior slope irrigation to cure the poor coverage areas. The actual type of plant material to be installed would be decided through discussions with a landscape architect and a committee of interested homeowners. 2) Hire a landscape architect to prepare a preliminary landscape plan to change the Stagecoach Road slopes to a much less water- and maintenance-intensive plan. This plan could include a strip of planting along Stagecoach Road and at the top-of the slopes next to the single-family homes and return the midslopes to native grasses and flowers.
