DESCRIPTION: Section 17958 Health and Safety Code requires the City to adopt various model codes within one year after they have been adopted by the State Department of Housing and Community Development (HCD) . HCD adopted the 1984 National Electrical Code in September 1984 . The 1984 National Electric Code reflects the latest development in the electrical industry. In many instances the changes reflect clarifications . Comments from interested parties were solicited. The only respondent supported the ordinance . City Clerk Y s 7 i TO INTERESTED PARTIES Attached are copies of three Ordinances which are proposed for adoption by the City of Dublin . Your comments are solicited. Item 1 . This Ordinance adopts the 1984 National Electrical Code No amendments are proposed. Item 2 . This Ordinance adopts the provisions . of Title 24 Cali ornia Administrative Code relating to accessibility of buildings to the physically handicapped. Section 1 pertains to r.esidential buildings , and Section 2 pertains to all other buildings . It is the intention of this proposal to eliminate conflicts with Title 24 and the Uniform Building Code by adopting the provisions of Title 24 . Item 3 . This Ordinance amends Section 12 .11 relating to expiration of permits by adding Exception "1" and renumbering existing Exception "1" to Exception "2" . Section 12. 12 is : amended by adding, "or arrange for inspections as specified in i Section 12.15. " Section 12 :15(b) is amended by adding a new paragraph. The purpose of these changes is to aid in making inspections of minor work as soon as possible after the work is completed. Typically a permit expires in one year. This proposal would allow the Building Official to establish an expiration date for minor work. It is proposed that the date would be established at the time of issuance, and the date would be established based on the applicant' s estimate of time necessary to complete the job. j This proposal would also allow the Building Official to refuse to issue pe kits to licensed contractors whenever they have failed to arrange for inspections on other completed projects. If the contractor does not arrange for inspections of minor work, it will not be inspected until after a year has passed by and the permit has expired. If corrections are required, this creates a problem for the owner and contractor. Under this proposal the follow-up usually made on expired permits will be commenced sooner because of the shorter expiration period. Thus, additional protection will be afforded the owners when corrections are necessary. Finally, it is proposed to withhold issuance of permits where contractors have consistantly neglected to arrange for inspection of minor work. This request was forwarded to me by the East Bay Chapter, American Institute of Architects. I am chairman of the Codes Committee , but I speak- in this communication as an individual , since our committee has ceased meeting for the summer. The two ordinances regarding the adoption of the 1984 National Electrical Code and Title 24 of the California Administrative Code are wholeheartedly supported . I applaud your efforts toward establishing a uniform code for the City of Dublin. I also support your amendment to Chapter 1 , Article 2 , Section 12 . 11 ( a) and Section 12. 12. I would , however, like to express some concern regarding Section 12 . 15 (b) .• As worded, this section would allow the building official to refuse to issue a permit to a contractor when said contractor has not arranged for inspection on other projects. My concern is that the contractor' s failure to perform on one project may jeopardize the progress of a second project. This could cause an undue hardship on the part of the second Owner. I believe your intent is to utilize this section for relatively small projects, such as those outlined in the proposed Section 12 . 11 . Perhaps this issue could be clarified by adding a reference to this type of work in this section. Thank you for the opportunity to respond and comment on these proposals.
