AGENDA STATEMENT
CITY COUNCIL MEETING DATE: October 8 , 1984
SUBJECT Vector Control Services Agreement
EXHIBITS ATTACHED Draft Agreement
RECOMMENDATION Consider report and authorize Mayor to execute
Agreement with Alameda County Health Care Services
Agency and authorize a budget transfer from the
` contingent reserve to an account established to
record charges related to Vector Control Services.
The amount of the transfer shall be $8 ,925 .
FINANCIAL STATEMENT: The cost for the remainder of the current fiscal year
shall not exceed $8 ,925 , unless additional services
are requested pursuant to the agreement . This cost
continues to be ,less than the $15 ,750 which would have
been assessed to the City of Dublin taxpayers had the
City been included in the County Vector Control
Service Area .
DESCRIPTION At the regular City Council meeting on August 13 , 1984
the City Council received a report relating to the provision of Vector
Control Services .
Effective July 1, 1984 , the Alameda County Vector Control Staff and its
entire budget were transferred to the newly created Vector Control District .
Therefore, the County has requested that the City provide the services or
make an attempt ' to have the services provided on a contractual basis . Since
that time, the City Staff has received calls related -to vector-related
situations and Staff has attempted to deal with them in an appropriate
manner . However , the size and lack of expertise of the City Staff limits
the City' s ability to respond to resident ' s needs in this area . At the City
Council meeting on August 13 , 1984 , Staff was directed to investigate other
alternatives which may be available to the City.
State Mandate
Staff has contacted Mr . Jack McGurk of the State of California Environmental
Health Services and handles coordination of services within Alameda County.
Mr . McGurk has indicated that the provisions of State law which designated
which areas a health department must provide were tied to State subventions .
The County is in the same situation as cities which no longer receive the
subvention monies with which the mandates were originally connected.
Therefore, he has indicated that it is difficult to have any enforcement
over a county as to which services are provided. In addition, Section 510
of the Health & Safety Code indicates that when funding is not sufficient
from the State, the Local Health Officer can charge a fee for service. Mr .
McGurk noted that throughout the states, environmental health agencies are
using assessment districts in order to provide funding for services .
City of Fremont
Staff has also held discussions with a representative of the City of Fremont
relating to their operations . Mr . Pat Hayes, Supervisor , indicated that
their animal control officers are currently doing the service related to the
vector control . He noted several potential problems with a contractual
arrangement between *the Cities of Dublin and Fremont .

One significant problem is the distance. Also, the fact that they are using
animal control officers . When these employees are not performing the duties
related to vector control, they are engaged in animal control areas . Mr .
Hayes also noted the difficulties the Fremont organization was experiencing
with the transition from the County. Specifically, this will require a
complete revision of Fremont ' s municipal codes to indicate that the County
Health Officer is no longer responsible for enforcement of specific duties .
It does not appear as if a contract with the City of Fremont would, be an
appropriate solution to effectively providing these services in the City of
Dublin .
Contra Costa County
Contra Costa County currently provides the services through its Division of
Environmental Health. The Environmental Health duties are performed by
registered sanitarians who also perform other health inspections. Staff
attempted to contact the Director of this program, however , phone calls were
not returned. It is presumed that a contract with this agency would not be
possible.
Lawrence Livermore Lab
Staff has also contacted the Lawrence Livermore Lab relating to their
ability to provide similar services to the City. The Lab has just completed
a survey of employees indicating outside interest in areas in which they
would perform services . However , the individual responsible for collecting
this information indicated that none of the current employees indicated an
interest in this area .
Private Sector Contractor
Staff has considered the possibility of utilizing the services of a private
exterminator . However , this type of company would only be capable of
addressing one portion of a comprehensive vector control program. A pest
control service would not be able to address questions of sanitation and the
scientific testing which is performed on vectors collected. This is a
specialized service which requires expertise related to all associated
portions of the program. The scope of a comprehensive program is discussed
further in the next section.
Alameda County Health Care Services Agency
Staff has continued to work with the County in order to identify a method by
which the City could contract for services on an as-needed basis . Mr .
Gerald Winn, Director of Division of Environmental Health has indicated that
the service would have to be provided by personnel possessing a degree and
certified with the State Department of Health. -The personnel operating in
Dublin would have higher qualifications than those working in the Vector
Control District . Asa result of this change, the cost of service would be
$51 . 00 per hour . This charge would include any costs associated with
overhead, materials , vehicles or other charges . A contract with the County
would also assure coordination of related services .
In 1982-83 , the City used a total of 131 hours . Staff believes that a
maximum of 175 hours of service for the upcoming fiscal year should be
adequate . This is contained in the proposed agreement which is attached for
your consideration. The maximum cost for this level of service would be
$8 , 925 .

If the City had determined at the outset to fund the cost of being a member
of the Vector Control Services District, the cost to the General Fund would
have been approximately $14 ,965 . However , the cost of participating in the
District represents 593 hours of service, provided by vector control
technicians . Mr . Winn has indicated to Staff that with the establishment of
the District, a computerized reporting system has been implemented. This
will allow the County to advise cities of the amount of service received
compared to the revenues collected in that area . Given the fact that the
City of Dublin is not a member of the Vector Control Assessment District ,
this would not be possible during the current year . - As information, City
Councilmembers should be advised that on September 20 , 1984 , LAFCO did adopt
a sphere of influence for the District which included the City of Dublin.
This allows the opportunity for the City of Dublin at some future date to
join the County Service Area if the City Council wished to proceed with
membership in the Vector Control Assessment District .
The scope of services provided by vector control - includes-.. areas beyond
complaints regarding rodent problems . Vector control also includes related
nuisances such as complaints related to trash piles, etc. It is important
to have an agency which can appropriately respond - to , these problems. - "The
Alameda County Health Care Services Agency has personnel knowledgable in
these areas .
Given the fact that Staff has been unable to identify a qualified contractor
who is willing to provide vector control services to the City other than
Alameda County and the need to have an agency available to respond to vector
control and related complaints, it is recommended that the City engage the
services of the Alameda County Health Care Services Agency. The services
will be provided on an as needed basis as defined in the attached agreement . '
Staff believes that the County Health Services Agency has the manpower and
technical ability to address these problems . In addition, due to the fact
that current ordinances and codes refer to the County Health Officer as the
individual having citation power , it would be consistent to continue with
the County for this service . In the future, Staff will continue to monitor
the services rendered and evaluate any alternative proposals for the
provision of this service.
C O N T R A C T
This agreement made and entered into this day of ,
1984 , by and between the County of Alameda, a body corporate and
politic of the State of California,. hereinafter referred to as the
"County" and the City of Dublin, a municiipal corporation,
hereinafter referred to as "City" .
W I T N E S S E T H
WHEREAS, City is not located within the boundaries of
the County Service Area for Vector Control (V.C. No. 1984-1 ) , but
requests to contract for vector control services from the County
Service Area; and
WHEREAS, the City has agreed to pay for the costs of
services outlined in this agreement from its general funds .
NOW, THEREFORE, it is mutually agreed as follows :
1 . The County shall perform the following vector
control services :
a . Enforcement of Dublin City Ordinances and State
Health and Safety Code and Administrative Code
relating to vector control including refuse and
animal wastes . -
b. Investigation of public complaints and requests
for services concerning insect, rodent and .other
animal vectors as well as conditions conducive
to harboring vectors .
3 . The City shall pay for services provided at a rate
estimated at $51 . 00 per hour of service rendered under this
agreement . This charge shall be all inclusive of any costs
associated with overhead, materials, vehicles or other charges .
4 . The city shall be invoiced on a quarterly basis and
payment rendered to the County within 30 days of receipt of said
invoice. Invoice shall specify the number of hours of service
provided. Total charges for the term of this agreement shall not
exceed $8 ,925 unless the agreement is amended, in writing, by the
City Council . The money shall be expended by the County solely to
provide those vector control services as described in Paragraph
One ( 1 ) above, within the City of Dublin.
5 . The County shall keep a record of the monies
received from the City to assure proper accounting of the funds,
which will be deposited to the revenue account of the County
Service Area for Vector control (V. 0 1984-1 ) .
6 . The term of the contract begins on the date first
mentioned above and terminates on the 30th day of June, 1985 .
7 . The County shall defend and hold harmless the City,
its officers , and employees from any liability arising out of the
performance of this agreement .
8 . The contract shall be automatically renewed each
subsequent fiscal year subject to the following:
a . Provided neither party has terminated this -
agreement pursuant to provision ( d) below. an
addendum shall be approved by the governing
bodies of the City and County at the beginning
of the fiscal year .
b. Said addendum shall identify the amount of funds
allocated by City and projected level of
service, which will be provided.
c. This contract can be amended only by written
agreememt of both parties .
d . Either party shall have right to terminate this
contract by giving at least 30 days written
notice prior to the effective date of such
termination.
IN WITNESS WHEREOF, the City and County hereto have executed this
contract in quadruplicate on the first day and year mentioned
above.
