ITEM NO. 114

DESCRIPTION: This assessment district, which was formed in the fall of 1996, funds
street landscape maintenance and utility costs for the Santa Rita development area. This area is bounded
by Arnold (Sebille)Road on the west, Gleason Drive on the north, Tassajara Road on the east, and
Interstate 580 on the south. The District was formed at the request of the property owner to assure that all
of the landscaping in Emerald Park was maintained at a consistently high level. This property owner did
not believe maintenance by homeowners' associations would accomplish the same desirable end result.
The scope of work includes maintenance of roadside landscaping for Dublin Boulevard, Hacienda Drive,
Central Parkway, a portion of Arnold (Sebille)Road, Tassajara Road (westerly portion), and a portion of
Gleason Drive, plus the maintenance of the trail and landscaping along the Tassajara Creek channel, as
delineated in the scope of work on Page 2 and 3 of the Engineer's Report.
It was anticipated that some of the landscaped areas in this District would be installed and maintained by
the City for most of 1998-99; however, due to the wet weather and other delays, only a small portion of
the landscaping has been installed, completed, and accepted by the City for maintenance. It is anticipated
that the City will begin maintaining additional portions of the improvements in this District about halfway
through Fiscal Year 1999-2000. The total maintenance and administration cost for this District for Fiscal
Year 1999-2000 is expected to be $65,133. It is proposed to use the existing surplus to offset part of this
cost; the proposed assessment for Fiscal Year 1999-2000 is $36,218. The total developed acreage in this
District is now 381.45 acres. This breaks down to a per-acre assessment of$94.95. As provided in the
Engineer's Report, individual lots in residential subdivisions are assessed based on density; in other words,
the number of acres in the subdivision is divided by the number of lots, and the resulting quotient is the
assessment per lot. For Fiscal Year 1999-2000, the following assessments resulted from this calculation:
California Creekside single-family lots: $13.50 per lot
California Brookside multi-family units: $ 5.94 per unit
SummerGlen—Richmond American (north) lots: $11.20 per.lot
SummerGlen—Richmond American (south) lots: $13.02 per lot
SummerGlen— SummerHill and Pulte lots: $20.26 per lot
Commercial (including retail, office, and industrial uses, as well as apartment properties) are assessed based
on the per-acre figure multiplied by the number of acres per individual lot.
Staff held an informational meeting for property owners on July 26, 1999. An informational newsletter
(Attachment 3) was sent to all property owners along with the required public hearing notice, explaining
the reasons for establishing the District and the activities that are expected to take place during the
upcoming Fiscal Year.
Four property owners attended the informational meeting. The sign-in attendance sheet is Attachment 4.
All of the attendees are owners within the California.Creekside development. Several questions were
asked about completion of items within California Creekside; specifically lighting that is to be installed on
entry columns, painting of the wrought iron fence at the end of Pheasant Court, and issues relating to
landscaping at the traffic circle within the development. The traffic circle landscaping is not part of the
assessment district but is to be maintained by-the Homeowners' Association for the California Brookside
multi-family development. Staff has developeda"punchlist" of items to be completed prior to acceptance
of the subdivision, and these items are included on the list.
D O(T. ')
Another question related to the estimated cost of maintenance for the ultimate or"buildout" improvements,
particularly the creek landscaping and soundwalls. It was explained that the engineering firm which
prepared the original Engineer's Report prepared this"ultimate" cost estimate based on information that
was available at the time. The annual assessments will be determined by the actual budget prepared for
maintenance each year and may continue to be lower than the"ultimate" of$710 per acre (plus allowable
inflationary and utility increases).
There was also a question related to "bidding" the landscape maintenance to achieve the best possible
price. Staff explained that MCE Corporation, the City's maintenance contractor, performs street, park and
building maintenance activities and that it appears there are no other contractors available to perform all of
these functions to the same extent as MCE. Staff assured the resident that the budgets prepared for the
assessment districts are reviewed extensively, that any subcontract work is, in fact, bid by MCE to obtain
the best possible price, and that payment of prevailing wage is required for public work.
As of the time this report was written (July 27,1999), one written protest had been received from a
property owner within California Creekside. Any additional protests received will be brought to the City
Council meeting for entry into the public record.
Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the resolution.

developed properties within the boundaries of the District on a per acre basis.
"Developed acres" shall include property which has a recorded final map or
parcel map as of July 1st of each year.
Each year the City Council shall determine the assessment for that year based
on the following:
1. Cost of maintenance of installed Improvements ("M").
2. Total amount of developed acres ("A").
3. The annual assessment for the developed acres for that year ("M")
shall be spread on a per-acre basis ("M" _ "A") based on the
following:
A. Commercial developed area, per acre basis.
B. Single-family residential area, per acre basis.
C. Multi-family residential area, per acre basis.
4. The single-family and multi-family residential area per acre
assessment will be further spread on a per lot basis based on the
number of lots on the final map, parcel map, or condominium map for
each particular development.
5. If the assessment in any year would exceed $710 per acre, the amount
in excess of$710 shall be assessed to the remaining undeveloped
acres on a per acre basis, subject to the maximum developed acre
amount.
Page 7

6. The maximum developed acre assessment of $710 per year will be
increased annually by the percentage increase in the Bay Area Urban
Wage Earner Price Index (applies to all costs except water and
electricity), plus any actual increase in the cost for water and
electricity.
7. If the square footage cost of the Improvements will be less than the
amount set forth herein (after adjustment in accordance with
Paragraph 7), the assessment shall be reduced proportionately to
reflect the reduced cost of Improvements in that year.

 INFORMATIONAL NEWSLETTER
WHAT IS AN ASSESSMENT DISTRICT?
A maintenance assessment district is an area within a City in which property owners receive a benefit
from certain public improvements, and for which the property owners pay the cost of maintaining those
improvements. The City of Dublin currently has a City-wide street light maintenance assessment
district, which funds the cost of energy and maintenance for the public street lighting system, as well as
three landscape maintenance assessment districts which fund the cost of utilities and maintenance for
street-side landscaping and related improvements. The landscape maintenance assessment districts
are specific to certain development areas.
WHY DO WE HAVE ASSESSMENT DISTRICTS?
Developer-installed residential area street-side landscaping in the City of Dublin
TIC.:}:
'xk:`::.: "r is not maintained through the City's General Fund. City street landscaping that is
..f.:,.::. ; ..: ' maintained through the City's General Fund includes ONLY median landscaping
(which the City also pays for in the Santa Rita Development Area), and landscaping
installed by the City as part of a Capital Improvement Project on an arterial street.
All other street-side landscaping is either maintained privately or through an assessment district. In this
way, the City's General Fund can be used for many other public services, which include Police and Fire
Services, park maintenance, recreation programs, and library services.
WHAT AREAS ARE INCLUDED IN THE DISTRICT?
The Santa Rita Development Area includes the_areal bounded by 1-580, Tassajara Road, Gleason
Drive, and Arnold Road. The specific areas that are to be maintained are as follows (see map):
1. The northerly and southerly street frontages for Dublin Boulevard from Arnold Road (Sebille Road)
• to Tassajara Road.
2. The northerly and southerly street frontages for Central Parkway (the "transit spine') from Arnold
Road (Sebille Road) to Tassajara Road excluding the future school frontage landscaping and
Emerald Glen Park frontage landscaping.
3. The southerly street frontage for Gleason Drive from Arnold Road(Sebille Road) to Tassajara Road,
excluding the Emerald Glen Park frontage landscaping, from Tassajara Creek to Tassajara Road.
4. The easterly street frontage for Arnold Road(Sebille Road) from Dublin Boulevard to Gleason Drive.
5. The easterly and westerly street frontages for Hacienda Drive from the 1-580/Hacienda interchange
to Gleason Drive.
6. The westerly street frontage of Tassajara Road 350 feet southerly of the Tassajara Road and
Dublin Boulevard intersection, to the Tassajara Road/Gleason Drive intersection.
7. Tassajara Creek and trail from 1-580 to Gleason Drive.
Street median landscape maintenance and park maintenance are not part of this District.
WHAT IMPROVEMENTS ARE MAINTAINED? ,
-. -. -. .'`:>:'<- -< '>
Improvements that are maintained by the.District include landscaped and open space=- _ _ = : -
areas, entry features, entry lighting, masonry soundwalls, wrought iron fences, publicly- 1=V' ..
owned drainage ditches, irrigation systems, and trees and plants. The cost includes water :::. •
:.it:,--"-! f M' rtiiM;-N! F
and power for irrigation systems, labor and materials, and administrative costs for both the City and the
County Assessor's office.
HOW IS THE ASSESSMENT AMOUNT DETERMINED?
Each year, the City estimates the cost of utilities and maintenance for the upcoming fiscal year and
divides that cost among the properties in the assessment district, based on an adopted formula. The
•
assessment for each property appears on the property tax bill as a "special assessment." The funds
collected in this manner can only be used for the purpose outlined in the Engineer's Report for the
assessment district. Any funds that remain unused at the end of the fiscal year are carried over as
surplus to be used in the future.
The preparation of the initial Engineer's Report for the District included cost estimates for
maintenance of improvements for both the first year (1997-98) and for "buildout" when all of the
improvements have ultimately been installed. We estimate that "buildout".will occur about two years
from now.
WHAT ASSESSMENTS HAVE OCCURRED SO FAR?
The initial (1997-98) assessment for this District was based on a maintenance cost estimate that
assumed the City would accept specific areas of landscaping during Fiscal Year 1997-98.
Subsequently, the improvements that were anticipated to be accepted in 1997-98 were not accepted by
the City, as these improvements were incomplete or in an unsatisfactory condition, and no assessment
district funds were expended in 1997-98. As a result, the assessment for the following year, 1998-99,
was set at zero. The City has now accepted improvements along Arnold Road and portions of Gleason
and Hacienda Drive. It is anticipated that additional areas will be accepted during 1999-2000. There is
still a surplus of funds remaining from the initial assessment which will pay a portion of the anticipated
cost for 1999-2000. The proposed assessment for 1999-2000 is lower than the initial assessment two
years ago.
The formula for future years includes an assessment cap for buildout, which is $710 per acre of
developed land, except that annual increases are allowed according to the Consumer Price Index (CPI)
and for actual increases in utility rates. The following table compares the initial (1997-98) assessment,
the proposed (1999-2000) assessment, and the estimated "buildout" assessment, which is based on
$710 per acre.*

*The $710 per acre buildout assessment is subject to increase according to the Consumer Price Index (CPI) and
actual utility rate increases as noted above. Tth CPI rate of increase has ranged from 3% to 5% per-year for the
past few years. There have been no electric rats increases, and the water rates have not changed appreciably.
ARE PROPERTY OWNERS NOTIFIED IN ADVANCE ABOUT ASSESSMENTS?
The City is required by law to hold annual public hearings regarding Landscaping and Light1i iv-
Assessment Districts and to provide 10-day hearing notices that explain the procedure to follow if you
want to protest the assessment. The public hearing notice enclosed with this newsletter advises you of
the public hearing date, which is August 3, 1999, and of the protest procedure. You can expect to
receive annual public hearing notices in upcoming years. The hearings are normally held in late July or
early August.
WHAT ISSUES ARE DISCUSSED AT THE HEARING?
The public hearing usually includes a presentation by City Staff which describes the
`. District improvements and any changes that have taken place or may take place the
following year. The report includes an accounting of expected costs and the amount
that is proposed to be assessed. The City Council may comment on the report and
then members of the public may ask questions, raise concerns, or protest the assessment.
Some concerns were raised at the public hearing last year regarding the landscaping improvements
that are being installed in this area. Specific landscape plans are provided to the City for approval.
Once the plans have been approved by the City, the developer is required to install the landscaping per
approved plans, and the landscaping must be in good condition before the City will accept it for
maintenance. No costs to the assessment district will occur until the City accepts the landscaping.
CAN THE DISTRICT BE DISSOLVED?
Some residents have inquired.about the means of cancelling or removing their property from the
assessment district. It is theoretically possible to cancel the assessment in any one year by means of a
majority protest (by owners of more than 50% of the property). However, the Alameda County Surplus
Property Authority, as developer of the area that is included in the Assessment District, has.recorded a
Declaration of Conditions, Covenants, and Restrictions (CC&R's) that imposes a "Deed Assessment" on
each parcel in an amount equal to the amount of the Landscape Maintenance Assessment. The Deed
Assessment ensures that the property owners will fund the cost of the specific landscape maintenance
that is covered by the Assessment District. The County would then collect the Deed Assessment along
with property taxes. The Deed Assessment will only be collected if the Landscape Maintenance
Assessment is not collected in a given year.

NOTICE OF ASSESSMENT
CITY OF DUBLIN
LANDSCAPING MAINTENANCE ASSESSMENT DISTRICT 97-1
(SANTA RITA AREA)
This assessment district funds the maintenance of landscaping improvements along the frontage of
Dublin Boulevard, Hacienda Drive, Central Parkway, a portion of Arnold (Sebille) Road, Tassajara Road
(west side) and a portion of Gleason Drive, plus the maintenance of the trail and landscaping along the
Tassajara Creek channel. Median landscaping maintenance is paid for by the City and is not a part of this
assessment district. The activities funded by this assessment district include the maintenance and repair of
landscaped and open space areas, entry features, entry lighting, masonry soundwalls, wrought iron fences,
publicly-owned drainage ditches, irrigation systems, trees and plantings, furnishing of water and power for
irrigation systems, sidewalks and pathways, together with all appurtenant and incidental expenses thereto.
The assessment for this district is spread among property owners within the area bounded by Arnold
(Sebille) Road on the west, Gleason Drive on the north, Tassajara Road on the east, and 1-580 on the
south, as indicated in the Engineer's Report which is on file with the City Clerk.
The assessment for the 1999-2000 tax year is calculated according to a formula set forth in the Engineer's
Report. The District requires that the cost of maintenance be spread equally among the property on a per-
acre basis. In the case of single-family or multi-family residential developments, the assessment would be
based on the total acreage of the development, divided equally among the single-family or multi-family
housing units. (If a residential development contains both single- and multi-family units, the proportion
between the two housing types may be different, based on their relative areas divided by the number of
units for each density category.)
Following are the proposed assessments for Fiscal Year 1999-2000: _,__
California Creekside single-family lots: $13.50 per lot
California Brookside multi-family units: { $ 5.94 per unit
SummerGlen — Richmond American (north) lots: $11.20 per lot
SummerGlen— Richmond American (south) lots: $13.02 per lot
SummerGlen —SummerHill and Pulte lots: $20.26 per lot
Commercial, Industrial, and other Non-Residential Property: $94.95 per acre.
Copies of the Preliminary Engineer's Report for this assessment district are available at the City Offices,
- 100 Civic Plaza, Dublin, California 94568. The Engineer's Report explains the scope of work, a breakdown
of the costs that are proposed to be paid by the assessment district, and the method of proportioning the
assessments among the properties within the District.
A public hearing will be held at the 'regular City Council meeting of August 3, 1999, for the purpose of
hearing protests regarding the levy of assessments for the 1999-2000 tax year. The meeting begins at 7:00
p.m. in the Council Chambers of the Dublin Civic Center, 100 Civic Plaza, Dublin.
If you wish to protest this assessment, your protest must be made in writing and must be sent to the City ,
of Dublin, 100 Civic Plaza, Dublin, California 94568. Protests must be received no later than the close of
the public hearing as listed above. Your protest should include both the street address of the property ?^ri.
the assessor's parcel number (APN) of the property. The Landscaping and Lighting Act of 1972 provi;
that a majority protest, which would consist of property owners of over 50% of the land area of the prop 'ray
being assessed, would cause the abandonmint of the assessment.
Please feel free to contact the Public Works Department at 100 Civic Plaza, Dublin, (925) 833-6630, if you -
have any questions.
