RECOMMENDATION dopt Resolution and Authorize Staff to execute Worker ' s Compensation Certificate and Assumption of Liability. FINANCIAL STATEMENT: The City would incur any premium adjustment from any Worker ' s Compensation claim submitted by designated volunteers . DESCRIPTION At the direction of the City Council Staff has contacted the Lawrence Livermore National Laboratory (LLNL) regarding their technical volunteer program. LLNL has tentatively made arrangements to have Mr . Charles McMillian evaluate the acoustical conditions at the Shannon Community Center . LLNL has specific requirements for agencies participating in this program. The volunteers must be covered by workers compensation insurance for illness or injury arising out of or incurred in the course of work . Provisions in the Labor Code allow a public agency to adopt a resolution declaring a volunteer to be deemed an employee for purposes of providing worker ' s compensation insurance. The proposed resolution allows the City Manager the discretion to designate volunteers covered by Worker ' s Compensation insurance. This will provide the proper control to assure that the 'risk assumed by the City will not outweigh the benefit of the volunteer services . The current proposal involves a review of the facility and building plan specifications. The potential for job related injury is minimal and the value of the technical expertise provided may be significant . Therefore, it is recommended that the City Council approve the Resolution Providing Worker ' s Compensation Coverage for Certain City Volunteers and authorize Staff to execute the Worker ' s Compensation Certificate and Assumption of Liability Form. ---------------------------------------------------------------------------- COPIES TO: ITEM NO. o Q I Item 3. 10 Exhibit Missing LLNL Technical Volunteers/Workers' Compensation Certificate and Assumption of Liability Form RESOLUTION NO. 90- 84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- PROVIDING WOKERS ' COMPENSATION COVERAGE FOR CERTAIN CITY VOLUNTEERS, PURSUANT TO THE PROVISIONS OF SECTION 3363 .5 OF THE LABOR CODE WHEREAS, the City of Dublin finds its best interest will be served by utilizing volunteers in the provision of certain government services ; WHEREAS, said volunteers should be eligible for workers ' compensation insurance while on duty; NOW THEREFORE BE IT RESOLVED that , the City Council of the City of Dublin, does resolve as follows : Section 1 . That this Council finds and determines that the public interest is best served by providing workers ' compensation coverage for city volunteer workers as specified by the City Fianager .. Section 2 . That said volunteers are eligible for workers ' compensation benefits which will be applicable during the time the person actually performs volunteer services. Section 3 . The Mayor shall sign this resolution and the City Clerk shall attest and certify to the passage and adoption thereof. PASSED, APPROVED AND ADOPTED this 27th day of August,1984 .
