CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: July 25, 1995 • SUBJECT: Public Hearing: Landscaping and Lighting District No. 83-2 (Tract 4719) Report by: Public Works Director Lee Thompson EXHIBITS ATTACHED: 1) /Resolution approving Engineer's Report, confirming diagram and assessment, and ordering levy of assessment. 2) / Engineer's Report and Diagram 3) / Notice, newsletter, and survey form sent to property owners RECOMMENDATION: 1) Open public hearing 2) Receive Staff report and public comment 3) Question Staff and the public 4) Close public hearing and deliberate 5) Adopt resolution approving Engineer's Report, confirming diagram and assessment, and ordering levy of assessment FINANCIAL STATEMENT: 1995-96 Sources and Use of Funds Revenues: Gross Amount Assessed: $55,659 Interest Revenue: 1,230 Less Estimated Collection and Delinquency Cost: (1,256) Net Total Revenues $55,633 Expenditures: Contract Maintenance and Utilities: $52,565 Administration and Engineering: 1,500 Total Operating Expenses: $54,065 Estimated revenues are anticipated to exceed expenses, which will increase the amount in reserves: $ 1,568 • $55,659 will be assessed to property owners for the 1995-96 street landscaping maintenance costs, which is the same as the 1994-95 assessment ($228.72 per single family home and $38.68 per Amador Lakes unit). It is estimated that this will result in a small appropriation to reserves in this District. DESCRIPTION: In 1983, the City formed Landscaping and Lighting Assessment District No. 83-2 for the purpose of maintaining landscaping within Tract 4719. The District originally included Stagecoach Park and Stagecoach Road north of the City Limit, but now includes only roadway landscaping along Stagecoach Road and on the "interior slopes" (Coral Way and Agate Way) within the Dublin Hills Estates development. The maintenance cost for Stagecoach Park, as well as the undeveloped Dougherty Hills Park, is paid by the City through the Park Maintenance Operating Budget and is not a part of this Assessment District. The cost of maintenance of the Stagecoach Road landscaping is spread 60% to the Amador Lakes development (divided among the 552 condominium lots) and 40% to the Dublin Hills Estates development (divided among 150 single-family lots). All of the "interior slope" maintenance cost is spread evenly to the 150 single-family lots. The estimated June 30, 1995, reserve for this District is projected to be$22,925. The actual reserve will not be known until the City closes its books and accrues the necessary revenues and expenses. In the 0 ,� ITEM NO. Copies to: CITY CLERK FILE I L3 past, portions of the reserve have been used for landscape renovations, particularly following the disastrous freeze several years ago. In addition, a portion of the reserve has been used in recent years to keep the assessment to property owners as low as possible. The level of service in this District has been tailored to the available funds (i.e., low assessment, small reserve) as much as possible rather than requesting to increase the assessment in order to perform additional work. This District has quite a large landscaped area which is supported by relatively few property owners. It is not proposed to use any of the reserve this year in order to keep the assessment at the same level as the 1994-95 assessment. Future Assessment Options and Survey of Property Owners At the July 11, 1995, City Council meeting, Staff presented several options regarding this assessment for future years. These options were: to allow the assessment to increase according to the Consumer Price Index rate of increase, to recalculate the assessment annually based on the actual operating cost of the District, or to freeze the assessment and continue to use reserves, when needed, to make up the difference between the District income and its costs. The City Council requested that Staff send out a survey to property owners in the District, asking which option the property owners would prefer. The survey was sent out to the 151 property owners on July 12th. As of July 18th, a total of 29 responses had been received, with results as follows: Nbr. Of Option Responses #1 Allow assessment to increase with CPI 13 #2 Recalculate assessment annually based on actual cost 7 #3 Freeze assessment at current level 8 None of the above 1 Total: 29 Several of the survey forms included comments, which were as follows: "I believe that the assessment should be higher for"only" the people owning homes immediately adjacent or contiguous to said area." (From Ron Nahas, owner of Amador Lakes): "I am hoping that when the oleanders are well developed the cost of maintenance will go down. Options 1 and 3 don't seem very practical to me." "Periodically rebid'maintenance cost. Use DWI or non-violent prison types to do the work. Costs would be higher if it were not for the generosity of Rafanelli and Nahas; be sure to thank them for us in Dublin Estates." "The interior slope on Coral Way looks horrible! We have to see it every day." "I feel we are already overpaying for what we get." Neighborhood Meeting On July 18th, Staff held a neighborhood meeting, which was attended by three of the property owners in the District. Topics of discussion included the following: Planting the interior slopes: The District budget for 1995-96 includes plant material for the interior slopes. The possibility of a neighborhood volunteer project was discussed. Staff will be meeting with property owners in the near future to discuss types of plant material and to plan the project. Installation of an improved, "high tech"irrigation system: While the new computerized irrigation systems are quite expensive and may require extensive street trenching to install, the existing system is over ten years old and will probably need to be replaced some time in the next ten years. Staff will begin researching new types of controllers and the possibility of utilizing radio links rather than hardwired systems. This project would not need to take place immediately but should be considered in future years' funding. Replacement of existing wood fences that border the maintenance easements: These fences are not maintained by the District but are the responsibility of the individual property owners. It was felt that the CC&R's for the development probably do not include any provision for requiring the fences to match, and that some property owners may eventually replace the existing fence with a fence of a different type, creating a patchwork effect. One of the property owners asked if it would be possible to collect funds through the Assessment District over a period of several years and then replace the fences all at once as a City project. Staff will be reviewing this request and advising the interested parties. Page 2 � 1 ` Recommendation For Fiscal Year 1995-96, no change is recommended with respect to the method of determining the assessments. The District boundary remains the same. At this time, Staff is proposing that the District assessment for FY 1995-96 remain the same as last year's assessment. The assessment to the single- family property owners in the Dublin Hills Estates development is proposed to remain at $228.72 per single-family home. The Amador Lakes Apartments property is proposed to be assessed at a rate of $38.68 per dwelling unit (or $21,351.36 for the entire apartment development), which is also the same as the 1994-95 assessment. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the resolution. • g:(ad)183-2lagsthrng Page 3 RESOLUTION NO. -95 A RESOLUTION OF THE CITY COUNCIL: OF THE CITY OF DUBLIN APPROVING ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT, AND ORDERING LEVY OF ASSESSMENT CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 (STAGECOACH ROAD) • WHEREAS, by its Resolution No. 28-95, a Resolution Directing Preparation of Annual Report for City of Dublin Landscaping and Lighting Maintenance Assessment District No. 83-2 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said report was made and filed with the City Clerk and duly considered by this Council and found to be sufficient in every particular, whereupon it was determined that said report should stand as Engineer's Report for all subsequent proceedings under and pursuant to the aforesaid Resolution and that July 25, 1995, at 7:00 p.m. in the Council Chambers, Dublin Civic Center, 100 Civic Plaza, Dublin, California, was appointed as the time and place for a hearing by the Council on the question of the levy of the proposed assessment, notice of which hearing was mailed, published and posted in accordance with Government Code Section 54954.6; and WHEREAS, at the appointed time and place, said hearings were held, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters pertaining to said levy were heard and considered by this Council, and this Council thereby acquired jurisdiction to order said levy and confirmation of diagram and assessment prepared by and made a part of the report of said engineer to pay the cost and expenses thereof; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve that: (a) The property owners owning more than fifty percent of the area of assessable land within the District had not, at the conclusion of said hearing, filed written protests against the said proposed levy, or against the Engineer's Estimate of costs and expenses, or against the maps and description, or against the diagram or the assessment to pay for the costs and expenses thereof; (b) The public interest, convenience, and necessity require that said levy be made; (c) The District benefited by said improvements and to be assessed to pay the costs and expenses thereof, and the exterior boundaries thereof, are as shown by a map thereof filed in the office of the City Clerk, which map is made a part hereof by reference thereto. The balance of this annual cost has been divided equally among Lots 1 through 150, inclusive, of Tract 4719. The cost of maintaining the excavated slopes and concrete culverts together with its landscaping on the interior slopes of the single-family area(above Agate Way and Coral Way) shall be evenly spread over Lots 1 through 150 of Tract 4719. Lots 152 and 153, being park and open space, shall have a zero assessment. Lots 154 and 155, being public agency owned, shall have a zero assessment. • 5 • • SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit. The district was formed as an alternative to utilizing a homeowner's association to maintain the landscaping. The activities funded by this assessment district include irrigation maintenance(including utility costs), weeding, pruning, fertilizing, and other activities associated with maintenance of landscapes. The assessment for this district is spread between the property owners of the Amador Lakes Apartments, who pay 60% of the cost of Stagecoach Road landscape maintenance, and the property owners of the 150 single-family homes of the Dublin Hills Estates development, who pay 40% of the cost of Stagecoach Road landscape maintenance and 100% of the cost of the interior slopes landscape maintenance. The assessment for the 1995-96 tax year is proposed to be as follows: Single-family lots: $228.72 per lot; Amador Lakes apartment lots: $ 38.68 per apartment This proposed assessment is the same as the assessment for the 1994-95 and 1993-94 fiscal years. Copies of the Preliminary Engineer's Report for this assessment district are available at the City Offices, 100 Civic Plaza, Dublin, California 94568. The Engineer's Reports explains the scope of work, a breakdown of the costs that are proposed to be paid by the assessment district, and the method of proportioning the assessments between the single-family and apartment/condominium lots. A public hearing will be held at the regular City Council meeting of July 25, 1995, for the purpose of hearing protests regarding this assessment. The meeting begins at 7:00 p.m. in the Council Chambers of the Dublin Civic Center, 100 Civic Plaza, Dublin. If you wish to protest this assessment, your protest must be made in writing and must be sent to the City of Dublin, 100 Civic Plaza, Dublin, California 94568. Protests must be received no later than the close of the public hearing as listed above. Your protest should include both the street address of the property and the assessor's parcel number(APN) of the property. The Landscaping and Lighting Act of 1972 provides that a majority protest, which would consist of property owners of over 50% of the land area of the property being assessed, would cause the abandonment of the assessment. 'r11Mw.pu xrsrr_er• NofthQ �Ja LK)S( Zr, 2v�1�c w STAGECOACH ROAD (TRACT 4719) LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT NEWSLETTER FACTS ABOUT THE ASSESSMENT DISTRICT This assessment district was formed in 1983 for the purpose of maintaining certain landscaping improvements along Stagecoach Road and on the"interior slopes"of the Dublin Hills Estates development(Coral Way and Agate Way). The following areas are being maintained by the City at the present time: • Landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between Amador Valley Boulevard and the northerly City Limit. • Slopes and landscaping and irrigation of the slopes within a public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48 of Tract 4719. These are the"interior slopes"which face houses on Agate Way and Coral Way. In order to arrive at the annual assessment,estimated maintenance costs for the ensuing year are divided among residents of the single-family homes of Dublin Hills Estates and the owners of the Amador Lakes Apartments as follows: • Sixty percent(60%)of the annual cost of maintaining the landscaping within and along Stagecoach Road has been assigned to the 552 apartment/condominium lots of Amador Lakes, distributed on an equal basis. The remaining 40%of this annual cost has been divided equally among the 150 single-family lots in Dublin Hills Estates. • The cost of maintaining the excavated slopes,concrete culverts,and landscaping on the interior slopes of the single-family area(Agate Way and Coral Way)is divided evenly among the 150 Dublin Hills Estates lots. The funds collected through assessments are accounted for separately from other City funds. These funds can only be used for specified expenses within the boundaries of the Assessment District. Each year,the City is required to notify you of one or more public hearings that are being held regarding the proposed assessment for the upcoming fiscal year. The public hearing notice is included in the envelope with this newsletter. These public hearings are held at regular City Council meetings;this year's hearing will be held on July 25th at 7:00 p.m. LANDSCAPING Oleander Planting: The City recently contracted to plant 320 oleanders on the Stagecoach Road slope at Quartz Circle as the next phase of the landscaping upgrade plan developed about two years ago. The work was completed in June. The funding for the plant material was contributed by Rafanelli and Nahas,the owner of the Amador Lakes apartment complex. The Assessment District paid the cost of labor to install the oleanders as part of the maintenance assessment already received for Fiscal Year 1994-95. VANDALISM The Stagecoach Road area continues to experience a significant amount of vandalism. While vandalism affecting the Assessment District landscaping remains at approximately the same level as last year, Stagecoach Park has been hit very hard and frequently. The City has spent over$2,000 in vandalism or graffiti-related repairs at Stagecoach Park in the past fiscal year. The vandalism has consisted of damage to plant material and irrigation systems,as well as defacing some of the park furniture,equipment, and fencing. Please contact Dublin Police Services at 833-6670 to report incidences of vandalism,particularly if you see the act of vandalism occurring or can provide a description of the vandals. We want to repair any areas that are vandalized as soon as possible;so please let us know right away if you notice any graffiti or damage. • RECOMMENDED ASSESSMENT At this time, our recommendation is to retain the same level of service and the same assessment as last year's. These amounts are: $228.72 per single family home and$38.68 per apartment dwelling unit(or a total of$21,351.36 for Amador Lakes). SURVEY REGARDING FUTURE YEARS'ASSESSMENTS At the July 11th City Council meeting,the City Council reviewed and approved the Preliminary Engineer's Report for the 1995-96 assessment,which is proposed to be as noted in the above paragraph. This is the same as the assessment which was levied in the 1993-94 and 1994-95 tax years. The City Council also discussed several options regarding this assessment for future years. These options are: 1) To allow the assessment to increase in accordance with the Consumer Price Index(CPI). The CPI rate of increase has recently been about 2%per year. This would increase the assessment per single-family lot to$233.30 and the Amador Lakes assessment to$39.46 per unit(total of$21,781.92). This would result in net revenue of about$1,100 and would help to keep from using the reserve,assuming that the maintenance cost and utilities will increase with the CPI. 2) To recalculate the assessment on an annual basis so as to reflect the actual cost of District maintenance. If this method were used, the assessment could potentially increase or decrease depending upon actual maintenance activities and utility costs that occur and the interest that is earned on the reserve. At this time,the reserve is approximately$23,000. 3) To freeze the assessment at its current level and utilize the reserve to pay any inflationary maintenance cost increases. The reserve has been used in the past to pay the cost of landscape renovations,particularly following the freeze of several years ago in which much of the plant material in the District was lost. The City's Public Works Staff recommends allowing the reserve to remain at least at its present level so that contingency funds are available in the event that another freeze or similar landscape disaster occurs. The City Council has requested that the property owners in this Assessment District provide some direction as to which of the above options is preferable. We are enclosing a survey sheet and a post-paid return envelope and would appreciate your letting us know by July 18th so that we can advise the Council at the July 25th public hearing. At this meeting,our City Staff will be available to discuss maintenance activities,assessment options,and answer any questions you may have about the District. We encourage you to attend this meeting. If this method were used, the assessment could potentially increase or decrease depending upon actual maintenance activities and utility costs that occur and the interest that is earned on the reserve.
