Prepared by Jayson Imai, Senior Civil Engineer EXECUTIVE SUMMARY: D.R. Horton BAY, Inc. has constructed the improvements for Tract 8108, Neighborhood E -1, Positano /Fallon Village, in accordance with their Tract Improvement Agreement. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: D.R. Horton BAY, Inc. has provided a Warranty Bond (Bond No. CMS290355) in the amount of $1,184,285.00, issued by RLI Insurance Company, to guarantee the improvements associated with the Tract 8108, Neighborhood E -1, Positano /Fallon Village, for one year. Upon acceptance of the Tract 8108 improvements, the City will incur annualized maintenance costs estimated to be $38,200 for street sweeping and street lighting (monthly), slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years). RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting the Tract Improvements and Approving the Regulatory Traffic Control Devices for Tract 8108, Neighborhood E -1, Positano /Fallon Village. ubmitte` By Public Works Director DESCRIPTION: "eviewed By Administrative Services D1\r`ebtor D.R. Horton BAY, Inc. (DR Horton) entered into a Tract Improvement Agreement with the City of Dublin on December 18, 2012, for the construction of street and other tract improvements associated with Tract 8108. Page 1 of 3 ITEM NO. 4.4 D.R. Horton provided a Faithful Performance Bond and a Labor & Materials Bond to guarantee construction of the tract improvements for Tract 8108. At the time the Tract Improvement Agreement was approved, D.R. Horton had completed approximately 80% of required improvements. Therefore, City Council approved bond amounts for the Faithful Performance and Labor & Materials Bonds equal to twenty five percent (25 %) of the total estimated cost to construct the complete improvements. D.R. Horton has recently completed the construction of the required tract improvements associated with Tract 8108, and is requesting that the bonds for this work be released. Horton has provided a Warranty Bond, issued by RLI Insurance Company, in the amount of $1,184,285.00 (Bond No. CMS290355). The bond amount is equal to twenty five percent (25 %) of the full cost of completion of the improvements and is equivalent to the reduced Faithful Performance Bond amount approved by City Council in December, 2012 with the Tract Improvement Agreement. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. Horton BAY, Inc., the developer of Tract 8108, previously entered into a Tract Improvement Agreement, dated December 18, 2012, City Council Resolution No. 206- 12, with the City of Dublin, to complete improvements associated with Tract 8108, in accordance with plans on file with the City Engineer; and WHEREAS, the developer provided Faithful Performance and Labor and Materials Bonds, each in the amount of $1,184,285.00 (Bond Nos. CMS262790), issued by Willis Florida to guarantee said Tract 8108 improvements; and WHEREAS, the Tract 8108 improvements are now complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, certain traffic regulatory devices have been installed as part of the Tract 8108 improvements; and WHEREAS, the Faithful Performance Bond and Labor and Materials Bonds can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, and replaced with a Warranty Bond to guarantee the completed work for a one -year period; and WHEREAS, D.R. Horton BAY, Inc. has provided a Warranty Bond in the amount of $1,184,285.00 issued by RLI Insurance Company (Bond No. CMS290355) to guarantee the improvements for a one -year period; NOW, THEREFORE, BE IT RESOLVED that: 1. The tract improvements for Tract 8108 are hereby approved and accepted, subject to a one -year guarantee period. 2. The submitted Warranty Bond issued by RLI Insurance Company (Bond No. CMS290355) in the amount of $1,184,285.00 for the Tract 8108 Improvements, be accepted as security for the aforesaid one -year warranty period, said period to commence on this date and terminate on the 5th day of April, 2017. 3. The original Faithful Performance Bond issued by Willis Florida (Bond No. CMS262790) in the amount of $1,184,285.00 for the Tract 8108 Improvements be released. 1 4. The original Labor and Materials Bond issued by Willis Florida (Bond No. CMS262790) in the amount of $1,184,285.00 for the Tract 8108 Improvements be released in accordance with the requirements of §66499.7 of the Government Code of the State of California. 5. The traffic regulatory devices installed by the developer within the development are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: A.
