No cost to the City at this time. The two open space parcels are to be maintained by this district for three years after acceptance of Tract 5511 improvements. DESCRIPTION: The property owners within Tract 5511 (the Villages at Alamo Creek), Rafanelli and Nahas and Ahmanson Developments, have submitted a petition requesting and consenting to formation of a landscaping and lighting assessment district for purposes of maintaining certain improvements within said Tract. This district would be very similar to District 1983-2, formed to - maintain the landscaping improvements in Tract 4719 (Stagecoach Road and the Beck development). Ahmanson Developments is the owner of Lots 1 through 145 (Village VI). Rafanelli and Nahas owns Lots 146 through 151. Villages IV and V will not be included in the District at this time but will be annexed when developed. The figure of $58,460 was formulated from the costs associated with those in District 1983-2 and estimates of manpower required to maintain the improvements. Formation of this district will insure routine maintenance of landscaping and irrigation systems, right-of-way fencing, walls, and entrance signs, trash removal, and maintenance of open space including firebreaks, weed abatement, slope drainage, and slope stability repair for the two open space lots. As the deadline for the 1986-87 assessments was August of this year, and as the landscaping in these proposed Villages will probably not be installed and accepted before next summer, this $58,460 assessment is being set for Fiscal Year 1987-88. The improvements to be maintained include landscaping, irrigation, fencing, and associated structures along Dougherty Road, Amador Valley Blvd. , Alamo Creek Drive, Shady Creek Road, and the slopes above Lots 119 to 145 (adjacent to the open space area) and any earth slide problems associated with the two open space parcels (A & D) . ,max ITEM NO. tiCOPIES TO: Rafanelli & Nahas Ahmanson Developments Maintenance Superintendent . • APPLICATION AND WAIVER RESPECTING FORMATION OF MAINTENANCE DISTRICT 1. The undersigned are the owners of the land which is the subject of this application and the related maintenance district, and which is described as follows: All that certain real property described as Tract 5511 in the City of Dublin, Alameda County, California. . 2. The undersigned hereby request and consent to the formation of a maintenance district pursuant to the Landscaping and Lighting Act of 1972 (Sections 22500 and following) , California .Streets and Highways Code, for the purpose of providing for the following: The maintenance of landscaping and associated structures, as delineated on plans prepared by Guzzardo and Associates, Landscape Architects, on file with the' City of Dublin, including weeding, fertilizing, pruning and plant replacement; the operation of irrigation systems including payment for the cost of water and power utilities; the maintenance of right-of-way fencing, walls and entrance. signs; trash removal on streets and landscape maintenance easements, maintenance of open space including fire breaks, weed abatement, slope repair (Lots A & D only) and slope drainage facilities. Maintenance shall not include slope repair on any private lot. - . 3. The areas to be maintained shall be the Rights of Way and Landscape Maintenance Easements (L.M.E. ) located as follows: west side of Dougherty Road from the south boundary of Lot 150 to Alamo Creek Drive, Amador Valley Blvd. from Alamo Creek to Dougherty Road, the west side of Wildwood Road, the north side of Alamo Creek Drive, Shady Creek Road (L.M.E. areas only) and the slope areas within the L.M.E. above Lots 110 to 145. For a • period of three years from final acceptance of Tract 5511 improvements, maintenance shall include cutting of fire breaks and slope repair on Lots A and D. Afterward, such maintenance shall be by the City of Dublin. 4. The undersigned hereby waive the notice of public hearing otherwise required by the Landscaping and Lighting Act of 1972 with • respect to both the formation of the maintenance district and the adoption of the initial budget, and the. undersigned further consent to the approval by the City Council of the City of Dublin of the Engineer's Report attached hereto as Exhibit A and by reference incorporated herein. Thompson, City Engineer of the City of Dublin, Engineer of Work for Landscaping and Lighting District No. 1986-1 (Tract 5511), City of Dublin, Alameda County, California, makes this report, as directed by the City Council, pursuant to. Section 22585 of the Streets and Highways Code (Landscaping and Lighting Act of 1972). The improvements which are the subject of this report are briefly described as follows: The maintenance of landscaping and associated structures, as delineated on plans prepared by Guzzardo and Associates, Landscape Architects, on file with the City of Dublin, including weeding, fertilizing, pruning and plant replacement; the operation of irrigation systems including payment for the cost of water and power utilities; the maintenance of right-of- way fencing, walls, and entrance signs, trash removal on streets, maintenance of open space including firebreaks, weed abatement, and slope drainage facilities. This report consists of six parts, as follows: Part A: Plans and specifications for the improvements are filed with the City Clerk. Although separately bound, the plans and specifications are a part of this report and are included in it by reference. Part B: An estimate of the cost of the improvement. Part C: An assessment of the estimated cost of the improvement on each benefited parcel of land within the assessment district. Part D: A statement of the method by which the undersigned has determined the amount proposed to be assessed against each parcel. Part E: A list of the names and addresses of the owners of real property within this - assessment district, as shown on the last equalized assessment roll for taxes, or as known to the Clerk. The list is keyed to Exhibit C by assessment number. Part F: A diagram showing all of the parcels of real property within this assessment district. OF THE CITY OF DUBLIN' i;:, ' ,:, T•` :.. 0 ' "4-17 - ORDERING FORMATION OF CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. 1986-1 • WHEREAS, on this date the City Council adopted its Resolution Initiating Proceedings for the formation of Landscaping and Lighting District No. 1986-1 (Tract 5511), City of Dublin, Alameda County, California, and directed the preparation and filing of an Engineer's Report on the proposed formation; and WHEREAS, the Engineer for these proceedings has filed an Engineer's Report with the City Clerk; and WHEREAS, owners of all land within the boundaries of the proposed assessment district have filed their consent to the formation of the proposed district without notice or hearing, and to the adoption of the Engineer's report and the levy of assessments stated herein. - NOW, THEREFORE, BE IT RESOLVED that the City Council hereby orders the maintenance of the improvements and the formation of the assessment district described in the Resolution Initiating Proceedings and in the Engineer's Report and confirms the diagram and assessment contained in the Engineer's Report and levies the assessment for the fiscal year 1986-87. - PASSED, APPROVED, AND ADOPTED this 10th day of November, 1986.
