FINANCIAL STATEMENT: The amount of sewage` capacity available;_,to 'the City
could impact the City's economic base. -
DESCRIPTION The members of the Livermore Amador Villey Water -
Management Agency are presently attempting to. reach a negotiate d
settlement regarding the percentage of sewage capacity each agency
should receive from the 4 .4 million gallon per day sewage expansion
project authorized by the voters of the •Vall.ey 'on June . 5, =1984 . }'"= '===
As indicated in the attached Measure K Ballot Measure � language, ` the - :
voters approved the expansion project,- with each member agency
receiving 33% of the capacity.
The City has received a letter from the Dublin San Ramon Services
District asking if the City of Dublin has a position with -respect -to
the sewage capacity distribution issue. • The District- would like to
know if the City Council would support either of the following
negotiating positions .
1. . ...33% split for all LAVWMA member 'agencies
2 .' A settlement which 'would give the Dublin San Ramon Services
District a little less than 33%. - --
It is staff ' s recommendation that the City Council consider the matter
and direct staff to respond appropriately.

Tuesday our Board and Legal Counsel reviewed the
status;'of-'.the LAVWMA project and directed me to have you
query your City Council about its feelings vis-a-vis the u
1/3 capacity split between the three LAVWMA agencies. .The ;-

question is : Does the City Council want us to stand fast o
'with ':the X1/3 formula or attempt to obtain a negotiated -, :r. ;
settlement which may not give us 1/3 immediately , but
would 'eventually result in our obtaining that amount or .a ,...

The next Board meeting is February 5 , and prior to
that date we would appreciate receiving a letter stating
your City .Council ' s objections or concurrence in ,this
matter .

the voters within its boundaries before any modifications or
