DESCRIPTION: On October 17, 1984, the City received a claim from Gino Riccardi for damages in the amount of $1 million. The claim is based on alleged pain and suffering, resulting from a traffic accident in which the claimant ' s son was fatally injured. The accident occurred on July 25, 1984 on Dougherty Road. The claim is alleging negligence on the part of the City with respect to road design, maintenance, and/or construction of the roadway and the placement of warning devices . Claimant , Gino Riccardi , is the natural father of the 12 deceased . As a proximate result -of the City and/or County-"' 13 negligent acts and/or omissions and subsequent demise of his' 14 son, the Claimant has suffered, and shall continue to suffer, 15 severe physical and emotional pain and suffering. Claimant 16 has forever lost the companionship and friendship of his son. 17 In addition, the Claimant has lost the companionship, love 18 and friendship of the potential grandchildren of his son. FACTS: About 2357 hours a citizen advised Unit 71, Deputy MULLEN, 44593, of a vehicle accident on Dougherty Road north of Amador Valley Boulevard. . I responded to the :.. area about 0001 hours on July 26 1984 and saw vehicle #1 overturned facing east in the northbound lane. Deputy MULLEN was already on the scene, had requested a, fire and ambulance and was in the process of ascertaining in'uries.' .. - 'Dublin San Ramon Fire had been notified and-Fire lEngine #141 with 'Ca to n�DENT - - � . and fire fighters DUBUQUE and PINTO had responded. '.. Fireman PINTO examined the ,, driver RICCARDI and advised he could find no vital signs. s., SCENE: DouRhertV Road at Mile Marker 1.46 where the accident 'occurred a two lane 49° left turn with about a 5° banked grade. The lanes are separated by painted ,. solid lines. The surface of the roadway is composed of asphalt and is in good condition. Upon my arrival the surface was free of any loose dirt or. debris. At e.' the point of impact, the turn is bound by steel guard rails with open fields on both sides. Prior to entering the turn there is a 25 MPH advisory_ safety sign and 9. a series of yellow reflectorized warning indicator signs. - ,e, As you approach the turn traveling northbound, there is clear vision with no visual obscurements. The weather conditions at the time of the accident was clear ,,. and dry. Road traffic was light and there is no artificial light source in the area. ,a. VEHICLE DAMAGE: Vehicle had damage to front left fender and rear quarter, broken wind-- sheild, driver's side window, and mirrors broken. Rear suspension was ,., bent. Massive damage to front. Interior compartment was intact and appeared to have little damage. ,s.. LOCATION OF DRIVER: The driver was lying face-up, motionless, with his body parallel ,,, with the vehicle. He had extensive damage to the top of his head and his arms were bent and twisted in separate directions. WITNESS STATEMENTS: REED said that they were at a friends house in Pleasanton; RICCARDI _ had drunk a couple of beers there and they were on their way home. She did not know where the house was located or how RICCARDI had gotten possession of the beer.' RICCARDI was driving the vehicle and thev were following BRYANT who was in front of them. She didn't ,. know how fast they were going but she said it was in excess of the ; ... seed limit. 6. 7. They were driving northbound on Dougherty Road and as the . entered into the left turn at Mile Marker 1.46 RICCARDI drove up over the dirt embankment. The next .thing she remembered was the vehicle collidin . 1 6. with a fence and seeing sparks flying alongside the vehicle. =The I vehicle then be an s inning and overturning. 9. Witness BRYANT said that he was with RICCARDI and REED at a house- .- in Pleasanton. They had a few beers and then were enroute home via Dougherty Road. He was in front of RICCARDI and REED in his own vehicle. He had already driven through the left turn and was about ,Z 400 yards in front of them when he saw in his rear view mirror the- tail lights of RICCARDI's vehicle flying through the air. He turned around to see what happened and found the vehicle overturned in the roadway. RICCARDI was hanging part way out of the vehicle with REED underneath his leas. He pulled RICCARDI off her and of her ,6. out of. the vehicle. Witness BEAKY said that he was northbound on Dougherty Road and driving ,6 about 55 MPH. When he first saw RICCARDI it was as RICCARDI had just passed him on the right side where northbound Dougherty Road changes ,T from two lanes to one. BRYANT was in front of RICCARDI and the were both traveling at a high rate of speed. The vehicles continued 16 north on Doug erty Road and drove out of BEAKY's view. As BEAKY drove around the left turn, he said that there was a large dust cloud on the roadway. As he drove through the dust he saw RI CARDI' vehicle overturned. BRYANT was already on the scene. 20 Because of the emotional state of the witnesses, they will have to be 21, recontacted for more detailed signed statements. ZZ. POINT OF IMPACT was determined to be 66'4" north of Mile Marker 1.46 at the east shoulder of the roadway (see diagram) . POINT OF REST: The vehicle was overturned lying on its roof in the northbound lane of Z,. Dougherty Road. The front of the vehicle was facing east. Upon arrival I observed that the accident scene be aarlht•bromuToyota~SR5a2adoorended northward from this point. North of mm 1.46 Z observed g ._ _ hatchback sedan settin on its to partially in the north-bound land with the front of the } vehicle being at the shoulder area. was heavily:damaged, ,although intact, :an d the left side windows had been broken out. Laying along*side' of the exterior of the left side of the vehicle was the body of a white male juvenile who appeared to have suffered severe head injuries with a considerable ammount of bleeding from the head and face area. The body was in a face down position and slightly resting on the right side. ._._..,- The accident was being investigated by Deputies, NELSON and ATKINSON at the time of my arrival (see accident report and investigation by the above officers for full, complete description of the accident scene and diagram) . Following my observation of. the scene and.the victim a .. series of forty ei scene hoto ra hs were taken with 35 mm color tint film. ' These photos included f the vehicle, the victim and the overall scene. Upon arrival of the Alameda County Coroner's Office about 0230 .hrs, RICCARDI's body was moved from its position and it was observed that at the right rear ortion of his head he had suffered a severe, depressed type of injury to the skull with an indentation appearing to be about 1/2" deep and about 2-3" in length This was apparently caused b the victim being at least partially ejected from the vehicle and having his head crushed, apparently by the body ; of the vehicle upon rolling The body was removed b the coroner's office about 0310 hrs and they advised on that they would be responsible for making all necessary notifications. Following this I assisted Dep. ATKINSON in protecting the scene until daylight when further investigation was completed.and the vehicle towed to be impounded for further investigation. REED states that she and RICCARDI had left a .residence..in.-the. city..pf__Pleasanton in_company with BRYANT who -was driving his own vehicle. REED, upon questioning, states that they had been at a house that she had not been to before . She and RICCARDI left in company with BRYANT as RICCARDI had to leave his mother's car at his house after he dropped off REED. RICCARDI was -then -to 'go off"---with-BR-Y-AV-T,in---his car. As they were proceeding north bound on Dougherty Rd through Dublin REED states that RICCARDI was driving quite fast. After passing Amador Valley Blvd, •REED -states-that RICCARDI-was driving at speeds between 65 mph and 70 mph. As they approached the turn near mm 1.46 on Dougherty Rd REED states that RICCARDI didn't slow down for the hard left -turn-;-even -though she could see the warning placards at the side of the road. REED states that RICCARDI at first began to try to turn the vehicle but that after it -began to-slide - (possibly in gravel) - he appeared to "lock up", holding the steering wheel rigidly. She states that she doesn't - think he ever attempted to apply the brakes. REED states that the only other things she - remembers is the vehicle going up on an embankment and then going through a fence and beginning to tumble end over end. Michael John RICCARDI was the driver of an automobile northbound on Dougherty Road. He suffered multiple blunt injuries when the vehicle left the roadway and collided with a fence and with a steel fence support, before becoming airborne after driving over a dirt embankment. The vehicle then rolled end over end,-before coming to rest on its roof, with RICCARDI partially ejected out the window. Ethanol: 0.14 GM% (blood). Barbiturates: 0 mcg/ml (blood).
