RECOMMENDATION Approve Resolution Consenting to Establishment of City
Street as a County Road (Silvergate Drive, Tract 4859 )
FINANCIAL STATEMENT: None
DESCRIPTION Tract 4859 (Nielsen) was approved by the City Council
on August 13 , 1984 and is scheduled to go before the County Board of
Supervisors on August 28 , 1984 .
The extension of Silvergate Drive within this Tract falls in both the City
and County. It is Staff ' s position that since the bulk of the tract and
street is in the County, the County should handle the processing.
This action simplifies the process by not requiring both jurisdictions to
enter into separate agreements and require separate bonds and fees .
Dublin Staff will inspect the improvements and the County will turn over the
inspection fees to the City for this purpose.
When this tract is annexed to the City, the street will become a Dublin
Street and the City will assume maintenance responsibility.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

CONSENTING TO ESTABLISHMENT OF CITY STREETS AS COUNTY ROADS
(SILVERGATE DRIVE, TRACT 4859)
WHEREAS, Tract 4859 is partially in the unincorporated
area of Alameda County and partially within the City of Dublin.
It is to the advantage of both Alameda County and the City of
Dublin that a single agency contract with the developer of Tract
4859 for all of the street improvements; and
WHEREAS , Section 1700 of the Streets and Highways Code
of the State of California provides that the Board of Supervisors
of a County may declare any highway lying wholly or in part within
a City, to be a County Highway for the purpose of construction,
maintenance, improvement or repair ; and
WHEREAS, Section 1701 of the Streets and Highway Code
requires consent of the City Council for such declaration to
become effective .
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Dublin does hereby resolve as follows :
That this City Council does hereby consent to the
establishment of that portion of Silvergate Drive, shown on the
Final Map of Tract 4859 within the City of Dublin, as a County
Highway for the purpose of the construction of street improvements
by the developer of Tract 4859 ; and
BE IT FURTHER RESOLVED that the City Clerk be, and is
hereby directed to forward two certified copies of this Resolution
to the Department of Public Works of Alameda County.
